본 약관 제22조에는 미국 에어비앤비를 상대로 제기되는 모든 손해 배상 청구에 적용되는 중재 합의 및 집단 소송 포기에 관한 사항이 명시되어 있습니다. 약관의 해당 조항을 주의 깊게 읽으시기 바랍니다.

에어비앤비를 이용해 주셔서 감사합니다.

본 이용 약관(이하 '약관')은 에어비앤비 웹사이트, 애플리케이션 및 기타 에어비앤비 제공 서비스(총칭하여 '에어비앤비 플랫폼') 이용에 관한 사용자의 권리에 적용되는 회원님과 에어비앤비 사이의 구속력 있는 법적 계약입니다. 본 약관에서 사용되는 '에어비앤비' 또는 '당사'라는 용어는 회원님이 계약을 체결하고 있는 에어비앤비 주체(부속서 1에 명시)를 지칭합니다.

에어비앤비 플랫폼은 사용자('회원')가 서비스를 게시, 제공, 검색, 예약할 수 있도록 해줍니다. 서비스를 게시하고 제공하는 회원은 '호스트'이며, 서비스를 검색, 예약 또는 사용하는 회원은 '게스트'입니다. 호스트는 숙소('숙소'), 액티비티, 투어, 행사('체험'), 다양한 여행 및 기타 서비스(총칭하여 '호스트 서비스', 제공되는 개별 호스트 서비스는 '리스팅')를 제공합니다. 에어비앤비 플랫폼 제공자로서 당사는 그 어떠한 리스팅, 호스트 서비스나 여행 서비스도 소유, 통제, 제공, 관리하지 않습니다. 호스트와 게스트 사이에 직접 체결된 계약에 있어 에어비앤비는 계약 당사자가 아니며, 부동산 중개업체나 여행사 또는 보험사 역시 아닙니다. 에어비앤비는 결제 서비스 약관('결제 약관')에 명시된 경우를 제외하고는 회원의 대리인 역할을 하지 않습니다. 에어비앤비의 역할은 제15조에 자세히 규정되어 있습니다.

에어비앤비는 당사의 개인정보 수집 및 사용 방식을 설명하는 개인정보 처리방침, 에어비앤비 결제 주체(총칭하여 '에어비앤비 페이먼츠')가 회원에게 제공하는 결제 서비스에 적용되는 결제 약관 등 본 약관을 보완하는 기타 약관정책을 유지합니다.

게스트 약관

1. 에어비앤비에서의 검색 및 예약

1.1 검색. 호스트 서비스 유형, 리스팅 유형, 여행 목적지, 여행 날짜, 게스트 수 등을 기준으로 호스트 서비스를 검색할 수 있습니다. 필터 기능을 사용하면 검색 결과 정확도를 높일 수 있습니다. 검색 결과는 검색어와의 관련성 및 기타 기준에 근거해 표시됩니다. 관련성에는 요금, 예약 가능 여부, 후기, 고객 서비스 상담 내역, 예약 취소 내역, 인기도, 이전 여행 내역 및 저장된 리스팅, 호스트가 설정한 조건(예: 최소 또는 최대 숙박 가능 일수) 등의 요인이 고려됩니다. 도움말 센터에서 검색 결과에 대해 자세히 알아보세요.

1.2 예약. 리스팅을 예약하면, 리스팅 요금, 에어비앤비 서비스 수수료, 오프라인 수수료, 관련 세금, 결제 시 표시되는 기타 항목 등 모든 예약 요금(총칭하여 '총 요금')을 지불하는 데 동의하는 것입니다. 호스트가 리스팅에 설정한 통화와 다른 통화로 결제하시는 경우, 표시되는 요금은 당사가 정한 환율에 따라 산정됩니다. 또한, 에어비앤비가 에어비앤비 페이먼츠를 통해 (본 약관 제14조에 명시된 바와 같이) 손해배상 청구액의 수금을 위해 (결제 서비스 약관에 명시된 바와 같이) 예약 시 사용한 결제 수단으로 청구하는 데 동의하는 것입니다.

예약 확정 메시지를 받으면 회원님과 호스트 간에 호스트 서비스 계약('예약')이 직접적으로 체결됩니다. 예약을 하면 계약 조건에 동의하는 것입니다. 계약 조건에는 본 약관은 물론, 환불 정책, 리스팅에 명시되어 있거나 예약 결제 시 안내받은 기타 규칙, 기준, 정책, 요건 등 예약에 적용되는 모든 조건이 포함됩니다. 리스팅을 예약하기 전에 이러한 약관과 예약에 적용되는 모든 조건(규칙, 기준, 정책 및 요건 등)을 포함한 계약 조건을 읽고 이해하는 것은 게스트의 책임입니다. 일부 호스트는 공동 호스트나 다른 팀원과 함께 호스트 서비스를 제공한다는 사실에 유념해 주세요.

1.3 숙소 예약. 숙소 예약은 숙소 출입, 점유 및 사용에 대한 제한적인 허가입니다. 호스트는 (i) 합리적으로 필요하고, (ii) 호스트와 게스트 간의 계약에 의해 허용되며, (iii) 관련 법규에서 허용하는 범위 내에서 게스트가 머무는 동안 숙소에 다시 들어갈 수 있는 권리를 보유합니다. 체크아웃 시간을 지나 숙소에 머물 경우, 호스트에게는 초과 숙박에 대해 관련법에서 허용하는 방식으로 합리적인 페널티를 부과하는 것을 포함하여 게스트를 숙소에서 퇴거시킬 권한이 있습니다. 최대 숙박 인원을 초과하여 숙박할 수 없습니다.

1.4 체험 및 기타 호스트 서비스 예약. 체험 또는 기타 호스트 서비스를 예약하면 해당 호스트 서비스에 참여, 참석하거나 해당 서비스를 이용할 수 있습니다. 본인과 본인이 초대하는 모든 사람이 최소 연령, 숙련도, 적합성 또는 기타 요건을 충족하는지 확인할 책임은 본인에게 있습니다. 질병, 신체 컨디션, 기타 상황으로 인해 체험이나 호스트 서비스에 참여하거나 참석하거나 서비스를 이용하는 능력에 영향을 받을 수 있는 경우, 이 사실을 호스트에게 알려야 할 책임은 회원님에게 있습니다. 명시적으로 승인된 경우를 제외하고, 예약 과정에서 추가 게스트로 포함하지 않은 다른 사람을 체험이나 호스트 서비스에 참여하도록 할 수 없습니다.

2. 취소, 예약 문제, 환불 및 예약 변경

2.1 취소, 예약 문제 및 환불. 일반적으로 게스트가 예약을 취소하면 해당 예약에 적용되는 호스트의 환불 정책에 따라 환불 금액이 결정됩니다. 그러나 특정 상황에서는 기타 정책이 우선적으로 적용되어 환불금이 결정됩니다. 통제할 수 없는 상황에 의해 예약을 취소해야 하는 경우, 에어비앤비의 정상참작이 가능한 상황 정책에 따라 일부 또는 전액 환불을 받으실 수도 있습니다. 호스트가 예약을 취소하거나 예약 문제(재예약 및 환불 정책에서 정의)가 발생한 경우, 재예약 및 환불 정책에 따라 재예약을 지원받거나 일부 또는 전액을 환불받을 수 있습니다. 특정 카테고리의 리스팅에는 다른 정책이 적용됩니다. 예를 들어 체험 예약에는 체험 게스트 환불 정책이 적용됩니다. 적용 대상과 각 상황에 따른 환불과 관련한 자세한 내용은 추가 법률 약관이나 정책을 참조하세요. 에어비앤비 고객지원 팀에 연락하여 당사의 결정에 대해 이의를 제기할 수 있습니다.

2.2 예약 변경. 게스트와 호스트가 에어비앤비 플랫폼을 통해 또는 에어비앤비 고객 서비스가 당사자를 대신해 직접 예약을 변경하도록 동의한 경우(이하 '예약 변경'), 게스트와 호스트는 해당 예약에 대해 책임을 지며 예약 변경으로 인해 발생하는 추가 금액, 수수료 또는 세금을 지불하는 데 동의합니다.

3. 회원의 책임과 위험 인수

3.1 회원의 책임. 회원님은 본인의 작위와 부작위에 대한 의무와 책임이 있으며, 숙소, 숙소가 있는 장소에서 숙소와 관련해 호스트와 게스트가 합법적으로 사용할 수 있는 모든 공간과 시설('공용 공간'), 체험 또는 기타 호스트 서비스에 참여하거나 이를 이용할 수 있도록 초대하거나 출입을 허용한 모든 사람의 작위와 부작위에 대해서도 책임을 집니다. 예를 들면 다음과 같은 책임이 있습니다. (i) 체크아웃할 때의 숙소 (및 관련된 개인 재산) 또는 공용 공간의 상태가 도착했을 때와 동일하도록 책임져야 하며, (ii) 합당한 수준의 손해 배상 청구 금액을 지급할 책임이 있으며, (iii) 정직하게 행동하고, 상대방을 존중하며, 관련 법률을 항상 준수해야 합니다. 미성년자인 추가 게스트를 대신해 예약하거나 미성년자를 호스트 서비스에 데려올 경우, 회원님에게 미성년자를 대리할 수 있는 법적 권한이 있어야 하며, 해당 미성년자를 감독할 책임은 전적으로 회원님에게 있습니다.

3.2 위험 인수. 회원님은 다양한 활동에 고유한 위험이 수반됨을 인정하며, 에어비앤비 플랫폼에 접속하고 에어비앤비 플랫폼이나 (제9조에서 정의한) 콘텐츠를 이용함으로써 발생하는 모든 위험에 대해 관련 법률이 허용하는 최대 한도에서 책임지는 것에 동의합니다. 여기에는 숙소에서의 모든 숙박, 체험 참여, 그 밖의 다른 호스트 서비스 이용 또는 직접 대면 또는 온라인을 통한 다른 회원과의 상호작용이 포함됩니다. 즉, 호스트 서비스가 본인에게 적합한지 여부를 확인할 책임은 본인에게 있습니다. 예컨대, 호스트 서비스에는 질병, 부상, 장애 또는 사망 위험이 따를 수 있으며, 회원님은 해당 호스트 서비스에 참여를 결정함으로써 자발적인 의지에 따라 상기 위험을 감수하는 것입니다.

호스트 약관

4. 에어비앤비 호스팅

4.1 호스트. 에어비앤비는 호스트에게 에어비앤비 플랫폼 및 서비스를 본 약관에 따라 사용하고 숙소, 체험 또는 기타 호스트 서비스를 활발한 게스트 커뮤니티와 공유하며 이를 통해 수입을 올릴 수 있는 권리를 제공합니다. 리스팅은 간편한 방식으로 등록할 수 있으며, 각 리스팅의 요금, 예약 가능 날짜, 이용규칙 등 호스팅 방식은 호스트가 결정합니다.

4.2 게스트와의 계약. 예약 요청을 수락하거나 에어비앤비 플랫폼을 통해 예약이 확정되면, 회원님은 게스트와 직접 계약을 체결하게 되는 것이며, 리스팅에 명시된 가격으로 약관에 따라 호스트 서비스를 제공할 책임이 있습니다. 또한 에어비앤비 서비스 수수료(및 관련 세금)를 지불하는 데 동의하시게 됩니다. 에어비앤비와 회원님이 별도의 결제 수단을 사용하기로 동의하지 않는 한 Airbnb Payments는 회원님이 에어비앤비에 지불해야 할 금액을 대금 수령액에서 차감합니다. 게스트와의 추가 계약에 포함되는 모든 약관 또는 조건은 (i) 본 약관, 에어비앤비의 추가 법률 약관, 정책 및 리스팅 설명에 제공된 정보와 일치해야 하며, (ii) 리스팅 설명에서 잘 보이게 명시되어야 합니다.

4.3 호스트의 독립성. 회원님과 에어비앤비와의 관계는 독립적인 개인 또는 주체의 관계이며, 회원님은 에어비앤비의 직원, 대리인, 합작 투자자 또는 파트너가 아닙니다. 단, 에어비앤비 페이먼츠는 결제 약관에 따라 결제 수금 대리인의 역할을 합니다. 에어비앤비는 호스트 서비스를 지시하거나 통제하지 않으며, 회원님은 호스트 서비스를 제공할지 여부와 제공 시기, 요금과 제공 조건 등과 관련해서 호스트 본인에게 전적으로 재량권이 있다는 사실을 이해합니다.

5. 리스팅 관리

5.1 리스팅 등록 및 관리. 에어비앤비 플랫폼은 리스팅을 쉽게 설정하고 관리할 수 있는 도구를 제공합니다. 리스팅 페이지에는 호스트 서비스, 요금, 청소비·리조트 수수료·오프라인 수수료와 같은 기타 비용, 게스트 또는 리스팅에 적용되는 모든 규칙이나 요건에 대한 완전하고 정확한 정보가 포함되어야 합니다. 회원님은 본인의 작위 또는 부작위에 대해 책임을 집니다. 또한, (예약 가능 여부를 확인할 수 있는 달력을 포함한) 리스팅 정보와 (사진 등의) 콘텐츠를 항상 최신 상태로 정확하게 유지할 책임 역시 회원님에게 있습니다. 회원님에게는 제공하는 호스트 서비스에 적합한 보험에 가입할 책임이 있으며, 보장 내역 및 예외 사항을 포함한 보험 약관을 주의 깊게 검토하는 것이 좋습니다. 숙박시설당 하나의 리스팅이 원칙이지만, 해당 숙박시설에 게스트가 머물 공간이 여럿인 경우, 단일한 숙박시설이라도 여러 개의 리스팅을 등록할 수 있습니다. 체험을 제공하는 경우 에어비앤비의 체험 호스트를 위한 추가 약관이 적용됩니다.

5.2 법적 의무 알기. 리스팅 또는 호스트 서비스에 적용되는 법규, 규정, 제3자와의 계약을 이해하고 준수할 책임은 회원님에게 있습니다. 예를 들어, 일부 임대인 및 임대전문업체 또는 주택 소유자 연합 및 공동주택 협회에서는 전대, 단기 임대 및/또는 장기 숙박을 제한하거나 금지하고 있습니다. 일부 도시에서는 주거용 부동산의 단기 임대를 제한하는 구역을 별도로 지정하거나 단기 임대를 제한하는 관련 법률을 시행하기도 합니다. 일부 관할권에서는 호스트가 특정 호스트 서비스(예: 단기 임대, 장기 숙박, 식품 조리, 판매 목적으로 주류 제공, 가이드 투어 또는 차량 서비스)를 제공하기 전에 등록, 허가 또는 면허를 취득해야 합니다. 일부 도시에서는 제공하려는 특정 호스트 서비스가 완전히 금지된 활동일 수도 있습니다. 일부 관할권에서는 숙소에 머무는 게스트를 등록해야 하거나, 게스트에게 임차 권한을 주고 호스트에게 추가 의무를 부과하는 법률을 시행하기도 합니다. 예를 들어 일부 지역의 장기 숙박의 경우, 임대인-임차인 관계, 임대료 제한, 퇴거에 관한 법규가 적용될 수 있습니다. 현지 규정을 살펴보고 제공하실 호스트 서비스에 어떤 규정이 적용되는지 확인하시기 바랍니다. 제공해드리는 법적 요건 관련 정보는 정보 제공 목적일 뿐이므로 본인에게 적용되는 의무는 개별적으로 직접 확인해야 합니다. 회원님은 게스트 및 기타 사용자의 개인정보를 취급하고 사용할 때 에어비앤비의 호스트 개인정보 취급 기준을 포함한 관련 개인정보 보호 법률 및 본 약관을 준수해야 할 책임이 있습니다. 현지 법규 적용과 관련한 의문점이 있다면 반드시 법적 자문을 구해야 합니다.

5.3 검색 결과. 에어비앤비 플랫폼 검색 결과에 표시되는 리스팅 순위는 다음과 같은 다양한 요인에 따라 달라집니다.

  • 게스트 검색 변수(예: 게스트 수, 목적지, 여행 시기 및 기간, 가격대)
  • 리스팅 특성(예: 요금, 예약 가능 여부, 게시된 이미지 개수 및 품질, 후기, 호스트 서비스 유형, 호스트 지위, 리스팅이 에어비앤비 플랫폼에 게시된 기간, 게스트 참여도 및 인기도)
  • 게스트 경험(예: 호스트의 고객 서비스 상담 내역 및 예약 취소 내역, 예약 편의성)
  • 호스트 설정 및 리스팅 적용 조건(예: 최소 또는 최대 숙박 가능 일수, 예약 마감 시간)
  • 게스트 환경 설정 및 이력(예: 이전 여행 내역, 조회 및 저장한 리스팅, 게스트가 검색을 진행하는 위치).

에어비앤비 모바일 애플리케이션의 검색 결과는 에어비앤비 웹사이트의 검색 결과와 다를 수 있으며, 지도 보기의 검색 결과도 다른 검색 결과와 다를 수 있습니다. 에어비앤비는 호스트가 추가 수수료를 지불하고 검색 결과 페이지나 에어비앤비 플랫폼 내 다른 공간에 리스팅을 홍보하도록 허용할 수 있습니다. 리스팅이 검색 결과에 표시되는 방식에 영향을 미치는 요인, 현재 진행 중인 프로모션 프로그램(해당하는 경우), 홍보 콘텐츠에 대한 에어비앤비의 정의에 대한 자세한 내용은 에어비앤비 도움말 센터에서 확인하실 수 있습니다.

5.4 회원의 책임. 회원님은 본인의 작위와 부작위에 대한 의무와 책임이 있으며, 호스트 서비스를 제공하는 데 있어 참여하도록 허용한 모든 사람의 작위와 부작위에 대해서도 책임을 집니다. 리스팅의 요금 책정과 이용규칙 및 요건에 대한 책임은 회원님에게 있습니다. 리스팅 설명에 반드시 모든 수수료와 요금이 명기되어 있어야 하며 에어비앤비 오프라인 수수료 정책에서 명시적으로 승인한 수수료를 제외하고는 에어비앤비 플랫폼 외부에서 추가 수수료나 요금을 수금할 수 없습니다. 게스트에게 제3자 계정을 만들도록 하거나, 외부 플랫폼에서 후기를 작성하게 하거나, 연락처 정보를 요청하거나, 에어비앤비 플랫폼 외부에서 다른 조치를 취하도록 유도하는 등 게스트가 플랫폼 외부 소통에 대한 에어비앤비 정책을 위반하는 행위를 하도록 유도해서는 안 됩니다.

5.5 팀 또는 조직으로서 호스팅하기. 공동 호스트와 함께, 또는 팀, 기업 및 기타 조직의 일원으로 호스팅하는 경우, 본 약관에 따라 회원님은 호스트 서비스 제공에 참여하는 각 주체와 개인의 작위와 부작위에 대해 호스트로서 책임을 집니다. 또한, 회원님은 호스트 서비스를 제공하기 위해 고용한 인력에게 본 약관에 따른 회원님의 의무에 대해 알릴 책임이 있습니다. 제3자가 제시하는 약관을 수락하거나 제3자와 계약을 체결하는 경우, 회원님은 본인이 소속된 팀, 기업 또는 조직을 대표해 계약을 체결하고 팀, 기업 또는 조직을 구속할 권한이 있으며, 회원님이 이용하는 각 주체는 사업장 소재지의 법규하에 양호한 상태임을 진술하고 보증합니다. 회원님이 다른 기능을 수행하는 경우, 해당 기능을 수행할 권한이 본인에게 있음을 진술하고 보증합니다. 회원님이 에어비앤비에 공동 호스트 또는 다른 호스트에게 대금 수령액의 일부를 이체하거나 다른 사람에게 대금을 보내도록 지시하는 경우, 회원님은 이러한 지급 요청을 실행할 권한이 있어야 하며, 제공하신 지급액 및 지급 정보의 정확성에 대한 책임은 회원님에게 있습니다.

5.6 위험 인수. 회원님은 호스팅에는 고유한 위험이 수반됨을 인정하며, 본인이 에어비앤비 플랫폼에 접속하고 플랫폼을 이용하거나 호스트 서비스를 제공하거나 다른 회원과 직접 대면이나 온라인을 통해 상호작용함으로써 발생하는 모든 위험에 대해 책임지는 것에 동의합니다. 회원님은 에어비앤비 플랫폼 및 리스팅이나 호스트 서비스에 적용될 수 있는 관련 법령·규칙·규정 또는 의무를 조사할 기회를 가졌으며, 에어비앤비가 게시한 법적 설명에 의존하지 않음에 동의합니다.

6. 취소, 예약 문제 및 예약 변경

6.1 취소 및 예약 문제. 일반적으로 게스트가 예약을 취소하면, 해당 예약에 적용되는 환불 정책에 따라 환불 금액이 결정됩니다. 에어비앤비의 정상참작이 가능한 상황 정책 또는 관련 법규에 따른 정당한 이유가 있는 경우가 아닌 한, 호스트는 게스트의 예약을 취소해서는 안 됩니다. 정당한 이유 없이 게스트의 예약을 취소하면 취소 수수료와 기타 불이익이 부과될 수 있습니다. (i) 게스트가 (재예약 및 환불 정책에 정의된 바와 같은) 예약 문제를 겪거나, (ii) 정상참작이 가능한 상황이 발생하거나, (iii) 본 약관 제12조에 따라 예약이 취소되는 경우, 에어비앤비가 게스트에게 환불하거나 다른 방법으로 제공한 금액 및 취소로 인해 발생하는 기타 합리적인 비용은 회원님께 지급되는 대금에서 차감됩니다. 회원님께 대금이 이미 지급된 후 게스트가 예약금을 환불받거나, 에어비앤비가 부담한 환불 및 기타 비용이 수령 대금을 초과하는 경우, 에어비앤비는 (에어비앤비 페이먼츠를 통해) 향후 지급되는 대금에서 환불금을 차감하는 등 해당 차액을 회원님으로부터 회수할 수 있습니다. 에어비앤비의 재예약 및 환불 정책, 정상참작이 가능한 상황 정책 및 본 약관에 따라 게스트에게 예약 취소 및/또는 환불 처리가 허용되는 상황에서는 이러한 정책과 약관이 회원님이 설정하신 환불 정책보다 우선적으로 적용되는 데 동의합니다. 에어비앤비는 이러한 정책 중 하나에 따라 게스트에게 예약금을 환불할 것이 합리적으로 예상되는 경우, 환불 결정이 내려질 때까지 해당 예약에 대한 대금 지급을 지연시킬 수 있습니다. 체험을 호스팅하는 경우, 체험 환불 정책, 체험 게스트 환불 정책 및 다른 취소 수수료와 제재 조치가 예약에 적용된다는 점을 유념해 주시기 바랍니다. 정책 적용 대상과 각 상황에 따라 호스트가 수령할 대금과 관련한 자세한 내용은 각 정책을 참조하세요.

6.2 예약 변경. 게스트와 호스트가 에어비앤비 플랫폼을 통해 또는 에어비앤비 고객 서비스가 당사자를 대신해 직접 예약을 변경하도록 동의한 경우, 게스트와 호스트는 해당 예약에 대해 책임을 지며 예약 변경으로 인해 발생하는 추가 금액, 수수료 또는 세금을 지불하는 데 동의합니다.

7. 세금

7.1 호스트와 세금. 호스트는 관련 법률에 따라 부가가치세나 기타 간접세, 숙박세, 관광세, 소득세 또는 기타 세금('세금')을 신고, 징수, 납부 또는 요금에 포함해야 할 의무가 있는지 파악하고 납세 의무를 이행할 책임이 있습니다.

7.2 에어비앤비의 징수 및 납부. 에어비앤비에서 호스트를 대신해 세금을 징수 및/또는 납부하는 지역의 경우, 회원님은 에어비앤비가 회원님을 대신하여 세금을 수금하고 관할 세무당국에 납부하도록 지시하고 이를 승인합니다. 에어비앤비에서 회원을 대신해 징수 및/또는 납부하는 모든 세금은 회원 계정의 거래 내역에서 확인할 수 있습니다. 에어비앤비에서 징수 및/또는 납부한 세금이 회원의 납세 의무를 이행하기에 충분하지 않은 경우, 당사는 회원에게 추가적인 금액을 청구할 수 있으며, 회원님은 관련 세무 당국으로부터 에어비앤비가 수금한 세금을 환급받는 것이 징수된 세금에 관해 본인이 행사할 수 있는 유일한 구제수단임에 동의합니다. 또한 회원님은 에어비앤비가 여하한 사유로든 해당 관할지에서 해당 사안으로 인해 영향받는 회원에게 사전 통지하고 세금 징수와 납부를 중단할 권리가 있음을 인지하고 이에 동의합니다.

7.3 세금 정보. 특정 관할권에서는 현지 세금 규정에 따라 에어비앤비가 회원님에 대한 세금 정보를 수집 및/또는 보고하거나, 지급하는 대금에서 세금을 원천징수하거나, 두 가지 모두를 이행해야 할 수 있습니다. 원천 징수 의무 이행에 필요하다고 판단되는 서류를 제공하지 않을 경우, 충분하다고 판단되는 서류가 제출될 때까지 회원님께 지급될 대금에서 관련 법규에서 요구하는 세액만큼을 지급 보류할 수 있습니다. 세금을 정확하게 신고하는 데 도움이 되도록 에어비앤비는 호스트를 대신해 호스트 서비스에 대한 부가가치세(VAT), 상품서비스세(GST), 소비세 또는 기타 세금에 대한 영수증이나 비슷한 성격의 서류를 발급할 수 있습니다.

8. 후기

호스트 서비스 제공이 종료되면 게스트와 호스트는 서로에 대해 후기를 작성할 기회를 갖습니다. 후기는 정확해야 하며, 본 약관, 관련 법률, 에어비앤비의 콘텐츠 정책 또는 후기 정책을 위반하는 차별적, 모욕적이거나 타인의 명예를 훼손하는 부적절한 표현은 일체 사용하실 수 없습니다. 에어비앤비는 후기의 정확성을 검증하지 않으며, 후기가 정확하지 않거나 사실을 오도하는 경우도 있을 수 있습니다.

9. 콘텐츠

에어비앤비는 사용자가 플랫폼 일부에 피드백, 텍스트, 사진, 오디오, 동영상, 정보 및 기타 콘텐츠('콘텐츠')를 올릴 수 있도록 허용합니다. 회원님은 형태와 방식을 불문하고 콘텐츠를 제공함으로써, 현재까지 알려져 있거나 알려지지 않은 여하한 매체 또는 플랫폼, 특히 인터넷과 소셜 네트워크에서 에어비앤비 플랫폼을 제공하거나 또는 홍보할 목적으로 해당 콘텐츠를 접근, 사용, 저장, 복사, 수정, 배포, 게시, 전송, 스트리밍, 방송하고 그에 대한 파생저작물을 제작하며 기타 방법으로 이용할 수 있는 비배타적이고, 전 세계적이고, 로열티가 부과되지 않으며, 영구적이며, 2차 라이선싱과 양도가 가능한 라이선스를 에어비앤비에 허여합니다. 콘텐츠에 개인정보가 포함된 경우, 해당 콘텐츠는 당사의 개인정보 처리방침에 따라 관련된 개인정보보호법을 준수하는 경우에만 이러한 목적으로 사용됩니다. 에어비앤비가 콘텐츠 제작 비용을 지불하거나 콘텐츠 제작을 가능케 하는 경우, 에어비앤비는 해당 콘텐츠를 소유할 수 있으며, 이 경우 보충 약관 또는 안내 공시에 이 사실이 명시됩니다. 제공하시는 모든 콘텐츠에 대한 책임은 전적으로 본인에게 있으며, 회원님은 해당 콘텐츠에 대한 소유권을 보유하고 있거나 본 약관에 기술된 권한을 에어비앤비에 부여할 권한이 있음을 보증합니다. 콘텐츠의 어느 부분이라도 제3자의 지식재산권 또는 개인정보 보호권을 침해하거나 위반하는 경우 이에 대한 책임은 회원님에게 있습니다. 콘텐츠는 차별, 외설, 괴롭힘, 기만, 폭력, 불법 콘텐츠 등을 금지하는 당사 콘텐츠 정책차별 금지 정책을 준수해야 합니다. 회원님은 에어비앤비가 콘텐츠를 번역할 수 있는 서비스나 자동화 도구를 제공할 수 있으며, 그러한 서비스나 도구를 사용하여 콘텐츠가 번역될 수 있음에 동의합니다. 에어비앤비는 번역의 정확성 또는 품질을 보증하지 않으며, 해당 번역의 정확성을 확인할 책임은 회원에게 있습니다.

10. 수수료

에어비앤비는 에어비앤비 플랫폼 이용권에 대한 대가로 호스트와 게스트에게 수수료(및 관련 세금)를 부과할 수 있습니다. 서비스 수수료가 부과되는 경우 및 수수료 산정 방식에 관한 자세한 정보는 서비스 수수료 페이지에서 확인하실 수 있습니다. 적용되는 모든 수수료는 예약하기 전에 게스트에게 공개됩니다. 에어비앤비 플랫폼에 달리 규정되지 않은 한, 서비스 수수료는 환불되지 않습니다. 적용되는 법률에 의거하여 에어비앤비는 서비스 수수료를 언제든 변경할 수 있으며, 변경 전에 회원에게 적정한 통지를 제공합니다. 수수료 변경은 효력 발생일 이전에 이루어진 예약에 영향을 미치지 않습니다. 수수료 변경에 동의하지 않는 경우, 제12조2항에 따라 언제든 본 계약을 해지하실 수 있습니다.

11. 에어비앤비 플랫폼 규정

11.1 규정. 회원님은 다음 규정을 준수해야 하며, 다른 사람이 규정을 위반하거나 회피하도록 도와주거나 유도해서는 안 됩니다.

  • 정직하게 행동하고 다른 사람들을 존중해야 합니다.
    • 거짓말을 하거나, 인물이나 대상을 왜곡되게 표현하거나, 타인을 사칭해서는 안 됩니다.
    • 다른 사람과 소통하거나 교류할 때는 예의 바르게 행동하고 상대를 존중해야 합니다.
    • 중복 계정·리스팅을 만드는 등의 방식으로 본 약관, 추가 법률 약관, 에어비앤비 정책 또는 기준의 적용을 회피하려고 시도해서는 안 됩니다.
    • 에어비앤비 차별 금지 정책을 준수해야 하며, 다른 사람을 차별하거나 괴롭혀서는 안 됩니다.
  • 에어비앤비 플랫폼을 스크레이핑, 해킹, 손상, 역설계해서는 안 됩니다.
    • 에어비앤비 플랫폼에서 데이터나 기타 콘텐츠에 접근하거나 이를 수집하거나 그 밖에 다른 방식으로 상호 작용하는 데 있어 봇, 크롤러, 스크래퍼 또는 기타 자동화된 수단을 사용해서는 안 됩니다.
    • 에어비앤비 플랫폼 또는 콘텐츠를 보호하기 위해 사용되는 보안 또는 기술 조치를 해킹, 회피, 삭제, 손상하거나 여하한 방식으로 우회하려 시도해서는 안 됩니다.
    • 에어비앤비 플랫폼을 제공하는 데 사용되는 소프트웨어나 하드웨어를 해독, 역컴파일링, 분해 또는 역설계해서는 안 됩니다.
    • 에어비앤비 플랫폼의 성능이나 적절한 기능 수행에 손상을 주거나 악영향을 미칠 수 있는 어떠한 조치도 취해서는 안 됩니다.
  • 본 약관 또는 당사와 체결한 다른 계약에 의해 승인된 방식으로만 에어비앤비 플랫폼을 이용할 수 있습니다.
    • 에어비앤비 플랫폼을 통한 거래를 위해 필요한 경우에만 본 약관에 의해 승인된 방식으로만 다른 회원의 개인정보를 사용할 수 있습니다.
    • 회원의 명시적 동의 없이 에어비앤비 플랫폼, 메시지 도구 또는 회원의 개인정보를 이용하여 상업적 메시지를 보내서는 안 됩니다.
    • 에어비앤비 플랫폼을 통해 이용할 수 있는 콘텐츠는 게스트 또는 호스트로서 에어비앤비 플랫폼을 이용하는 데 필요한 목적으로만 사용할 수 있습니다.
    • 콘텐츠 소유자에게 허락받았거나 본 약관 또는 회원님이 당사와 체결한 다른 계약에 의해 사용이 승인되지 않는 한, 콘텐츠를 사용할 수 없습니다.
    • 수수료나 세금 회피 또는 기타 다른 이유로 에어비앤비 플랫폼 외부에서 예약 또는 결제를 요청하거나 진행하거나 수락해서는 안 됩니다. 예외가 적용되는 경우는 에어비앤비 오프라인 수수료 정책에서 확인하실 수 있습니다.
    • 에어비앤비의 승인을 받지 않는 한, 예약 이전·도중·종료 후에 게스트에게 제3자 사이트, 애플리케이션 또는 서비스에서 계정을 만들거나, 후기를 남기거나, 설문조사를 완료하거나, 기타 방식으로 이러한 제3자 사이트, 애플리케이션 또는 서비스를 이용하도록 요구하거나 권장해서는 안 됩니다.
    • 에어비앤비 검색 알고리즘을 조작하려는 그 어떤 행위에도 관여해서는 안 됩니다.
    • 호스트 서비스를 실제 이용하지 않는 한 호스트 서비스를 예약해서는 안 됩니다.
    • 에어비앤비 플랫폼, 모든 콘텐츠, 에어비앤비 브랜딩 또는 페이지 레이아웃이나 디자인을 당사의 동의 없이 사용, 복제, 전시, 미러링 또는 프레이밍해서는 안 됩니다.
  • 법적 의무를 준수해야 합니다.
    • 개인정보 보호, 데이터 보호, 데이터 해외 반출 관련 법률을 포함하여 본인에게 적용되는 모든 법률을 이해하고 준수하여야 합니다.
    • 회원님이 다른 사람의 개인정보를 에어비앤비에 제공할 경우, (i) 관련 법규를 반드시 준수하고, (ii) 반드시 해당인의 동의를 얻어야 하며, (iii) 에어비앤비가 당사 개인정보 처리방침에 따라 해당인의 개인정보를 처리할 수 있도록 승인해야 합니다.
    • 에어비앤비의 약관, 추가 법률 약관, 정책기준을 읽고 이를 준수해야 합니다.
    • 승인되지 않은 파티나 이벤트를 열거나 주최해서는 안 됩니다. 파티 및 이벤트 규칙에 규정된 내용에 따라 회원님은 본인의 예약 중 이루어지는 파티나 이벤트와 관련하여 위 규칙 위반에 대하여 책임을 집니다.
    • 에어비앤비 명칭, 로고, 브랜드, 상표 또는 기타 콘텐츠를 무단 사용해서는 안 되며, 에어비앤비 상표 가이드라인에 명시된 대로만 사용해야 합니다.
    • 에어비앤비 상표, 로고 또는 브랜딩과 혼동될 수 있을 정도로 유사한 도메인 이름, 소셜 미디어 계정 이름, 상표명, 상표, 브랜딩, 로고 또는 기타 출처 표기를 사용하거나 등록해서는 안 됩니다. 자세한 내용은 상표 가이드라인을 참조하세요.
    • 관련 법규나 본인에게 적용되는 계약을 위반하는 호스트 서비스를 제공해서는 안 됩니다.
    • 성매매를 제안·유도하거나 인신매매에 참여하거나 인신매매가 가능하도록 도와서는 안 됩니다.

11.2 위반 신고. 특정 회원, 리스팅 또는 콘텐츠가 즉각적으로 신체 또는 재산상의 위해를 가할 위험이 있다고 판단하면 에어비앤비에 연락하기 앞서 즉시 현지 당국에 신고해야 합니다. 마찬가지로 특정 회원, 리스팅 또는 콘텐츠가 에어비앤비 기준을 위반했다고 판단하면, 이를 에어비앤비에 신고해야 합니다. 현지 당국에 문제를 신고하신 경우, 에어비앤비에서 해당 신고서 사본을 요청할 수 있습니다. 법률에 의해 요구되는 경우를 제외하고, 에어비앤비는 신고에 대응할 의무가 없습니다.

11.3 저작권 통보. 에어비앤비 플랫폼에 게시된 콘텐츠가 저작권을 침해하고 있다고 판단하실 경우, 당사의 저작권 정책에 따라 당사에 통지하시기 바랍니다.

12. 해지, 일시 정지 및 기타 조치

12.1 기간. 본 약관에 반영된 회원님과 에어비앤비 간의 계약은 회원님이 에어비앤비 플랫폼에 접속(예: 회원 가입 및 계정 생성)할 때 효력이 발생하며, 회원님이나 에어비앤비가 본 약관에 따라 계약을 해지할 때까지 유효합니다.

12.2 계약의 해지. 당사에 이메일을 보내거나 계정을 삭제함으로써 언제든 본 계약을 해지할 수 있습니다. 에어비앤비는 30일의 기한을 두고, 회원님이 계정에 등록한 이메일이나 그 밖의 연락처로 통지함으로써 어떠한 이유로든 본 계약과 회원님의 계정을 해지할 수 있습니다. 회원님이 본 약관, 당사의 추가 법률 약관, 정책, 관련 법률을 위반하거나 에어비앤비가 당사, 회원 또는 제3자를 보호하기 위해 계약 해지가 필요하다고 합리적으로 판단하는 경우, 에어비앤비는 회원님과의 계약을 통지 없이 즉시 해지하고 에어비앤비 플랫폼 접속을 차단할 수 있습니다. 계정이 2년 이상 비활성화 상태인 경우, 사전 통지 없이 계정을 해지할 수 있습니다.

12.3 회원 위반. (i) 본 약관, 당사의 추가 법률 약관, 정책 또는 기준을 위반하는 경우, (ii) 관련 법률 또는 규정을 위반하거나 제3자의 권리를 침해하는 경우, (iii) 에어비앤비와 회원 또는 제3자를 보호하기 위해 에어비앤비가 합리적으로 필요하다고 판단하는 경우, 에어비앤비는 사전 통지 없이 다음과 같은 조치를 취할 수 있습니다.

  • 에어비앤비 플랫폼 및/또는 계정에 대한 접속 또는 사용을 일시 중지하거나 제한하는 조치
  • 리스팅, 후기 또는 기타 콘텐츠의 일시 중지, 삭제, 접근 제한 또는 공개 제한 조치
  • 진행 중이거나 확정된 예약을 취소하는 조치
  • 계정과 연계된 특별 지위를 일시 정지 또는 취소하는 조치

경미한 위반이거나 기타 적절하다고 에어비앤비가 단독 재량으로 판단하는 경우, 에어비앤비는 회원님에게 위반에 따른 제재 조치를 사전 통보하고 문제 해결 기회를 제공합니다. 본 조항에 따라 고객센터에 문의하고 당사가 취한 조치에 대해 이의를 제기할 수 있습니다. 본 조항에 따라 예약이 취소될 경우, 에어비앤비가 게스트에게 환불하거나 제공하는 금액 및 취소로 인해 발생하는 기타 비용은 호스트에게 지급되는 대금에서 차감됩니다.

12.4 법적 의무사항. 에어비앤비는 관련 법률 또는 법원, 법률 집행 기관 또는 기타 행정기관 또는 정부 기관의 명령 또는 요청을 준수하기 위해 제12조3항에서 명시한 방안을 포함하여 합리적으로 필요하다고 판단하는 조치를 취할 수 있습니다.

12.5 해지의 효력. 호스트인 회원이 에어비앤비 계정을 해지하면 모든 확정된 예약이 자동으로 취소되며 게스트에게는 예약금이 전액 환불됩니다. 게스트인 회원이 에어비앤비를 탈퇴하면 확정되어 있던 모든 예약이 자동 취소되며, 환불액은 해당 예약에 적용되는 환불 정책에 따라 결정됩니다. 본 계약이 해지된 경우, 회원님에게는 본인의 에어비앤비 계정 또는 콘텐츠의 어느 부분도 복구할 권리가 없습니다. 회원님의 에어비앤비 플랫폼 접근 또는 이용이 제한되거나, 에어비앤비 계정이 일시 중지되거나, 당사에 의해 본 계약이 해지된 경우, 회원님은 새로운 계정을 등록하거나 다른 회원의 계정을 통해 에어비앤비 플랫폼에 접속하거나 플랫폼을 이용할 수 없습니다.

12.6 존속 규정. 본 약관 중 제1조부터 제25조까지를 포함한 일부 조항은, 그 특성상 해지 후에도 효력이 유지되며 본 계약이 해지된 후에도 존속합니다.

13. 변경

에어비앤비는 본 약관을 언제든지 변경할 수 있습니다. 본 에어비앤비 약관에 주요한 변경사항이 있는 경우, 변경된 약관은 에어비앤비 플랫폼에 게시되며, 약관 상단에 '최종 수정일'이 기재됩니다. 아울러 에어비앤비는 변경된 약관이 발효되기 최소 30일 전에 이메일, 에어비앤비 플랫폼을 통한 통지, 메시지 서비스 또는 회원님이 선택하고 에어비앤비가 이용할 수 있는 기타 연락 수단을 통해 변경 사실을 고지합니다. 변경된 약관에 동의하지 않는 경우, 약관에 명시된 대로 본 계약을 즉시 해지하실 수 있습니다. 개정 약관의 발효일 전까지 계약을 해지하지 않고 계속 에어비앤비 플랫폼에 접속해 사용하는 경우, 변경된 약관에 동의하시는 것으로 간주합니다.

14. 진정 및 손해 배상 청구 해결

다른 회원이 회원님, 회원님의 게스트 또는 회원님의 반려동물이 다음과 같은 피해를 초래했다는 유효한 증거를 제시하는 경우

(i) 진정을 제기한 회원이나 숙소 소유주(숙소 소유주가 호스트가 아닌 경우)의 부동산 혹은 개인 재산, 또는 진정을 제기한 회원에게 책임이 있거나 경제적 이해관계가 있는 개인 재산 혹은 부동산에 피해를 입힘

(ii) 상기 (i)에 명시된 피해가 직접적인 원인이 되어 에어비앤비 플랫폼을 통한 예약 수입의 손실 또는 기타 간접적 손해가 발생함

(iii) 진정을 제기한 회원이 설정한 청소비를 초과하는 청소비를 부담하게 됨((i), (ii), (iii) 각각을 '손해 배상 청구'라 칭함)

진정을 제기한 회원은 이를 에어비앤비에 알리거나 해결 센터를 통해 배상을 요청할 수 있습니다. 상대 회원은 손해 배상 청구에 대한 통지를 받게 되며, 이에 대응할 수 있는 기회가 주어집니다. 회원님이 손해 배상금 지급에 동의하거나, 손해 배상 청구가 에어비앤비에 전달되어 에어비앤비가 단독 재량으로 해당 청구가 유효하며 책임이 회원님에게 있다고 판단하는 경우, 에어비앤비는 에어비앤비 페이먼츠를 통해 회원님으로부터 배상금을 수금할 수 있습니다. 회원님은 본인이 가입한 보험 정책에 따라 에어비앤비가 보험사로부터 손해 배상금을 회수하려 할 수 있으며, 관련 법률에 따라 회원님을 상대로 모든 구상권을 청구할 수 있음(추심 대행사에 위임, 회원님에 대해 가용한 소송 또는 청구 제기 포함)에 동의합니다. 손해 배상 청구, 회원의 진정 사항, 보험 약관에 따른 보상 청구 또는 호스트 서비스 제공이나 사용과 관련된 기타 청구와 관련하여 선의로서 협조하며, 에어비앤비가 요청하는 모든 정보를 제공하고, 서류를 이행하며, 합리적인 추가 조치를 취하는 데 동의합니다.

15. 에어비앤비의 역할

에어비앤비는 회원들이 호스트 서비스를 게시·제공·검색·예약할 수 있는 플랫폼에 대한 이용권을 제공합니다. 에어비앤비는 당사 서비스를 이용하는 회원들이 최상의 경험을 할 수 있도록 최선을 다하고 있지만, 게스트와 호스트의 행동을 통제할 수도, 통제하지도 않습니다. 회원님은 에어비앤비가 사용자의 플랫폼 이용을 모니터링하고 회원이 제공한 정보를 확인할 권한은 가지지만 의무는 없다는 사실을 인정합니다. 예를 들어, 에어비앤비는 (i) 에어비앤비 플랫폼 운영, 보안 유지, 개선하기 위한 목적(사기 방지, 위험 평가, 조사 및 고객 지원 목적 포함), (ii) 회원의 본 약관 준수를 보장하기 위한 목적, (iii) 관련 법률, 법원, 법률 집행기관 또는 기타 행정기관 또는 정부 기관의 명령 또는 요청을 준수하기 위한 목적, (iv) 유해하거나 부적절하다고 판단되는 회원 콘텐츠에 대응하기 위한 목적, (v) 본 약관에 명시된 기타 목적, (vi) 퀄리티 및 적격 기준을 충족하지 않는 리스팅을 삭제하는 등 모든 퀄리티 또는 적격 기준을 실행하고 유지하기 위한 목적으로 콘텐츠를 검토, 접속 차단, 삭제 또는 편집할 수 있습니다. 회원은 에어비앤비가 특정 상황에서의 정책 적용 여부와 적용 방식을 포함하여 당사의 추가 법률 약관, 정책(정상참작이 가능한 상황 정책 등)과 기준(호스트에게 요구되는 기본 요건 등)을 단독 재량에 따라 시행함을 인정하고 이에 동의합니다. 에어비앤비가 에어비앤비 플랫폼 이용 또는 악용에 관해 진행하는 조사와 관련하여 에어비앤비에 성실하게 협조 및 지원하고 관련 정보를 제공하며 에어비앤비가 합리적으로 요청한 조치를 취하는 것에 동의합니다. 에어비앤비는 결제 약관에 명시된 대로 Airbnb Payments가 수금 대리인 역할을 하는 경우를 제외하고는 회원의 대리인 역할을 하지 않습니다.

16. 회원 계정

에어비앤비 플랫폼의 여러 기능에 접속하고 이를 이용하려면 계정을 등록해야 합니다. 법인, 합작회사 및 만 18세 이상의 자연인에게만 계정 등록이 허용됩니다. 회원님은 미국, 거주지 또는 기타 관할지의 법규에 따라 에어비앤비 플랫폼의 이용이 금지된 개인 또는 주체가 아님을 진술하고 보증합니다. 회원님은 계정 등록 과정에서 정확하고 온전한 최신 정보를 제공해야 하며 계정 정보를 수시로 업데이트해야 합니다. 회원님은 타인에게 계정을 양도할 수 없습니다. 본인의 에어비앤비 계정 인증 정보의 기밀성과 보안을 유지할 책임은 회원님에게 있으며 이를 제3자에게 공개할 수 없습니다. 계정을 통해 수행된 활동에 대한 책임은 본인에게 있으며, 인증 정보가 분실되었거나, 도난되었거나 계정이 무단 사용된 것으로 의심되는 경우 즉시 에어비앤비에 알려야 합니다. 관련 법률이 허용하는 경우 허용 범위 내에서, 당사는 (i) 회원에게 신분증 또는 기타 정보를 제공해 달라고 요청할 수 있으며, (ii) 본인 인증이나 신원 확인 목적을 위해 설계된 확인 절차를 수행할 수 있으며, (iii) 제3자 데이터베이스 또는 기타 자료에 기반하여 회원의 신원을 조사하고 서비스 제공업체에 보고서를 요청할 수 있으며, (iv) 형사 기소, 성범죄자 등록 또는 이에 상응한 현지의 배경 조사 또는 성범죄자 확인 등에 관한 기록을 확보할 수 있으나 이는 의무사항이 아닙니다.

17. 보증의 부인

에어비앤비 플랫폼과 모든 콘텐츠는 어떠한 유형의 보증 없이 '있는 그대로'의 조건으로 제공되며, 에어비앤비는 명시적이든 묵시적이든 모든 유형의 보증을 부인합니다. 예를 들어, (i) 게스트, 호스트, 호스트 서비스, 리스팅 또는 제3자의 존재, 행동, 안전, 품질, 합법성 또는 적합성을 지지하거나 보증하지 않습니다. (ii) 에어비앤비 플랫폼 성능에 문제가 생기거나 운영이 중단되는 일이 없으리라고 보증하지 않습니다. (iii) 리스팅이나 회원에 대해 실시한 검증, 본인 인증 또는 신원 조회가 과거의 부정행위를 발각해 내고 미래의 부정행위를 방지할 수 있다고 보증하지 않습니다. 특정 회원 또는 리스팅에 대하여 '검증됨(또는 이와 유사한 표현)'이라고 표시한 경우는 해당 회원, 리스팅 또는 에어비앤비가 관련 검증 또는 본인 인증 절차를 마쳤다는 것을 의미할 뿐 다른 의미는 없습니다. 본 약관에서 명시된 면책 조항은 법률에서 허용하는 최대 범위 내에서 적용됩니다. 에어비앤비가 부인할 수 없는 법적 권리나 보증이 있는 경우 회원님은 이를 행사할 수 있으나, 법적으로 요구되는 이와 같은 권리나 보증 기간은 법에서 허용하는 최대 수준으로 제한됩니다.

18. 책임 제한

에어비앤비(계열사 및 임직원 포함) 또는 에어비앤비 플랫폼 또는 콘텐츠의 생성, 제작 또는 교부에 관련된 기타 당사자는 부수적, 특별, 징벌적 또는 결과적 손해에 대한 책임을 지지 않습니다. 이러한 손해에는 (i) 본 약관, (ii) 에어비앤비 플랫폼 또는 그 어떤 콘텐츠의 이용 또는 이용 불가능, (iii) 다른 회원 또는 에어비앤비 플랫폼을 통해 또는 플랫폼 이용의 결과로 소통하거나 만나는 타인과의 모든 의사소통, 상호작용 또는 만남, 또는 (iv) 호스트 서비스 제공 또는 사용을 포함한 회원님의 리스팅 게시 또는 예약으로 인해 발생하거나 그와 관련된 일실 이익, 데이터 유실 또는 영업권 상실, 서비스 중단, 컴퓨터 파손 또는 시스템 고장 또는 대체 제품 또는 서비스 비용, 또는 개인적∙신체적 상해 또는 정신적 고통에 대한 손해 배상이 포함되고, 보증, 계약, 불법행위(과실 포함), 제조물 책임 또는 기타 법리에 기한 것인지 여부 및 에어비앤비가 해당 손해의 가능성을 고지받았는지 여부를 불문하며, 본 약관에 명시된 제한적 구제수단이 그 주요 목적달성에 실패한 것으로 판명된 경우에도 적용됩니다.

본 약관, 에어비앤비 호스트 손해보상 프로그램에 따라 승인된 결제 요청에 따라 호스트에게 대금을 지급해야 하는 당사의 의무를 제외하고, 본 약관, 다른 회원과의 소통, 또는 에어비앤비 플랫폼, 모든 콘텐츠, 또는 호스트 서비스의 이용 또는 이용 불가능으로 인하여 또는 이와 관련하여 에어비앤비가 책임을 부담하는 총금액은 어떠한 경우에도 (A) 게스트인 경우, 책임이 초래된 사유가 발생하기 전 12개월 동안 게스트로서 에어비앤비 플랫폼에 지급하였거나 지급해야 하는 금액, (B) 호스트인 경우, 책임이 초래된 사유가 발생하기 전 12개월 동안 에어비앤비가 회원님에게 지급한 금액, 또는 (C) 그 밖의 모든 사람의 경우, 미화 1백 달러($100)를 초과할 수 없습니다.

이러한 책임 제한과 손해 배상 한도는 회원님과 에어비앤비 사이 계약의 기초가 되는 사항입니다. 관련 법률이 본 약관에 명시된 책임 제한을 허용하지 않는 경우, 회원님에게 상기 제한은 적용되지 않을 수 있습니다.

19. 면책

회원님은 (i) 본 약관(제품 또는 기능에 적용되는 보조 약관이나 추가 약관 포함), 추가 법률 약관, 정책 또는 기준 위반, (ii) 부적절한 에어비앤비 플랫폼 사용, (iii) 다른 회원과의 교류, 숙소에서의 숙박, 체험이나 기타 호스트 서비스에 참여한 결과 또는 이러한 활동과 관련하여 발생한 모든 부상, 손실, 피해(보상적, 직접적, 우발적, 간접적 또는 기타 경우를 포함하되 여기에 국한되지는 않음), (iv) 회원님의 또는 에어비앤비 측의 잘못으로 인한 정확한 세금 신고, 수금, 납입 실패, (v) 법률, 규정 위반 또는 지식재산권이나 개인정보 보호권과 같은 제3자 권리를 침해하는 회원님의 행위로 인해 또는 이와 관련하여 발생하는 합리적인 법무 관련 및 회계 수수료를 한도 없이 포함하되 이에 국한하지 않는 모든 청구, 책임, 손해, 손실, 경비에 대한 책임으로부터 관련 법률이 허용하는 최대 범위 내에서 에어비앤비(에어비앤비 페이먼츠와 기타 계열사 및 소속 임직원)를 면제, 방어(에어비앤비의 재량에 따라 판단), 면책하고 피해가 없도록 할 것에 동의합니다.

20. 계약 주체

아래 부속서 1에는 거주 국가나 사업장 소재지, 에어비앤비 플랫폼에서의 활동을 기준으로 계약 체결 대상이 되는 에어비앤비 주체가 명시되어 있습니다. 부속서 1에 명시된 주체 이외의 에어비앤비 주체가 당사 플랫폼을 통해 제품, 기능 또는 거래에 대한 책임을 지는 것으로 확인되는 경우, 회원님은 제품, 기능 또는 거래와 관련하여 해당 주체와 계약을 체결하신 것입니다. 거주 국가 또는 사업장 소재지를 변경할 경우, 회원님이 계약을 체결하는 에어비앤비 회사(부속서 1에 명시)와 적용되는 버전의 이용 약관은 해당 변경일부로 새로운 거주 국가 또는 사업장 소재지에 의해 결정됩니다.

21. 미국 준거법 및 법정지

거주지 또는 사업장 소재지가 미국인 경우, 본 약관은 미국 캘리포니아주 법률 및 미연방 법률에 따라 해석하며, 국제사법은 적용하지 않습니다. 제22조에 명시된 중재 합의에서 제외되는 사법 절차(소액청구 소송은 제외)는 양 당사자가 다른 법정지에 대해 합의하지 않은 한 캘리포니아주 샌프란시스코 소재 주법원 또는 연방법원에 제기되어야 합니다. 회원님과 당사는 캘리포니아주 샌프란시스코를 법정지로 하며 동 법원에 대인 관할권이 있음에 동의합니다.

22. 미국 내 분쟁 해결 및 중재 합의

다음 조항은 회원님과 에어비앤비가 구속력 있는 개별 중재를 통해 서로 간 모든 분쟁을 해결하고 집단 소송 포기 및 배심원 재판 포기 조항을 포함하는 데 동의한다는 내용을 담고 있으므로 주의 깊게 읽어보시기 바랍니다. 본 중재 합의는 모든 이전 버전에 우선합니다.

22.1 적용. 이 중재 합의는 거주 국가 또는 사업장 소재지가 미국인 경우에만 적용됩니다. 거주 국가 또는 사업장 소재지가 미국이 아님에도 미국에서 에어비앤비를 상대로 법적 소송을 제기하려는 경우, 본 중재 합의는 본 약관의 제22조가 회원님에게 적용되는지 여부를 결정짓는 기준, 그리고 거주지, 중재 가능성, 법정지, 관련 법규를 포함한 기타 모든 기준 사안을 결정하는 데 적용됩니다.

22.2 분쟁 해결 절차 개요 에어비앤비는 소비자 친화적인 분쟁 해결 절차를 통해 문제를 해결하고자 노력합니다. 이를 위해 본 약관은 제22조가 적용되는 개인에 대해 다음의 두 단계로 구성된 절차를 제공합니다. (1) 에어비앤비 고객서비스팀과 직접 비공식 협상(아래 제22조3항 참조), 그리고 필요한 경우 (2) 본 중재 합의 약관에 따라 구속력 있는 중재. 회원님과 에어비앤비는 중재에 대한 대안으로 소액 청구 법원에 분쟁 해결을 요청할 권리를 보유합니다.

22.3 중재 전 분쟁 해결 및 통지 의무. 중재 절차를 시작하기 최소 30일 전에, 회원님과 에어비앤비는 분쟁에 대한 개별 통지를 상대방 당사자에게 서면으로 발송하고('분쟁 전 통지서') 개별 청구를 비공식적으로 해결하기 위해 성실히 노력하는 데 동의합니다. 회원님은 반드시 해당 업무를 맡고 있는 에어비앤비 대리인(CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833)에게 분쟁 전 통지서를 우편으로 송부해야 합니다. 에어비앤비는 분쟁 전 통지서를 회원님의 에어비앤비 계정과 연결된 이메일 주소로 발송합니다. 분쟁 전 통지서에는 날짜, 회원님의 이름, 우편 주소, 에어비앤비 사용자 이름, 에어비앤비 계정을 만들 때 사용한 이메일 주소, 서명, 분쟁에 대한 간단한 설명 및 희망하는 구제책이 포함되어야 합니다. 관련 당사자가 30일 이내에 분쟁을 해결하지 못하는 경우에 한하여, 아래 제22조6항에 따라 지정된 중재 기구에 서면으로 중재 요청서를 제출함으로써 중재 절차를 시작할 수 있습니다. 청구인이 분쟁 전 통지를 발송하는 것이 모든 중재의 전제 조건이며, 분쟁 전 통지서 사본과 본 조항에서 요구하는 바에 따라 통지서가 발송되었다는 증빙 자료를 모든 중재 요청에 첨부해야 합니다.

22.4 중재 합의. 회원님과 에어비앤비는 본 약관 또는 본 약관의 적용, 위반, 해지, 유효성, 집행 또는 해석, 또는 에어비앤비 플랫폼, 호스트 서비스, 또는 콘텐츠 이용으로 인해 또는 그와 관련해 발생한 모든 분쟁, 피해 보상 청구 또는 이견(총칭하여 '분쟁')을 구속력 있는 중재에 의해 개별적으로 해결하는 것('중재 합의')에 동의합니다. 본 중재 합의가 양 당사자 간 분쟁에 대하여 집행되거나 적용될 수 있는지에 관하여 분쟁이 있는 경우, 회원님과 에어비앤비는 이 문제를 중재인의 판단에 맡기기로 합의합니다. 의심의 여지가 없도록 명확히 하자면, 회원님과 에어비앤비는 중재 가능성 및 본 제22조 전체 또는 일부의 형성, 집행 가능성, 유효성, 범위 또는 해석에 관한 모든 질문(분쟁 전 통지서 요건 준수 및 중재 수수료 지불에 대한 일방 당사자의 책임에 관한 분쟁을 포함)은 오로지 중재인에 의해 해결되어야 함에 동의합니다.

22.5 중재 합의 예외 사항. 회원님과 에어비앤비는 다음과 같은 소인 및/또는 구제 청구가 중재 합의의 예외 사항에 해당하며 (제22조에 정의된 바와 같이) 관할 법원에 사법적 절차로 제기되어야 함에 동의합니다. (i) 일방 당사자의 저작권, 상표, 영업비밀, 특허 또는 기타 지식재산권에 대한 실질적인 또는 예정된 침해, 남용, 위반에 대한 모든 피해 보상 청구 또는 소인 (ii) 긴급한 사정(예: 임박한 위험 또는 범죄, 해킹, 사이버 공격 행위)에 따라 긴급 가처분 구제를 요하는 모든 청구 또는 소인, (iii) 공공 가처분 구제 방안에 대한 요청, 또는 (iv) 소송 남용에 대한 모든 청구 또는 소인, (v) 에어비앤비 플랫폼 또는 호스트 서비스 이용 중 발생한 성폭행 또는 성희롱 피해에 대한 개별 청구. 회원님과 에어비앤비는 모든 공공 가처분 조치 요청이 모든 중재 청구, 구제 조치 또는 소인의 중재 이후에 진행되며, 연방 중재법 제3조에 따라 중재 결과가 나올 때까지 유예된다는 데 동의합니다.

22.6 중재 포럼 규정 및 준거법. 본 중재 합의는 주(州) 사이의 상거래에 적용되며, 본 중재 합의의 모든 실체적·절차적 해석과 집행에는 주법이 아닌 연방 중재법(Federal Arbitration Act)이 적용됩니다. 중재는 ADR 서비스(ADR Services, Inc., 'ADR')(www.adrservices.com)가 연방 민사 소송 규정의 규정 1, 6~7, 8~9 및 11~12, 45, 54 및 56('선별된 연방 규정')(https://www.uscourts.gov/rules-policies/current-rules-practice-procedure/federal-rules-civil-procedure) 및 해당 시점에 유효한 ADR의 중재 규정('ADR 규정')에 따라 진행합니다. 단, 선별된 연방 규정 또는 ADR 규칙이 본 중재 합의에 의해 변경되거나 상충하는 경우는 예외입니다. ADR 규정은 www.adrservices.com에서 확인할 수 있습니다. 중재 요청이 본 합의 및 ADR 규정에 따라 ADR 서비스에 제출되고 ADR 서비스가 중재를 진행할 수 없거나 진행하지 않을 경우, 해당 중재는 미국중재협회('AAA')에서 진행하며, 선별된 연방 규정 및 AAA의 소비자 중재 규정 및/또는 미국 중재협회가 적용하기로 정하고 해당 시점에 유효한 기타 AAA 중재 규정('AAA 규정')에 따라 진행합니다. 단 본 약관에 의해 변경된 사항은 제외됩니다. AAA 규정은 www.adr.org에서 확인할 수 있습니다. AAA가 중재를 진행할 수 없거나 진행하지 않을 경우, 회원님과 에어비앤비는 대체 중재 포럼을 협의하고 선정해야 하며, 이에 동의할 수 없는 경우, 회원님 또는 에어비앤비는 9 U.S.C. § 5에 따라 법원에 중재인 임명을 요청할 수 있습니다. 이 경우, 중재는 지정된 중재 포럼의 규정에 따라 진행됩니다. 단, 해당 규정이 본 중재 합의의 조항과 일치하지 않는 경우는 예외입니다.

22.7 중재 규정의 변경 - 중재 심리/장소. 중재의 비용 대비 효율성과 편의성을 최대한 높이기 위해, 분쟁 금액이 미화 1백만 달러($1,000,000)를 초과하지 않는 경우, 필요한 중재 심리는 양 당사자가 달리 합의하거나 중재인이 지시한 경우를 제외하고 화상회의를 통해 원격으로 진행되어야 합니다. 분쟁 금액이 미화 1백만 달러($1,000,000)를 초과하는 경우, 필요한 중재 심리는 양 당사자가 달리 합의하거나 중재인이 지시한 경우를 제외하고 샌프란시스코 카운티에서 진행되어야 합니다. 분쟁 금액이 미화 1만 달러($10,000) 이하인 경우, 양 당사자는 단지 중재인에게 서류를 제출하는 것만으로 진행될 수 있음에 동의합니다.

22.8 중재 규정의 변경 - 중재 수수료와 비용. 중재 비용 및 중재인 보수 중 회원님의 부담 부분에 관해서는 ADR 규정 및 ADR 서비스 수수료 별첨 문서(www.adrservices.com에서 확인 가능)가 적용됩니다. 월 총소득이 연방 빈곤 기준치의 300% 미만인 경우, 중재인 보수를 제외한 중재 수수료와 비용 면제권을 행사할 수 있습니다. 해당하는 경우, 월수입과 가구 구성원 수를 진술한 서약서를 중재 기구에 제출하여 수수료 면제를 신청할 수 있습니다. 중재 기구로부터 수수료 면제를 승인받고 월 총소득이 연방 빈곤 기준치의 300% 미만임을 입증하는 데 필요한 서류를 에어비앤비에 제출하는 경우, 에어비앤비에서 중재인 보수 중 회원님의 부담 부분을 지불합니다.

22.9 중재 규정의 변경 - 부적절한 목적으로 제기되거나 본 중재 합의에 위배되는 청구. 어느 당사자건 상대 당사자 또는 그 변호인이 사실이나 법적 근거 없이, 악의적으로, 괴롭히려는 목적으로, 또는 경솔한 이유로 청구 또는 변호를 진행했다는 사실을 입증할 경우, 상대 당사자에게 제재를 부과하도록 중재인에게 요청할 수 있습니다. 상대 당사자가 사실이나 법적 근거 없이, 악의적으로 또는 단순히 괴롭히려는 목적으로, 연방민사소송규칙 제11조b항(중재자를 '법원'으로 취급)을 위반하여, 또는 경솔한 이유로 청구를 제기하거나 변호를 진행했다는 사실이 입증될 경우, 중재인은 관련 법률에서 허용하는 바에 따라 요청 당사자에게 발생한 합리적인 변호사 수임료와 제반 비용에 상응하는 제재 조치를 상대 당사자에게 부과해야 합니다. 어느 당사자든 본 중재 합의의 조항을 위반하여 제기된 중재의 기각을 요청할 수 있습니다. 어느 당사자든 상대 당사자가 본 중재 합의의 요건을 준수하지 않거나 이를 위반하여 중재 가능한 분쟁에 관한 절차를 개시할 경우, 중재 과정에서 이에 대한 반소 청구를 제기할 수 있습니다. 일방 당사자가 본 중재 합의의 요건을 준수하지 않거나 이를 위반하여 중재 가능한 분쟁에 관한 절차를 개시한 것으로 입증될 경우, 중재인은 상대 당사자에게 합리적인 변호사 수임료 및 제반 비용을 포함하나 이에 국한되지 아니하는 실손해액에 대한 배상금을 지급하도록 판정해야 합니다.

22.10 중재인의 결정. 중재인은 판정의 기초로 삼는 주요 판단 및 결론이 포함된 서면 결정을 내립니다. 중재 결정에 대한 판결은 해당 분쟁에 대한 관할권을 가진 법원에서 집행될 수 있습니다. 중재인은 법률 또는 ADR 규정에서 허용하는 구제안을 허여할 수 있지만, 선언적인 또는 가처분 구제안은 신청인의 개별 청구에 의해 보증된 구제안을 제공하는 데 필요한 범위 내에서 개별 기준으로만 허여할 수 있습니다.

22.11 배심원 재판의 포기. 회원님과 에어비앤비는 중재가 가능한 모든 분쟁에 대해 배심원에 의한 재판을 받을 권리를 포기하기로 동의합니다.

22.12 집단 소송 또는 대표 소송 불가. 회원님과 에어비앤비는 관련 법률에서 허용하는 최대한의 범위 내에서 집단 소송, 집단 중재, 공익 소송 또는 기타 대표 또는 병합 소송에서 원고 또는 구성원으로 참여할 수 있는 권리를 포기하기로 합니다. 양측이 서면으로 합의하거나 본 합의에 명시된 경우를 제외하고, 중재인은 복수의 일방 당사자의 청구를 병합할 수 없으며 달리 여하한 집단 소송 또는 대표 소송을 주재할 수 없습니다. 관련 법률에 따라 특정 청구, 소인 또는 요청된 구제 조치와 관련해 본 조항에 포함된 권리 포기의 집행이 불가능하다는 최종 사법 결정이 있는 경우, 해당 청구, 소인 또는 요청된 구제 조치(오직 해당 청구, 소인 또는 요청된 구제 조치만 해당)는 본 합의에서 분리되어 중재되고 관할권을 가진 법원에 제기될 것입니다. 청구, 소인 또는 요청된 구제 조치가 시행 불가능하게 되어 본 조항에 따라 분리된 경우, 회원님과 당사는 중재인에 의해 모든 청구, 소인, 요청된 구제 조치가 해결될 때까지 중재의 대상이 되지 않는 청구, 소인, 또는 요청된 구제 조치가 유예된다는 데 동의합니다.

22.13 대량 중재 청구 포기. 회원님과 에어비앤비는 다음과 같은 성격의 중재 청구가 180일 내에 100건 이상 대량으로 제기될 경우 중재의 상대적인 효익과 효율성이 상실될 수 있음을 인정하고 이에 동의합니다. (1) 동일하거나 유사한 상황에 처한 당사자가 관련되어 있고, (2) 동일하거나 실질적으로 동일한 거래, 사고, 위반 가능성 또는 사건으로 인해 야기되었으며, 동일하거나 실질적으로 동일한 법적 또는 사실적 논점에 대한 판단이 요구되는 동일하거나 유사한 청구에 기반하며, (3) 양 당사자의 변호인이 동일하거나 협력 관계인 중재 청구('대량 청구'). 이에 따라, 회원님과 에어비앤비는 대량 중재 청구의 일환으로 분쟁을 진행, 중재 또는 해결할 권리를 포기하는 데 동의합니다(단, 본 약관 제21조 및 제22조12항은 분쟁에 계속 적용됩니다). 분쟁이 발생하는 경우, 일방 당사자가 인정한 복수의 청구 중 첫 번째로 다뤄지는 사안에 선임된 중재인이 해당 청구가 대량 중재 청구의 일환인지 그 여부를 판정합니다. 중재인이 아직 선임되지 않은 경우, 일방 당사자가 인정한 청구 건이 대량 중재 청구의 일환인지 여부를 판정할 중재인을 별도로 선임해야 합니다. 본 조항의 어떠한 내용도 회원님이나 에어비앤비가 대량 중재 청구에 참여하는 것을 제한하지 않습니다.

22.14 중재 규정의 변경 – 대규모 중재 청구의 일괄 처리 요건. 제22조13항에도 불구하고 어떠한 이유로든 중재가 대량 중재 청구의 일환으로 진행되는 경우, 양 당사자는 전체 청구 건을 200건 이하로 나누어 묶음을 구성해야 합니다. 묶음을 구성할 때는 청구인의 성 또는 회사명 중 해당하는 경우에 따라 알파벳순으로 정렬한 후 나눠야 합니다. 정렬 순서에 따라 첫 200명의 청구인이 첫 번째 묶음을 구성하고, 다음 200명의 청구인이 두 번째 묶음으로 분류되는 방식입니다. 양 당사자는 각 묶음에 순차적인 번호를 무작위로 배정하고, 해당 번호에 따라 한 번에 한 묶음씩 순차적으로 중재를 진행해야 합니다. 하나의 묶음에 대한 중재가 진행되는 동안, 중재 기구는 양 당사자가 달리 합의하거나 중재 기구가 지시한 경우를 제외하고 나머지 묶음을 유예 상태로 두어야 합니다. 각 묶음은 해당 묶음에 대한 심리 준비 기일로부터 240일 내에 해결되어야 합니다. 상기 내용에도 불구하고, 청구인의 제기한 청구가 대량 중재 청구 중 가장 최근에 제기된 청구로부터 2년 이내에 심리 전 사전 절차의 대상이 되지 않은 경우, 청구인은 본 약관 제21조 및 제22조12항의 적용을 받는 법원에서 해당 청구를 진행하기로 선택할 수 있습니다.

22.15 중재 규정의 변경 - 중재 판결 제안. 회원님 또는 에어비앤비는 중재 심리가 열리기 최소 10일 전까지 특정 조건의 중재 판결이 가능하도록 상대 당사자에게 중재 판결 제안을 서면으로 제시할 수 있습니다. 상대 당사자가 제안을 수락하는 경우, 수락 사실 증빙이 첨부된 중재 판결 제안서가 중재 기구에 제출되며, 중재 기구는 이에 따라 판결을 내려야 합니다. 중재 심리 전 또는 제의를 보낸 후 30일 이내에 중재 판결 제안이 수락되지 않는 경우, 무엇이 먼저 발생하였는지 상관없이, 해당 제안은 철회된 것으로 간주되며 관련 비용(중재 기구에 지급된 모든 수수료 포함)을 제외하고 이를 중재에 증거로 제시할 수 없습니다. 일방 당사자의 중재 판결 제안을 상대 당사자가 수락하지 않고, 상대 당사자가 제안보다 더 유리한 판결을 받지 못한 경우, 상대 당사자는 제안이 제시된 이후 발생한 비용을 회수할 수 없으며, 제안이 제시된 시점부터 제안한 당사자에게 발생한 비용(중재 기구에 지불하는 모든 수수료 포함)을 부담해야 합니다.

22.16 조항의 독립성. 제22조11항에 명시된 사항을 제외하고, 본 중재 합의의 일부가 불법 또는 집행 불가한 것으로 간주될 경우, 해당 조항은 분리되며 중재 합의의 나머지 부분은 완전한 효력을 유지합니다.

22.17 중재 합의 변경. 에어비앤비가 회원님의 본 약관의 최종 수락일(또는 본 약관의 후속 변경이 수락된 일자) 후에 제22조를 변경하는 경우, 회원님은 해당 변경 약관의 발효일로부터 30일 이내에 서면으로 통지하여 변경을 거부할 수 있습니다. 해당 통지서에는 회원님의 이름, 우편 주소, 통지일, 에어비앤비 사용자 이름, 에어비앤비 계정을 만들 때 사용한 이메일 주소, 회원님의 서명 및 변경된 제22조를 거부한다는 명백한 진술이 포함되어야 합니다. 통지서를 우편(주소: 888 Brannan St, San Francisco, CA 94103, Attn: Arbitration Opt-Out)으로 보내거나, 변경 약관 거부 통지서를 이메일(arbitration.opt.out@airbnb.com)로 보내야 합니다. 단, 변경을 거부하더라도 회원님과 에어비앤비 사이의 분쟁을 중재하기 위한 이전 합의에 대한 사전 동의(또는 이에 대한 후속 변경에 대한 회원님의 사전 동의)는 취소 또는 변경되지 않으며, 회원님과 에어비앤비 사이의 분쟁에 대해 효력을 유지하고 집행될 수 있습니다.

22.18 존속 규정. 제22조12항에 명시된 경우를 제외하고, 제12조6항이 적용됨을 전제로, 제22조는 본 약관이 해지된 이후에도 존속하며 회원님이 에어비앤비 플랫폼의 이용을 중단하거나 계정을 해지한 이후에도 계속 적용됩니다.

23. 중국 준거법 및 분쟁 해결

23.1 중국 국내 거래. 거주지 또는 사업장 소재지가 중국이며 에어비앤비 차이나(Airbnb China)와 계약을 체결하는 경우, 본 약관과 제23조1항은 중화인민공화국 법규의 적용을 받습니다. 이러한 상황에서 본 약관 또는 에어비앤비 플랫폼 사용으로 인하여 또는 이와 관련하여 발생하는 모든 분쟁은 중국 국제경제무역중재위원회(이하 'CIETAC')에 중재를 요청해야 하며, 중재는 신청 당시 유효한 위원회의 중재 규정에 따라 진행됩니다. 중재 판정은 최종적이며 쌍방에 구속력이 있습니다. 재판부는 3명의 중재인으로 구성됩니다. 중재지는 베이징이며, 중재 언어는 영어입니다.

23.2 국외 거래. 거주지 또는 사업장 소재지가 중국이며, 에어비앤비 주식회사(Airbnb, Inc.), 에어비앤비 스테이즈(Airbnb Stays, Inc.), 에어비앤비 트래블(Airbnb Travel, LLC), 럭셔리 리트리츠 인터내셔널(Luxury Retreats International ULC) 또는 기타 비중국 주체와 계약을 체결하는 경우, 본 약관과 제23조2항은 싱가포르 법규의 적용을 받습니다. 이러한 상황에서, 본 약관의 존재, 유효성 또는 해지와 관련된 모든 질문을 포함하여 본 약관 또는 에어비앤비 플랫폼의 이용으로 인해 또는 이와 관련하여 발생하는 모든 분쟁은 당분간 싱가포르 국제 중재 센터('SIAC')로 의뢰하고 싱가포르 국제 중재 센터의 중재 규정('SIAC 규정')에 따라 해당 기관에서 주재하는 중재를 통해 최종적으로 해결되며, 해당 중재 규정은 본 조항에 통합된 것으로 간주합니다. 중재지는 싱가포르입니다. 재판부는 3명의 중재인으로 구성됩니다. 중재 언어는 영어입니다.

23.3 제한 조항 없음. 상기 제23조1항 및 23조2항은 국제사법의 원칙과 무관하게 명시되며, 에어비앤비가 싱가포르, 중화인민공화국 법률 또는 회원님에게 적용될 수 있는 기타 법률에 따라 회원님이 특정 행위를 수행하거나, 수행하는 것을 금지하거나 기타 임시 구제수단을 행사하거나 행사하지 못하도록 하는 명령을 관할 법원에 신청할 수 있는 에어비앤비의 권리를 제한하는 것으로 해석될 수 없습니다.

24. 브라질 준거법 및 법정지. 거주지 또는 사업장 소재지가 브라질인 경우, 본 약관은 브라질 법률에 따라 해석하며, 국제사법은 적용되지 않습니다. 본 약관으로 인하여 또는 본 약관과 관련하여 회원님이 당사를 상대로 제기할 수 있는 사법 절차는 브라질 소재 법원에만 제기될 수 있습니다.

25. 전 세계 그 밖의 지역에 적용되는 분쟁 해결, 법정지 및 법정, 준거법. 거주지나 사업장 소재지가 미국, 중국, 브라질 이외 지역인 회원에게는 본 조항이 적용되며, 본 약관은 아일랜드 법률에 의거하여 해석됩니다. 국제물품매매계약(CISG)에 관한 국제연합협약의 적용은 제외됩니다. 개인 소비자이고 거주 국가의 소비자 보호 의무 규정에 회원님에게 더 유리한 조항이 포함된 경우, 아일랜드 법 대신 해당 조항이 적용됩니다. 개인 소비자는 본 약관과 관련된 모든 사법 절차를 본인의 거주지 관할 법원 또는 아일랜드 에어비앤비 관할 법원에 제기할 수 있습니다. 에어비앤비가 소비자인 회원을 상대로 권리를 행사하고자 하는 경우, 회원의 거주지 관할 법원을 통해서만 행사할 수 있습니다. 회원님이 사업체로 행동하는 경우, 회원님은 아일랜드 법원의 배타적 관할권에 따를 것에 동의합니다.

26. 기타 조항

26.1 기타 언급에 의해 포함된 약관. 에어비앤비 호스트 손해보상, 일본 호스트 보험 약관, 재예약 및 환불 정책, 체험 게스트 환불 정책, 콘텐츠 정책, 차별 금지 정책, 정상참작이 가능한 상황 정책, 추가 법률 약관, 정책, 기준 및 기타 본 약관에 링크로 첨부된 보완 정책 및 약관은 회원님의 에어비앤비 플랫폼 이용에 적용되며, 언급으로 본 정책에 통합되어 회원님과 에어비앤비 간 계약의 일부를 구성합니다.

26.2 본 약관 해석. 추가 약관, 조건, 정책, 지침, 기준, 상품 내 공시에 의해 보완될 수 있는 경우를 제외하고, 본 약관은 회원님의 에어비앤비 플랫폼 접속 및 이용에 관한 에어비앤비와 회원님 사이의 완전한 합의를 구성하며, 에어비앤비와 회원님 사이에 맺어진 기존의 모든 구두 또는 서면에 의한 양해 또는 합의에 우선합니다. 본 약관은 회원님과 에어비앤비를 제외한 다른 누구에게도 어떠한 권리나 구제수단을 제공하지 않으며 이를 제공할 의도로 작성되지 않았습니다. 제22조11항에 명시된 경우를 제외하고, 본 약관의 특정 조항이 무효 또는 집행 불가능한 것으로 판단되는 경우, 해당 조항은 삭제되며 나머지 조항들의 유효성 및 집행 가능성에 영향을 주지 않습니다. 본 약관에 '합니다'라는 표현이 사용되는 경우, '반드시 해야 합니다'와 동일한 의미의 의무를 부여합니다.

26.3 권리 불포기. 에어비앤비가 본 약관상의 권리 또는 조항을 집행하지 않더라도 당사가 서면으로 인정하고 합의하지 않은 한 이는 해당 권리 또는 조항의 포기로 간주되지 않습니다. 본 약관에 명시된 경우를 제외하고, 본 약관에 따라 일방 당사자가 구제수단을 행사하는 경우 이는 본 약관에 따른 해당 당사자의 다른 구제수단 또는 법률에서 허용한 구제수단을 침해하지 않습니다.

26.4. 양도. 회원님은 에어비앤비의 사전 서면 동의 없이 본 계약 및 그에 따른 회원님의 권리와 의무를 양도, 이전 또는 위임할 수 없습니다. 에어비앤비는 30일 전에 통지하여 그 재량에 따라 본 계약 및 그에 따른 권리와 의무를 제한 없이 양도, 이전 또는 위임할 수 있습니다.

26.5 통지. 달리 명시된 경우를 제외하고, 본 합의에 따라 허용되거나 요구되는 여하한 통지 또는 기타 의사연락은 에어비앤비에 의해 이메일, 에어비앤비 플랫폼 통지, 메시지 서비스(SMS와 WeChat 포함) 또는 회원님이 제공하며 에어비앤비가 이용할 수 있는 기타 연락 방법을 통해 전자적으로 제공됩니다. 일본에서 진행되는 예약이나 일본 내 리스팅과 관련된 통지의 경우, 회원님은 서면 통지를 갈음한 전자적 수단을 통한 통지가 일본 주택숙박사업법(Housing Accommodation Business Act) 제59조1항에 따른 에어비앤비의 의무를 충족함을 인정하고 이에 동의합니다.

26.6 제3자 서비스. 에어비앤비 플랫폼에는 에어비앤비와는 별개의 약관 및 개인정보 보호정책이 적용되는 제3자 웹사이트, 애플리케이션, 서비스 또는 자료('제3자 서비스')로 연결되는 링크가 포함될 수 있습니다. 에어비앤비는 이러한 제3자 서비스의 어떠한 측면에 대해서도 책임지지 않으며, 제3자 서비스로 연결되는 링크가 있더라도 그것이 에어비앤비가 해당 서비스를 승인한다는 의미는 아닙니다.

26.7 Google 약관. 에어비앤비 플랫폼에는 Google 번역에 의한 번역이 포함될 수 있습니다. Google은 번역과 관련된 모든 명시적 또는 묵시적 보장(정확성, 신뢰성, 상품성, 적합성, 특정 목적 부합성 및 침해의 부존재에 대한 보장 포함)을 부인합니다. 에어비앤비 플랫폼의 일부 영역은 Google 지도와 Google 어스 매핑 서비스(Google 지도 API 포함)를 실행합니다. 회원님의 Google 지도와 Google 어스 사용은 Google 지도/Google 어스 추가 서비스 약관의 적용을 받습니다.

26.8 Apple 약관. Apple 앱스토어에 접속하거나 Apple 앱스토어에서 애플리케이션을 다운로드하면 Apple의 라이선스 대상 애플리케이션 최종 사용자 라이선스 계약에 동의하는 것입니다.

26.9 플랫폼에 게시되는 콘텐츠. 에어비앤비 플랫폼을 통해 제공되는 콘텐츠(상표, 트레이드 드레스, 발명품, 알고리즘, 컴퓨터 프로그램(소스 코드 및 오브젝트 코드), 고객 및 마케팅 정보, 기타 콘텐츠)('플랫폼 콘텐츠')는 등록 여부와 관계없이 미국과 기타 국가의 저작권, 상표, 특허, 영업 비밀, 노하우 및/또는 기타 법률에 의해 보호됩니다. 회원님은 플랫폼 콘텐츠에 대한 모든 지식재산권이 에어비앤비 및/또는 라이선스 제공자의 배타적 재산임을 인정하며, 저작권, 상표, 서비스 마크 또는 기타 배타적인 지식재산권 고지를 삭제, 변경하거나 가리지 않을 것에 동의합니다. 회원님은 본인이 특정 플랫폼 콘텐츠의 법적 소유자이거나 본 약관에서 명시적으로 허용하지 않은 한, 에어비앤비 플랫폼을 통해 접근 가능한 모든 플랫폼 콘텐츠를 사용, 복사, 편집, 수정, 배포, 라이선싱, 판매, 양도, 공개적으로 전시, 공연, 전송, 방송하거나, 그에 대한 파생저작물을 제작하거나 달리 활용할 수 없습니다. 회원님이 본 약관을 준수하는 것을 전제로, 에어비앤비는 회원님에게 개인적이고 비상업적인 목적에 한하여 (i) 회원님의 개인 기기에서 애플리케이션을 다운로드하여 사용하고, (ii) 에어비앤비 플랫폼에 또는 그를 통해 제공되거나 접속이 허용된 플랫폼 콘텐츠에 접속하여 열람할 수 있는 제한적, 비배타적, 취소 가능하며 2차 라이선싱 및 양도가 불가능한 라이선스를 부여합니다.

26.10 Airbnb.org. Airbnb.org는 미국 연방 세법 제501조 (c)항 (3)목에 의거 미 국세청(IRS)에서 공공 자선단체로 인정하는 기관으로서 소득세 면제 대상입니다. Airbnb.org는 에어비앤비가 소유하거나 통제하지 않습니다. Airbnb.org는 에어비앤비 호스트 및 게스트 커뮤니티와 일반 대중에게 도움이 되는 여러 자선 프로그램을 운영합니다.

26.11 불가항력. 에어비앤비는 천재지변, 자연재해, 전쟁, 테러, 폭동, 금수 조치, 민병대 또는 군사 당국의 행위, 화재, 홍수, 사고, 팬데믹, 전염병이나 질병, 파업, 또는 교통 시설·연료·에너지·인력·자재 부족 등 에어비앤비가 합리적으로 통제할 수 없으며, 에어비앤비가 모든 노력을 기울인다고 하더라도 그 결과를 피할 수 없는 비정상적이거나 예측 불가능한 상황으로 발생하는 의무 이행의 지연 또는 불이행에 대해 책임을 지지 않습니다.

26.12 이메일 및 문자 메시지. 에어비앤비에서는 계정에 입력하신 이메일 주소나 기타 연락처 정보로 관리 관련 내용을 전달해드립니다. 추가적인 이메일 신청 프로그램에 등록해도 이러한 관리 목적 이메일이 발송되는 빈도가 달라지지는 않지만, 신청하신 프로그램에 특화된 이메일을 추가로 받으실 수 있습니다. 또한 에어비앤비 프로모션 이메일을 받으실 수도 있습니다. 프로모션 이메일은 무료로 제공되나 제3자의 데이터 요금이 부과될 수 있습니다. 계정 설정의 알림 환경 설정에서 프로모션 이메일 수신 여부를 선택할 수 있습니다. 특정 커뮤니케이션 설정을 비활성화하거나 에어비앤비 계정이 없는 경우 해당 프로모션을 활용할 수 없음을 양해해주시기 바랍니다. 미국에서는 문자 메시지를 수신하는 데 동의할 경우, 문자 메시지 약관이 적용됩니다.

These Terms of Service for European Users (“Terms”) are a binding legal agreement between you and Airbnb that govern your use of the websites, applications, and other offerings from Airbnb (collectively, the “Airbnb Platform”). When used in these Terms, “Airbnb,” “we,” “us,” or “our” refers to the Airbnb entity set out on Schedule 1 with whom you are contracting.

The Airbnb Platform offers an online venue that enables users (“Members”) to publish, offer, search for, and book services. Members who publish and offer services are “Hosts” and Members who search for, book, or use services are “Guests.” Hosts offer accommodations (“Accommodations”), activities, excursions and events (“Experiences”), and a variety of travel and other services (collectively, “Host Services,” and each Host Service offering, a “Listing”). You must register an account to access and use many features of the Airbnb Platform, and must keep your account information accurate. As the provider of the Airbnb Platform, Airbnb does not own, control, offer or manage any Listings or Host Services. Airbnb is not a party to the contracts concluded directly between Hosts and Guests, nor is Airbnb a real estate broker, insurer or an organiser or retailer of travel packages under Directive (EU) 2015/2302. Airbnb is not acting as an agent in any capacity for any Member, except as specified in the Payments Terms of Service (“Payment Terms”). To learn more about Airbnb’s role see Section 16.

We maintain other terms and policies that supplement these Terms like our Privacy Policy, which describes our collection and use of personal data, and our Payments Terms, which govern any payment services provided to Members by the Airbnb payment entities ("Airbnb Payments").

If you Host, you are responsible for understanding and complying with all laws, rules, regulations and contracts with third parties that apply to your Host Services.

Guest Terms

1. Our Mission.

Our mission is to create a world where you can belong anywhere. From cabins to castles to cooking classes, browse through millions of Listings to find the ones that fit the way you like to travel. Learn more about a Listing by reviewing the description and photos, the Host profile, and past Guest reviews. If you have questions, just message the Host.

2. Searching and Booking on Airbnb.

2.1 Searching. You can search for Host Services by using criteria like the type of Host Service, travel destination, travel dates, and number of guests. You can also use filters to refine your search results. Search results are based on their relevance to your search and other criteria. Relevance considers factors like price, availability, Reviews, customer service and cancellation history, popularity, previous trips and saved Listings, Host requirements (e.g. minimum or maximum nights), and more. 2.2 Booking. When you book a Listing, you are agreeing to pay all charges for your booking including the Listing price, applicable fees like Airbnb’s service fee, offline fees, taxes and any other items identified during checkout (collectively, “Total Price”). You are also agreeing that Airbnb Payments may charge and collect any security deposit identified during checkout. When you receive the booking confirmation, a contract for Host Services (sometimes called a reservation in these Terms) is formed directly between you and the Host. The cancellation policy and any other rules, standards, policies, or requirements identified in the Listing or during checkout form part of your contract with the Host. Be aware that some Hosts work with a co-host or as part of a team to provide their Host Services.

2.3 Accommodation Reservations. An Accommodation reservation is a limited license to enter, occupy and use the Accommodation. The Host retains the right to re-enter the Accommodation during your stay, to the extent: (i) it is reasonably necessary, (ii) permitted by your contract with the Host, and (iii) consistent with applicable law. If you stay past checkout, the Host has the right to make you leave in a manner consistent with applicable law, including by imposing reasonable overstay penalties. You may not exceed the maximum number of allowed Guests.

2.4 Reservations for Experiences and Other Host Services. An Experience or other Host Service reservation entitles you to participate in, attend, or use that Host Service. You are responsible for confirming that you, and anyone you invite, meet minimum age, proficiency, fitness or other requirements. You are responsible for informing the Host of any medical or physical conditions, or other circumstances that may impact your ability to participate, attend or use the Host Service. Except where expressly authorized, you may not allow any person to join a Host Service unless they are included as an additional guest during the booking process.

3. Cancellations, Travel Issues, Refunds and Booking Modifications.

3.1 Cancellations, Travel Issues, and Refunds. In general, if you cancel a reservation, the amount refunded to you is determined by the cancellation policy that applies to that reservation. But, in certain situations, other policies take precedence and determine what amount is refunded to you. If something outside your control requires you to cancel a reservation, you may be entitled to a partial or full refund under our Extenuating Circumstances Policy. If the Host cancels, or you experience a Travel Issue (as defined in our Guest Refund Policy), you may be entitled to rebooking assistance or a partial or full refund under our Guest Refund Policy. Different policies apply to certain categories of Listings; for example Experiences reservations are governed by the Experiences Guest Refund Policy. See each Policy for details about what is covered, and what refund applies in each situation. You may appeal a decision by Airbnb by contacting our customer service.

3.2 Booking Modifications. Hosts and Guests are responsible for any booking modifications they agree to make via the Airbnb Platform or direct Airbnb customer service to make on their behalf ("Booking Modifications"), and agree to pay any additional amounts, fees or taxes associated with any Booking Modification.

4. Your Responsibilities.

You are responsible for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to any Accommodation or Experience. For example, this means: (i) you are responsible for leaving an Accommodation (and related personal property) in the condition it was in when you arrived, and (ii) you must act with integrity, treat others with respect and comply with applicable laws at all times. If you are booking for an additional guest who is a minor or if you bring a minor to a Host Service, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor.

Host Terms

5. Hosting on Airbnb.

5.1 Host. As a Host, Airbnb offers you the opportunity to share your Accommodation, Experience, or other Host Service with our vibrant community of Guests - and earn money doing it. It’s easy to create a Listing and you are in control of how you host - set your price, availability, and rules for each Listing.

5.2 Contracting with Guests. When you accept a booking request, or receive a booking confirmation through the Airbnb Platform, you are entering into a contract directly with the Guest, and are responsible for delivering the Host Service under the terms and at the price specified in your Listing. You are also agreeing to pay applicable fees like Airbnb’s service fee (and applicable taxes) for each booking. Airbnb Payments will deduct amounts you owe from your payout unless we and you agree to a different method. Any terms or conditions that you include in any supplement contract with Guests must: (i) be consistent with these Terms, our Policies, and the information provided in your Listing, and (ii) be prominently disclosed in your Listing description.

5.3 Independence of Hosts. Your relationship with Airbnb is that of an independent individual or entity and not an employee, agent, joint venturer or partner of Airbnb, except that Airbnb Payments acts as a payment collection agent as described in the Payments Terms. Airbnb does not direct or control your Host Service and you understand that you have complete discretion whether and when to provide Host Services and at what price and on what terms to offer them.

6. Managing Your Listing.

6.1 Creating and Managing Your Listing. The Airbnb Platform provides tools that make it easy for you to set up and manage a Listing. Your Listing must include complete and accurate information about your Host Service, your price, other charges like cleaning fees, resort fees, security deposits, offline fees, and any rules or requirements that apply to your Guests or Listing. You are responsible for your acts and omissions as well as for keeping your Listing information (including calendar availability) and content (like photos) up-to-date and accurate at all times. We recommend that you obtain appropriate insurance for your Host Services and suggest you carefully review policy terms and conditions like coverage details and exclusions. You may only maintain one Listing per Accommodation, but may have multiple Listings for a single property if it has multiple places to stay. Any offer of an Experience is subject to our Additional Terms for Experience Hosts.

6.2 Know Your Legal Obligations. You are responsible for understanding and complying with any laws, rules, regulations and contracts with third parties that apply to your Listing or Host Services. For example: Some landlords and leases, or homeowner and condominium association rules, restrict or prohibit subletting, short-term rentals and/or longer-term stays. Some cities have zoning or other laws that restrict the short-term rental of residential properties. Some jurisdictions require Hosts to register, get a permit, or obtain a license before providing certain Host Services (such as short-term rentals, longer-term stays, preparing food, serving alcohol for sale, guiding tours or operating a vehicle). In some places, the Host Services you want to offer may be prohibited altogether. Some jurisdictions require that you register Guests who stay at your Accommodation. Some jurisdictions have laws that create tenancy rights for Guests and additional obligations for Hosts. For example, some places have landlord-tenant, rent control, and eviction laws that may apply to longer stays. Check your local rules to learn what rules apply to the Host Services you plan to offer. Information we provide regarding legal requirements is for informational purposes only and you should independently confirm your obligations. You are responsible for handling and using personal data of Guests and others in compliance with applicable privacy laws and these Terms, including our Host Privacy Standards. If you have questions about how local laws apply you should always seek legal advice.

6.3 Search Ranking. The ranking of Listings in search results on the Airbnb Platform depends on a variety of factors, including these main parameters:

  • Guest search parameters (e.g. number of Guests, time and duration of the trip, price range),
  • Listing characteristics (e.g. price, calendar availability, number and quality of images, Reviews, type of Host Service, host status, age of the Listing, average Guest popularity),
  • Guest booking experience (e.g. customer service and cancellation history of the Host, ease of booking),
  • Host requirements (e.g. minimum or maximum nights, booking cut-off time), and
  • Guest preferences (e.g. previous trips, saved Listings, location from where the Guest is searching).

Search results may appear different on our mobile application than they appear on our website. Airbnb may allow Hosts to promote their Listings in search or elsewhere on the Airbnb Platform by paying an additional fee. More information about the factors that determine how your Listing appears in search results, our current promotional programs (if any) and how we identify promoted Content can be found in our Help Center.

6.4 Your Responsibilities. You are responsible for your own acts and omissions and are also responsible for the acts and omissions of anyone you allow to participate in providing your Host Services. You are responsible for setting your price and establishing rules and requirements for your Listing. You must describe any and all fees and charges in your Listing description and may not collect any additional fees or charges outside the Airbnb Platform except those expressly authorized by our Offline Fee Policy. Do not encourage Guests to create third-party accounts, submit reviews, provide their contact information, or take other actions outside the Airbnb Platform in violation of our Off-Platform Policy.

6.5 Hosting as a Team or Organization. If you work with a co-host or host as part of a team, business or other organization, the entity and each individual who participates in providing Host Services, is responsible and liable as a Host under these Terms. If you accept terms or enter into contracts, you represent and warrant that you are authorized to enter into contracts for and bind your team, business or other organization, and that each entity you use is in good standing under the laws of the place where it is established. If you perform other functions, you represent and warrant that you are authorized to perform those functions. If you instruct Airbnb to transfer a portion of your payout to a co-host or other Hosts, or send payments to someone else, you must be authorized to do so, and are responsible and liable for the payment amounts and accuracy of any payout information you provide.

7. Cancellations, Travel Issues, and Booking Modifications.

7.1 Cancellations and Travel Issues. In general, if a Guest cancels a reservation, the amount paid to you is determined by the cancellation policy that applies to that reservation. As a host, you should not cancel on a Guest without a valid reason under our Extenuating Circumstances Policy or applicable law. If you cancel on a Guest without such a valid reason, we may impose a cancellation fee and other consequences. If: (i) a Guest experiences a Travel Issue (as defined by the Guest Refund Policy), (ii) an Extenuating Circumstance arises, or (iii) a reservation is cancelled under Section 13 of these Terms, the amount you are paid will be reduced by the amount we refund or otherwise provide to the Guest, and by any other reasonable costs we incur as a result of the cancellation. If a Guest receives a refund after you have already been paid, or the amount of the refund and other costs incurred by Airbnb exceeds your payout, Airbnb (via Airbnb Payments) may recover that amount from you, including by offsetting the refund against your future payouts. You agree that Airbnb’s Guest Refund Policy, Extenuating Circumstances Policy, and these Terms preempt the cancellation policy you set in situations where they allow for the cancellation of a reservation and/or the issuance of refunds to Guests. If we reasonably expect to provide a refund to a Guest under one of these policies, we may delay release of any payout for that reservation until a refund decision is made. If you Host an Experience please note that the Experience Cancellation Policy, Experiences Guest Refund Policy and different cancellation fees and consequences apply to your reservations. See each Policy for details about what is covered, and what your payout will be in each situation. You may appeal a decision by Airbnb by contacting our customer service.

7.2 Booking Modifications. Hosts and Guests are responsible for any Booking Modifications they agree to make via the Airbnb Platform or direct Airbnb customer service to make on their behalf, and agree to pay any additional amounts, fees or taxes associated with a Booking Modification.

8. Taxes.

8.1 Host Taxes. As a host, you are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit or include in your price any applicable VAT or other indirect taxes, occupancy taxes, tourist, income or other taxes ("Taxes").

8.2 Collection and Remittance by Airbnb. In jurisdictions where Airbnb facilitates the collection and/or remittance of Taxes on behalf of Hosts, you instruct and authorize Airbnb to collect Taxes on your behalf, and/or to remit such Taxes to the relevant Tax authority. Any Taxes that are collected and/or remitted by Airbnb are identified to Members on their transaction records, as applicable. Airbnb may seek additional amounts from Members (including by deducting such amounts from future payouts) in the event that the Taxes collected and/or remitted are insufficient to fully discharge that Members’ tax obligations, and you agree that your sole remedy for Taxes collected by Airbnb is a refund from the applicable Tax authority. You acknowledge and agree that we retain the right, with prior notice to affected Members, to cease the collection and remittance of Taxes in any jurisdiction for any reason.

8.3 Tax Information. In certain jurisdictions, Tax regulations may require that we collect and/or report Tax information about you, or withhold Taxes from payouts to you, or both. If you fail to provide us with documentation that we determine to be sufficient to support any such obligation to withhold Taxes from payouts to you, we may withhold payouts up to the amount as required by law, until sufficient documentation is provided. You agree that Airbnb may issue on your behalf invoices or similar documentation for VAT, GST, consumption or other Taxes for your Host Services to facilitate accurate tax reporting by our Guests and their organizations.

General Terms

9. Reviews.

After each Host Service, Guests and Hosts will have an opportunity to review each other. Your Review must be accurate and may not contain any discriminatory, offensive, defamatory, or other language that violates our Content Policy or Review Policy. Reviews are not verified by Airbnb for accuracy and may be incorrect or misleading.

10. Content.

Parts of the Airbnb Platform enable you to provide feedback, text, photos, audio, video, information and other content (“Content”). By providing Content, in whatever form and through whatever means, you grant Airbnb a non-exclusive, worldwide, royalty-free, sub-licensable and transferable license, for the term of the protection of the rights so licensed, to access, use, store, copy, modify, prepare derivative works of, distribute, publish, transmit, stream, broadcast, and otherwise exploit in any manner such Content to provide and/or promote the Airbnb Platform, in any media or platform, known or unknown to date and in particular on Internet and social networks. If Content includes personal information, such Content will only be used for these purposes if such use complies with applicable data protection laws in accordance with our Privacy Policy. Where Airbnb pays for the creation of Content or facilitates its creation, Airbnb may own that Content, in which case supplemental terms or disclosures will say that. You are solely responsible for all Content that you provide and warrant that you either own it or are authorized to grant Airbnb the rights described in these Terms. You are responsible and liable if any of your Content violates or infringes the intellectual property or privacy rights of any third party. Content must comply with our Content Policy and Nondiscrimination Policy, which prohibit, among other things, discriminatory, obscene, harassing, deceptive, violent and illegal content. You agree that Airbnb may make available services or automated tools to translate Content and that your Content may be translated using such services or tools. Airbnb does not guarantee the accuracy or quality of translations and Members are responsible for confirming the accuracy of such translations.

11. Fees.

Airbnb may charge fees (and applicable Taxes) to Hosts and Guests for use of the Airbnb Platform. More information about when service fees apply and how they are calculated can be found on our Service Fees page. Except as otherwise provided on the Airbnb Platform, service fees are non-refundable. Airbnb reserves the right to change the service fees at any time, and will provide Members notice of any fee changes before they become effective. Fee changes will not affect bookings made prior to the effective date of the fee change. If you disagree with a fee change you may terminate this agreement at any time pursuant to Section 13.2.

12. Airbnb Platform Rules.

12.1 Rules. You must follow these rules and must not help or induce others to break or circumvent these rules.

  • Act with integrity and treat others with respect
    • Do not lie, misrepresent something or someone, or pretend to be someone else.
    • Be polite and respectful when you communicate or interact with others.
    • Follow our Nondiscrimination Policy and do not discriminate against or harass others.
  • Do not scrape, hack, reverse engineer, compromise or impair the Airbnb Platform
    • Do not use bots, crawlers, scrapers or other automated means to access or collect data or other content from or otherwise interact with the Airbnb Platform.
    • Do not hack, avoid, remove, impair, or otherwise attempt to circumvent any security or technological measure used to protect the Airbnb Platform or Content.
    • Do not decipher, decompile, disassemble or reverse engineer any of the software or hardware used to provide the Airbnb Platform.
    • Do not take any action that could damage or adversely affect the performance or proper functioning of the Airbnb Platform.
  • Only use the Airbnb Platform as authorized by these Terms or another agreement with us
    • You may only use another Member’s personal information as necessary to facilitate a transaction using the Airbnb Platform as authorized by these Terms.
    • Do not use the Airbnb Platform, our messaging tools, or Members’ personal information to send commercial messages without their express consent.
    • You may use Content made available through the Airbnb Platform solely as necessary to enable your use of the Airbnb Platform as a Guest or Host.
    • Do not use Content unless you have permission from the Content owner or the use is authorized by us in these Terms or another agreement you have with us.
    • Do not request, make or accept a booking or any payment outside of the Airbnb Platform to avoid paying fees, taxes or for any other reason. See our Offline Fee Policy for exceptions.
    • Do not require or encourage Guests to open an account, leave a review, or otherwise interact, with a third party website, application or service before, during or after a reservation, unless authorized by Airbnb.
    • Do not engage in any practices that are intended to manipulate our search algorithm.
    • Do not book Host Services unless you are actually using the Host Services.
    • Do not use, copy, display, mirror or frame the Airbnb Platform, any Content, any Airbnb branding, or any page layout or design without our consent.
  • Honor your legal obligations
    • Understand and follow the laws that apply to you, including privacy, data protection, and export laws.
    • If you provide us with someone else’s personal information, you: (i) must do so in compliance with applicable law, (ii) must be authorized to do so, and (iii) authorize us to process that information under our Privacy Policy.
    • Read and follow our Terms, Policies and Standards.
    • Do not organize or facilitate unauthorized parties or events. You are responsible and liable for any party or event during your reservation that violates our rules for parties and events, as incorporated by reference herein.
    • Do not use the name, logo, branding, or trademarks of Airbnb or others without permission.
    • Do not use or register any domain name, social media handle, trade name, trademark, branding, logo or other source identifier that may be confused with Airbnb branding.
    • Do not offer Host Services that violate the laws or agreements that apply to you.
    • Do not offer or solicit prostitution or participate in or facilitate human trafficking.

12.2 Reporting Violations. If you believe that a Member, Listing or Content poses an imminent risk of harm to a person or property, you should immediately contact local authorities before contacting Airbnb. In addition, if you believe that a Member, Listing or Content has violated our Standards, you should report your concerns to Airbnb. If you reported an issue to local authorities, Airbnb may request a copy of that report. Except as required by law, we are not obligated to take action in response to any report.

12.3 Copyright Notifications. If you believe that Content on the Airbnb Platform infringes copyrights, please notify us in accordance with our Copyright Policy.

13. Termination, Suspension and other Measures.

13.1 Term. The agreement between you and Airbnb reflected by these Terms remains in effect until either you or we terminate the agreement in accordance with these Terms.

13.2 Termination. You may terminate this agreement at any time by sending us an email or by deleting your account. Airbnb may terminate this agreement for any reason by giving you 30 days’ notice via email or using any other contact information you have provided for your account. Airbnb may also terminate this agreement immediately and without prior notice and stop providing access to the Airbnb Platform if (i) you materially breach these Terms or our Policies, (ii) you violate applicable laws, or (iii) such action is necessary to protect the personal safety or property of Airbnb, its Members, or third parties (for example in the case of fraudulent behavior of a Member), or (iv) your account has been inactive for more than two years.

13.3 Member Violations. If (i) you breach these Terms, our Policies, or our Standards, (ii) you violate applicable laws, regulations or third party rights, (iii) you have repeatedly received poor Reviews or Airbnb otherwise becomes aware of or has received complaints about your performance or conduct, (vi) you have repeatedly cancelled confirmed bookings or failed to respond to booking requests without a valid reason, or (vii) such action is necessary to protect the personal safety or property of Airbnb, its Members, or third parties, Airbnb may:

  • suspend or limit your access to or use of the Airbnb Platform and/or your account;
  • suspend or remove Listings, Reviews, or other Content;
  • cancel pending or confirmed bookings; or
  • suspend or revoke any special status associated with your account.

In case of non-material violations or where otherwise appropriate, you will be given notice of any intended measure by Airbnb and an opportunity to resolve the issue, unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other Members or third parties, or (iii) contravene applicable laws.

13.4 Legal Mandates. Airbnb may take any action it determines is reasonably necessary to comply with applicable law, or the order or request of a court, law enforcement or other administrative agency or governmental body, including the measures described above in Section 13.3.

13.5 Effect of Termination. If you are a Host and terminate your Airbnb account, any confirmed booking(s) will be automatically cancelled and your Guests will receive a full refund. If you terminate your account as a Guest, any confirmed booking(s) will be automatically cancelled and any refund will depend upon the terms of the Listing’s cancellation policy. When this agreement has been terminated, you are not entitled to a restoration of your account or any of your Content. If your access to or use of the Airbnb Platform has been limited, or your Airbnb account has been suspended, or this agreement has been terminated by us, you may not register a new account or access or use the Airbnb Platform through an account of another Member.

13.6 Appeal. If Airbnb takes any of the measures described in this Section 13 you may appeal such a decision by contacting our customer service.

14. Modification of these Terms.

Airbnb may modify these Terms at any time. When we make changes to these Terms, we will post the revised Terms on the Airbnb Platform and update the “Last Updated” date at the top of these Terms. We will also provide you with notice of the proposed changes by email at least thirty (30) days before the date they become effective. If you disagree with the revised Terms, you may terminate this agreement immediately as provided in these Terms. We will inform you about your right to terminate the Agreement in the notification email. If you do not terminate your agreement before the date the revised Terms become effective, your continued access to or use of the Airbnb Platform will constitute acceptance of the revised Terms.

15. Resolving Complaints and Damage Claims.

If a Member provides evidence that another Member has culpably damaged their real or personal property ("Damage Claim"), the complaining Member can seek compensation through the Resolution Center. If the complaining Member escalates a Damage Claim to Airbnb, the other Member will be given an opportunity to respond. If the responding Member agrees to pay, or Airbnb determines under consideration of any applicable statutory rules on the burden of proof that they are responsible for the Damage Claim, Airbnb via Airbnb Payments can collect any sums required to cover the Damage Claim from the responding Member and/or against any security deposit. Airbnb may also pursue against you any remedies it may have available under applicable law. You agree to cooperate in good faith, provide any information Airbnb requests, execute documents, and take further reasonable action, in connection with Damage Claims, Member complaints, claims under insurance policies, or other claims related to your provision or use of Host Services. You may appeal a decision by Airbnb by contacting our customer service. Any decisions made by Airbnb in relation to a Damage Claim do not affect your contractual and statutory rights. Your right to take legal action before a court of law remains unaffected.

16. Airbnb’s Role.

We offer a platform that enables Members to publish, offer, search for, and book Host Services. When Members make or accept a booking, they are entering into a contract directly with each other. Airbnb is not and does not become a party to or other participant in any contractual relationship between Members. Airbnb is not acting as an agent for any Member except for where Airbnb Payments acts as a collection agent as provided in the Payments Terms. While we work hard to ensure our Members have great experiences using Airbnb, we do not and cannot control the conduct or performance of Guests and Hosts and do not guarantee (i) the existence, quality, safety, suitability, or legality of any Listings or Host Services or (ii) the truth or accuracy of any Listing descriptions, Reviews, or other Content provided by Members. You acknowledge that Airbnb has no general obligation to monitor the use of the Airbnb Platform and verify information provided by our Members, but has the right to review, disable access to, remove, or edit Content to: (i) operate, secure and improve the Airbnb Platform (including for fraud prevention, risk assessment, investigation and customer support purposes); (ii) ensure Members’ compliance with these Terms; (iii) comply with applicable law or the order or requirement of a court, law enforcement or other administrative agency or governmental body; (iv) address Member Content that we determine is harmful or objectionable; (v) take actions set out in these Terms; and (vi) maintain and enforce any quality or eligibility criteria, including by removing Listings that don’t meet quality and eligibility criteria. Where we remove or disable Content, we will notify a Member and provide the reasons for such a measure, unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other Members or third parties, or (iii) contravene applicable laws. You may appeal such a decision by contacting our customer service. Members agree to cooperate with and assist Airbnb in good faith, and to provide Airbnb with such information and take such actions as may be reasonably requested by Airbnb with respect to any investigation undertaken by Airbnb regarding the use or abuse of the Airbnb Platform.

17. Member Accounts.

You must register an account to access and use many features of the Airbnb Platform. Registration is only permitted for legal entities, partnerships and natural persons who are 18 years or older. You represent and warrant that you are not a person or entity barred from using the Airbnb Platform under the laws of the United States, your place of residence, or any other applicable jurisdiction. You must provide accurate, current, and complete information during registration and keep your account information up-to-date. You may not register more than one account or transfer your account to someone else. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You must immediately notify Airbnb if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised. You are responsible and liable for activities conducted through your Airbnb Account, unless such activities are not authorized by you and you are not otherwise negligent (such as failing to report the unauthorized use or loss of your credentials). If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.

18. Disclaimer.

We do not endorse or warrant the existence, conduct, performance, safety, quality, legality or suitability of any Guest, Host, Host Service, Listing or third party and we do not warrant that verification, identity or background checks conducted on Members (if any) will identify past misconduct or prevent future misconduct. Any references to a Member being "verified" (or similar language) indicate only that the Member or Airbnb has completed a relevant verification or identification process and nothing else. We are not responsible for outages or disruptions of the Internet and telecommunications infrastructure which are beyond our control and can lead to interruptions in the availability of the Airbnb Platform. Airbnb may, temporarily and under consideration of the Members’ legitimate interests (e.g. by providing prior notice), restrict the availability of the Airbnb Platform or certain features thereof, if this is necessary in view of capacity limits, the security or integrity of our servers, or to carry out maintenance measures that ensure the proper or improved functioning of the Airbnb Platform.

19. Liability.

Airbnb is liable under statutory provisions for intent and gross negligence by us, our legal representatives, directors, or other vicarious agents. The same applies to the assumption of guarantees or any other strict liability, or in case of a culpable injury to life, limb, or health. For any negligent breaches of essential contractual obligations by us, our legal representatives, directors, or other vicarious agents Airbnb’s liability is limited to the typically occurring foreseeable damages. Essential contractual obligations are such duties of Airbnb in whose proper fulfillment you regularly trust and must trust for the proper execution of the contract. Any additional liability of Airbnb is excluded.

20. Indemnification.

To the maximum extent permitted by applicable law, you agree to release, defend (at Airbnb’s option), indemnify, and hold Airbnb (including Airbnb Payments, other affiliates, and their personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your breach of these Terms (including any supplemental or additional terms that apply to a product or feature) or our Policies or Standards, (ii) your improper use of the Airbnb Platform, (iii) your interaction with any Member, stay at an Accommodation, participation in an Experience or other Host Service, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use, (iv) your failure, or our failure at your direction, to accurately report, collect or remit Taxes, or (v) your breach of any laws, regulations or third party rights such as intellectual property or privacy rights. The indemnification obligation only applies if and to the extent that the claims, liabilities, damages, losses, and expenses have been adequately caused by your culpable breach of a contractual obligation.

21. Contracting Entities.

Based on your country of residence or establishment and what you are doing on the Airbnb Platform, Schedule 1 below sets out the Airbnb entity with whom you are contracting. If we identify through the Airbnb Platform, an Airbnb entity other than the one set out on Schedule 1 as being responsible for a product, feature or transaction, the Airbnb entity so identified is your contracting entity with respect to that product, feature or transaction. If you change your country of residence or establishment to a country outside of the EEA, Switzerland or the United Kingdom, the Airbnb company you contract with and the applicable version of the Terms of Service will be determined by your new country of residence or establishment, from the date on which your country of residence or establishment changes.

22. Applicable law and Jurisdiction.

These Terms are governed by and construed in accordance with Irish law. If you are acting as a consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of Irish law. As a consumer, you may bring any judicial proceedings relating to these Terms before the competent court of your place of residence or the competent court of Airbnb's place of business in Ireland. If Airbnb wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the Irish courts.

23. Miscellaneous.

23.1 Other Terms Incorporated by Reference. Our Host Guarantee Terms, Japan Host Insurance Terms, Guest Refund Policy, Experiences Guest Refund Policy, Content Policy, Nondiscrimination Policy, Extenuating Circumstances Policy, Policies, Standards and other supplemental policies and terms linked to in these Terms apply to your use of the Airbnb Platform, are incorporated by reference, and form part of your agreement with Airbnb.

23.2 Interpreting these Terms. Except as they may be supplemented by additional terms, conditions, policies, guidelines, standards, and in-product disclosures, these Terms constitute the entire agreement between Airbnb and you pertaining to your access to or use of the Airbnb Platform and supersede any and all prior oral or written understandings or agreements between Airbnb and you. These Terms do not and are not intended to confer any rights or remedies upon anyone other than you and Airbnb. If any provision of these Terms is held to be invalid or unenforceable, except as otherwise indicated in Section 24.11 below, such provision will be struck and will not affect the validity and enforceability of the remaining provisions.

23.3 No Waiver. Airbnb’s failure to enforce any right or provision in these Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise permitted under law.

23.4 Assignment. You may not assign, transfer or delegate this agreement or your rights and obligations hereunder without Airbnb's prior written consent. Airbnb may without restriction assign, transfer or delegate this agreement and any rights and obligations hereunder, at its sole discretion, with 30 days’ prior notice. Your right to terminate this agreement at any time pursuant to Section 13.2 remains unaffected.

23.5 Notice. Unless specified otherwise, any notices or other communications to Members permitted or required under this agreement, will be provided electronically and given by Airbnb via email, Airbnb Platform notification, messaging service (including SMS and WeChat), or any other contact method we enable you to provide. If a notification relates to a booking or Listing in Japan, you agree and acknowledge that such notifications via electronic means in lieu of a written statement, satisfies Airbnb’s obligations under Article 59 (1) of the Japanese Housing Accommodation Business Act.

23.6 Third-Party Services. The Airbnb Platform may contain links to third-party websites, applications, services or resources (“Third-Party Services”) that are subject to different terms and privacy practices. Airbnb is not responsible or liable for any aspect of such Third-Party Services and links to such Third-Party Services are not an endorsement.

23.7 Google Terms. Some translations on the Airbnb Platform are powered by Google. Google disclaims all warranties related to the translations, express or implied, including any warranties of accuracy, reliability, and any implied warranties for merchantability, fitness for a particular purpose and non-infringement. Some areas of the Airbnb Platform implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to the Google Maps/Google Earth Additional Terms of Service.

23.8 Apple Terms. If you access or download our application from the Apple App Store, you agree to Apple’s Licensed Application End User License Agreement.

23.9 Airbnb Platform Content. Content made available through the Airbnb Platform may be protected by copyright, trademark, and/or other laws of the United States and other countries. You acknowledge that all intellectual property rights for that Content are the exclusive property of Airbnb and/or its licensors and agree that you will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices. You may not use, copy, adapt, modify, prepare derivative works of, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit any Content accessed through the Airbnb Platform except to the extent you are the legal owner of that Content or as expressly permitted in these Terms. Subject to your compliance with these Terms, Airbnb grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to (i) download and use the Application on your personal device(s); and (ii) access and view the Content made available on or through the Airbnb Platform and accessible to you, solely for your personal and non-commercial use.

23.10 Airbnb.org. Airbnb.org is a nonprofit corporation exempt from income taxation under U.S. Internal Revenue Code Section 501(c)(3), operating as a public charity. Airbnb.org is not owned or controlled by Airbnb. Airbnb.org administers a number of charitable programs that benefit our Host and Guest communities and the public.

23.11 Force Majeure. Airbnb shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials.

23.12 Emails and SMS. You will receive administrative communications from us using the email address or other contact information you provide for your Airbnb account. Enrollment in additional email subscription programs will not affect the frequency of these administrative emails, though you should expect to receive additional emails specific to the program(s) to which you have subscribed. You may also receive promotional emails from us. No fee is charged for these promotional emails, but third-party data rates could apply. You can control whether you receive promotional emails using the notification preferences in your account settings. Please note that you will not be able to take advantage of certain promotions if you disable certain communication settings or do not have an Airbnb Account. In the U.S. if you consent to receive SMS (text messages) from us, you will be subject to our SMS Terms.

24. United States Dispute Resolution and Arbitration Agreement.

24.1 Application. This Arbitration Agreement only applies to you if your country of residence or establishment is the United States. If your country of residence or establishment is not the United States, and you nevertheless attempt to bring any legal claim against Airbnb in the United States, this Arbitration Agreement will apply for determination of the threshold issue of whether this Section 24 applies to you, and all other threshold determinations, including residency, arbitrability, venue, and applicable law.

24.2 Overview of Dispute Resolution Process. Airbnb is committed to participating in a consumer-friendly dispute resolution process. To that end, these Terms provide for a two-part process for individuals to whom this Section 24 applies: (1) an informal negotiation directly with Airbnb’s customer service team (described in paragraph 24.3, below), and if necessary (2) a binding arbitration administered by the American Arbitration Association (“AAA”). You and Airbnb each retain the right to seek relief in small claims court as an alternative to arbitration.

24.3 Mandatory Pre-Arbitration Dispute Resolution and Notification. At least 30 days prior to initiating an arbitration, you and Airbnb each agree to notify the other party of the dispute in writing and attempt in good faith to negotiate an informal resolution. You must send your notice of dispute to Airbnb by mailing it to Airbnb’s agent for service: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833. Airbnb will send its notice of dispute to the email address associated with your Airbnb account. A notice of dispute must include: the party’s name and preferred contact information, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written Demand for Arbitration (available at www.adr.org) with the AAA and providing a copy to the other party as specified in the AAA Rules (available at www.adr.org). 

24.4 Agreement to ArbitrateYou and Airbnb mutually agree that any dispute, claim or controversy arising out of or relating to these Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of the Airbnb Platform, Host Services, or any Content (collectively, “Disputes”) will be settled by binding individual arbitration (the “Arbitration Agreement”). If there is a dispute about whether this Arbitration Agreement can be enforced or applies to our Dispute, you and Airbnb agree that the arbitrator will decide that issue.

24.5 Exceptions to Arbitration Agreement. You and Airbnb each agree that the following causes of action and/or claims for relief are exceptions to the Arbitration Agreement and will be brought in a judicial proceeding in a court of competent jurisdiction (as defined by Section 22 of the Terms of Service for Non-European Users): (i) any claim or cause of action alleging actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights; (ii) any claim or cause of action seeking emergency injunctive relief based on exigent circumstances (e.g., imminent danger or commission of a crime, hacking, cyber-attack); or (iii) a request for the remedy of public injunctive relief. You and Airbnb agree that the remedy of public injunctive relief will proceed after the arbitration of all arbitrable claims, remedies, or causes of action, and will be stayed pending the outcome of the arbitration pursuant to section 3 of the Federal Arbitration Act.

24.6 Arbitration Rules and Governing Law. This Arbitration Agreement evidences a transaction in interstate commerce and the Federal Arbitration Act governs all substantive and procedural interpretation and enforcement of this provision. The arbitration will be administered by AAA in accordance with the Consumer Arbitration Rules and/or other AAA arbitration rules determined to be applicable by the AAA (the “AAA Rules“) then in effect, except as modified here. The AAA Rules are available at www.adr.org. In order to initiate arbitration, a completed written demand (available at www.adr.org) must be filed with the AAA and provided to the other party, as specified in the AAA rules.

24.7 Modification to AAA Rules - Arbitration Hearing/Location. In order to make the arbitration most convenient to you, Airbnb agrees that any required arbitration hearing may be conducted, at your option: (a) in the U.S. county where you reside; (b) in San Francisco County; (c) via phone or video conference; or (d) if all parties agree, by solely the submission of documents to the arbitrator.

24.8 Modification of AAA Rules - Attorney’s Fees and Costs. Your arbitration fees and your share of arbitrator compensation shall be governed by the AAA Rules and, where appropriate, limited by the AAA Consumer Rules. If such costs are determined by the arbitrator to be excessive, Airbnb will pay all arbitration fees and expenses. Either party may make a request that the arbitrator award attorneys’ fees and costs upon proving that the other party has asserted a claim, cross-claim or defense that is groundless in fact or law, brought in bad faith or for the purpose of harassment, or is otherwise frivolous, as allowed by applicable law and the AAA Rules.

24.9 Arbitrator’s Decision. The arbitrator’s decision will include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court with proper jurisdiction. The arbitrator may award any relief allowed by law or the AAA Rules, but declaratory or injunctive relief may be awarded only on an individual basis and only to the extent necessary to provide relief warranted by the claimant’s individual claim.

24.10 Jury Trial Waiver. You and Airbnb acknowledge and agree that we are each waiving the right to a trial by jury as to all arbitrable Disputes.

24.11 No Class Actions or Representative Proceedings. You and Airbnb acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate as a plaintiff or class member in any purported class action lawsuit, class-wide arbitration, private attorney general action, or any other representative or consolidated proceeding. Unless we agree in writing, the arbitrator may not consolidate more than one party’s claims and may not otherwise preside over any form of any class or representative proceeding. If there is a final judicial determination that applicable law precludes enforcement of the waiver contained in this paragraph as to any claim, cause of action or requested remedy, then that claim, cause of action or requested remedy, and only that claim, cause of action or requested remedy, will be severed from this agreement to arbitrate and will be brought in a court of competent jurisdiction. In the event that a claim, cause of action or requested remedy is severed pursuant to this paragraph, then you and we agree that the claims, causes of action or requested remedies that are not subject to arbitration will be stayed until all arbitrable claims, causes of action and requested remedies are resolved by the arbitrator.

24.12 Severability. Except as provided in Section 24.11, in the event that any portion of this Arbitration Agreement is deemed illegal or unenforceable, such provision will be severed and the remainder of the Arbitration Agreement will be given full force and effect.

24.13 Changes to Agreement to Arbitrate. If Airbnb changes this Section 24 after the date you last accepted these Terms (or accepted any subsequent changes to these Terms), you may reject that change by sending us written notice (including by email) within 30 days of the date the change is effective. Rejecting a new change, however, does not revoke or alter your prior consent to any earlier agreements to arbitrate any Dispute between you and Airbnb (or your prior consent to any subsequent changes thereto), which will remain in effect and enforceable as to any Dispute between you and Airbnb.

24.14 Survival. Except as provided in Section 24.12, and subject to Section 13.6 of the Terms of Service for Non-European Users this Section 24 will survive any termination of these Terms and will continue to apply even if you stop using the Airbnb Platform or terminate your Airbnb Account.

Additional Terms Applicable to Business Users

If you are a Business User as defined in Section 25 of these Terms, the following additional terms will apply to you:

25. Business Users.

You are a “Business User” for the purposes of these Terms if (i) your place of residence or establishment is within the EEA or the United Kingdom, (ii) you fully meet the definition of a ‘business user’ outlined in Article 2 (1) of Regulation (EU) 2019/1150 on promoting fairness and transparency for business users of online intermediation services (“Platform to Business Regulation”), and (iii) you have notified Airbnb that you are a Business User by adding your business details to your Airbnb account. You are responsible for keeping your business details accurate and up to date.

26. Termination, Suspension and other Measures.

In case we take any of the measures according to Section 13.2 and 13.3, you will be given the opportunity to clarify the facts and circumstances leading to such a measure in the framework of our internal complaint-handling process as described in Section 27.

27. Complaints Handling and Mediation.

We want to be transparent about how we handle complaints and aim to treat all Business Users fairly. Our Help Center explains how you can access our internal complaint-handling system and what you can expect as a Business User when you make a complaint in relation to issues falling under the remit of Article 11 (1) of the Platform to Business Regulation. It also sets out the details of the mediation service that you can use in the event that such a complaint is not resolved.

28. Access to Data.

Business Users have access to personal and other data in their Airbnb account and host dashboard which is provided by the Business User, their Guests or generated through the use of the Airbnb Platform and which is necessary for the performance of their Host Services as well as aggregated information about searches, bookings and the performance of their listings. Our Privacy Policy sets out the categories of personal data and other data we collect, how we use, process, disclose and retain it, and how you can access it and exercise your data rights.

29. Additional Distribution Channels.

Airbnb operates an affiliate program through which Listings may be featured on third party websites, such as those for online travel sites, media outlets, loyalty programs, and search aggregators. Listings may also appear in advertisements for Airbnb published on third party websites from time to time.

Terms of Service for Australian Users

These Terms of Service for Australian Users (“Terms”) are subject to the Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. These Terms (including Sections 1.3, 3, 5.3, 5.4, 5.5, 10, 17, 18 and 19) apply to the maximum extent permitted by the Australian Consumer Law.

Section 23 of these Terms contains an arbitration agreement and class action waiver that applies to all claims brought against Airbnb in the United States. Please read them carefully.

These Terms and the documents, policies and standards referred to within them, form a binding legal agreement between you and Airbnb that governs your right to use the websites, applications, and other offerings from Airbnb (collectively, the “Airbnb Platform”).

The documents referred to within these Terms include but are not limited to our:

  • Payments Terms of Service, which govern any payment services provided to Members by the Airbnb payment entities (such entities, collectively, "Airbnb Payments").
  • Privacy Policy, which describes our collection and use of personal data.
  • Service Fees Policy, which describes how Airbnb service fees are charged to Hosts and Guests.
  • Offline Fee Policy, which describes the circumstances in which a Host can charge additional fees or charges outside the Airbnb Platform.
  • Off-Platform Policy, which prohibits certain actions from occurring outside of the Airbnb Platform.
  • Taxes Policy, which explains what taxes may apply to a Reservation.
  • Host Privacy Standards, that specify how Hosts should handle Guest Personal Information.

  • Listing Management Terms of Service, which govern the use of Teams to help manage Listings and provide Host Services.

For convenience, we have set out above several terms and policies that are referred to in these Terms. However, it is important that you note that there are other supplemental policies and terms linked from our Legal Terms and Policies pages, which apply to your use of the Airbnb Platform, and are incorporated by reference, and form part of the binding legal agreement between you and Airbnb.

When used in these Terms, “Airbnb,” “we,” “us,” or “our” refers to the Airbnb entity set out on Schedule 1 with whom you are contracting.

The Airbnb Platform offers an online venue that enables users (“Members”) to publish, offer, search for, and book services. Members who publish and offer services are “Hosts” and Members who search for, book, or use services are “Guests". Hosts offer accommodations (“Accommodations”), activities, excursions and events (“Experiences”), and a variety of travel and other services (collectively, “Host Services,” and each Host Service offering, a “Listing”).

As the provider of the Airbnb Platform, Airbnb does not own, control, offer or manage any Listings, Host Services, or tourism services. Airbnb is not a party to the contracts entered into directly between Hosts and Guests, nor is Airbnb a real estate broker, travel agency, or insurer. Airbnb is not acting as an agent in any capacity for any Member, except as specified in the Payments Terms of Service (“Payment Terms”). To learn more about Airbnb’s role see Section 15.

Guest Terms

1. Searching and Booking on Airbnb.

1.1 Searching. You can search for Host Services by using criteria like the type of Host Service, type of listing, travel destination, travel dates, and number of guests. You can also use filters to refine your search results. Search results are based on their relevance to your search and other criteria. Relevance considers factors like price, availability, reviews, customer service and cancellation history, popularity, previous trips and saved Listings, Host requirements (e.g. minimum or maximum nights), and more. Learn more about search results in our Help Center.

1.2 Booking. When you book a Listing, you are agreeing to pay all charges for your booking including the Listing price, applicable fees like Airbnb’s service fee, offline fees, taxes, and any other items identified during checkout (collectively, “Total Price”). If you choose to pay using a currency that differs from the currency set by the Host for their Listing, the price displayed to you prior to you completing payment is based on a currency conversion rate determined by us. You are also agreeing that Airbnb via Airbnb Payments may charge the Payment Method (as defined in the Payment Terms) used to book the Listing in order to collect Damage Claim (as defined in Section 14) amounts. If you choose to pay using a currency that differs from the currency set by the Host for their Listing, the price displayed to you is based on a currency conversion rate determined by us. When you receive the booking confirmation, a contract for Host Services (a "Reservation") is formed directly between you and the Host. By making a Reservation you are agreeing to the terms of the contract. The terms of the contract include these Terms, all terms of the Reservation, including without limitation, the cancellation policy and any other rules, standards, policies, or requirements identified in the Listing or during checkout that apply to the Reservation. It is your responsibility to read and understand these terms of the contract including these Terms and all terms of the Reservation including all rules, standards, policies, and requirements prior to booking a Listing. Be aware that some Hosts work with a co-host or as part of a team to provide their Host Services.

1.3 Accommodation Reservations. An Accommodation Reservation is a limited license to enter, occupy and use the Accommodation. The Host retains the right to re-enter the Accommodation during your stay, to the extent: (i) it is reasonably necessary, (ii) permitted by your contract with the Host, and (iii) permitted by applicable law. If you stay past checkout, the Host has the right to make you leave in a manner permitted by applicable law, including by imposing reasonable overstay penalties. You may not exceed the maximum number of allowed Guests.

1.4 Reservations for Experiences and Other Host Services. An Experience or other Host Service Reservation entitles you to participate in, attend, or use that Experience or Host Service. You are responsible for confirming that you, and anyone you invite, meet minimum age, proficiency, fitness or other requirements. You are responsible for informing the Host of any medical or physical conditions, or other circumstances that may impact your ability to participate, attend or use the Experience or Host Service. Except where expressly authorized, you may not allow any person to join an Experience or Host Service unless they are included as an additional guest during the booking process.

2. Cancellations, Reservation Issues, Refunds and Booking Modifications.

2.1 Cancellations, Reservation Issues, and Refunds. In general, if you cancel a Reservation, the amount refunded to you is determined by the Host’s cancellation policy that applies to that Reservation, as displayed on the Listing page at the time of booking. But, in certain situations, other policies take precedence and determine what amount is refunded to you. If something outside your control requires you to cancel a Reservation, you may be entitled to a partial or full refund under our Extenuating Circumstances Policy. If the Host cancels, or you experience a Reservation Issue (as defined in our Rebooking and Refund Policy), you may be entitled to rebooking assistance or a partial or full refund under our Rebooking and Refund Policy. Different policies apply to certain categories of Listings; for example, Experiences reservations are governed by the Experiences Guest Refund Policy. See each Additional Legal Term or Policy for details about what is covered, and what refund applies in each situation. You may appeal a decision by Airbnb by contacting our customer service.

2.2 Booking Modifications. Guests and Hosts are responsible for any booking modifications they agree to make via the Airbnb Platform or direct Airbnb customer service to make on their behalf ("Booking Modifications"), and agree to pay any additional amounts, fees, or taxes associated with any Booking Modification, which are notified to them prior to choosing to proceed with the Booking Modification.

3. Your Responsibilities and Assumption of Risk.

3.1 Your Responsibilities. To the maximum extent permitted by law, you are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to any Accommodation, all areas and facilities where the Accommodation is located that the Host and Guest are legally entitled to use in connection with the Accommodation (“Common Areas”), or any Experience or other Host Service. For example, this means: (i) you are responsible for leaving an Accommodation (and related personal property) or Common Areas in the condition it was in when you arrived, (ii) you are responsible for paying all reasonable Damage Claim amounts, and (iii) you must act with integrity, treat others with respect and comply with applicable laws at all times. If you are booking for an additional guest who is a minor or if you bring a minor to a Host Service, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor.

3.2 Your Assumption of RiskYou acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the risk arising out of your access to and use of the Airbnb Platform and any Content (as defined in Section 9), including your stay at any Accommodation, participation in any Experience, use of any other Host Service, or any other interaction you have with other Members whether in person or online. This means it is your responsibility to investigate a Host Service to determine whether it is suitable for you. For example, Host Services may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Host Services.

Host Terms

4. Hosting on Airbnb.

4.1 Host. As a Host, Airbnb offers you the right to use the Airbnb Platform in accordance with these Terms to share your Accommodation, Experience, or other Host Service with our vibrant community of Guests - and earn money doing it. It’s easy to create a Listing and you are in control of how you host - set your price, availability, and rules for each Listing.

4.2 Contracting with Guests. When you accept a booking request, or receive a booking confirmation through the Airbnb Platform, you are entering into a contract directly with the Guest, and are responsible for delivering the Host Service under the terms and at the price specified in your Listing. You are also agreeing to pay applicable fees like Airbnb’s service fee (and applicable taxes) for each booking. Airbnb Payments will deduct amounts you owe from your payout unless we and you agree to a different method. Any terms or conditions that you include in any supplemental contract with Guests must: (i) be consistent with these Terms, our Additional Legal Terms, Policies, and the information provided in your Listing, and (ii) be prominently disclosed in your Listing description.

4.3 Independence of Hosts. Your relationship with Airbnb is that of an independent individual or entity and not an employee, agent, joint venturer or partner of Airbnb, except that Airbnb Payments acts as a payment collection agent as described in the Payments Terms. Airbnb does not direct or control your Host Service and you understand that you have complete discretion whether and when to provide Host Services and at what price and on what terms to offer them.

5. Managing Your Listing.

5.1 Creating and Managing Your Listing. The Airbnb Platform provides tools that make it easy for you to set up and manage a Listing. Your Listing must include complete and accurate information about your Host Service, your price, other charges like cleaning fees, resort fees, offline fees, and any rules or requirements that apply to your Guests or Listing. You are responsible for your acts and omissions as well as for keeping your Listing information (including calendar availability) and content (like photos) up-to-date and accurate at all times. You are responsible for obtaining appropriate insurance for your Host Services and we suggest you carefully review policy terms and conditions including coverage details and exclusions. You may only maintain one Listing per Accommodation, but may have multiple Listings for a single property if it has multiple places to stay. Any offer of an Experience is subject to our Additional Terms for Experience Hosts in Section 24.

5.2 Know Your Legal Obligations. You are responsible for understanding and complying with any laws, rules, regulations and contracts with third parties that apply to your Listing or Host Services. For example: Some landlords and leases, or homeowner and condominium association rules, restrict or prohibit subletting, short-term rentals and/or longer-term stays. Some cities have zoning or other laws that restrict the short-term rental of residential properties. Some jurisdictions require Hosts to register, get a permit, or obtain a license before providing certain Host Services (such as short-term rentals, longer-term stays, preparing food, serving alcohol for sale, guiding tours or operating a vehicle). In some places, the Host Services you want to offer may be prohibited altogether. Some jurisdictions require that you register Guests who stay at your Accommodation. Some jurisdictions have laws that create tenancy rights for Guests and additional obligations for Hosts. For example, some places have landlord-tenant, rent control, and eviction laws that may apply to longer stays. Check your local rules to learn what rules apply to the Host Services you plan to offer. Information we provide regarding legal requirements is for informational purposes only and you should independently confirm your obligations. You are responsible for handling and using personal data of Guests and others in compliance with applicable privacy laws and these Terms, including our Host Privacy Standards. If you have questions about how local laws apply you should always seek legal advice.

5.3 Search Ranking. The ranking of Listings in search results on the Airbnb Platform depends on a variety of factors, including these main parameters:

  • Guest search parameters (e.g. number of Guests, destination, time and duration of the trip, price range),
  • Listing characteristics (e.g. location, price, calendar availability, number and quality of images, reviews, ratings and other quality signals, type or category of Host Service, Host status, length of time the Listing has been live on the Airbnb Platform, Guest engagement and popularity),
  • Guest experience (e.g. customer service and cancellation history of the Host, ease of booking),
  • Host and Listing requirements (e.g. minimum or maximum nights, booking cut-off time), and
  • Guest preferences and history (e.g. previous trips, viewed and saved Listings, location from where the Guest is searching).

Search results may be different on our mobile application than on our website, and may also differ in the map view. Airbnb may allow Hosts to promote their Listings in search or elsewhere on the Airbnb Platform by paying an additional fee. More information about the factors that determine how your Listing appears in search results, our current promotional programs (if any) and how we identify promoted Content can be found in our Help Center.

5.4 Your Responsibilities. To the maximum extent permitted by law, you are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you allow to participate in providing your Host Services. You are responsible for setting your price and establishing rules and requirements for your Listing. You must describe any and all fees and charges in your Listing description and may not collect any additional fees or charges outside the Airbnb Platform except those expressly authorized by our Offline Fee Policy. Do not encourage Guests to create third-party accounts, submit reviews, provide their contact information, or take other actions outside the Airbnb Platform in violation of our Off-Platform Policy.

5.5 Hosting as a Team or Organization. To the maximum extent permitted by law, if you work with a co-host or host as part of a team, business or other organization, you are responsible and liable as a Host under these terms for the acts and omission of each entity and individual who participates in providing your Host Services and you are required to inform personnel engaged by you to deliver any Host Services of your obligations under these Terms. If you accept terms or enter into contracts with third parties, you represent and warrant that you are authorized to enter into contracts for and bind your team, business or other organization, and that each entity you use is in good standing under the laws of the place where it is established. If you perform other functions, you represent and warrant that you are authorized to perform those functions. If you instruct Airbnb to transfer a portion of your payout to a co-host or other Hosts, or send payments to someone else, you must be authorized to do so, and are responsible and liable for the payment amounts and accuracy of any payout information you provide.

5.6 Your Assumption of Risk. You acknowledge that hosting carries inherent risks and agree that, to the maximum extent permitted by law, you assume the risk arising out of your access to and use of the Airbnb Platform, offering Host Services, or any interaction you have with other Members whether in person or online. You agree that you have had the opportunity to investigate the Airbnb Platform and any laws, rules, regulations, or obligations that may be applicable to your Listings or Host Services.

6. Cancellations, Reservation Issues, and Booking Modifications.

6.1 Cancellations and Reservation Issues. In general, if a Guest cancels a Reservation, the amount paid to you is determined by the cancellation policy that applies to that Reservation. As a host, you should not cancel on a Guest without a valid reason under our Extenuating Circumstances Policy or applicable law. If you cancel on a Guest without such a valid reason, we may impose a cancellation fee and other consequences. If: (i) a Guest experiences a Reservation Issue (as defined by the Rebooking and Refund Policy), (ii) an Extenuating Circumstance arises, or (iii) a Reservation is cancelled under Section 12 of these Terms, the amount you are paid will be reduced by the amount we refund or otherwise provide to the Guest, and by any other reasonable costs we incur as a result of the cancellation. If a Guest receives a refund after you have already been paid, or the amount of the refund and other costs incurred by Airbnb exceeds your payout, Airbnb (via Airbnb Payments) may recover that amount from you, including by deducting the refund against your future payouts. You agree that Airbnb’s Rebooking and Refund Policy, Extenuating Circumstances Policy, and these Terms preempt the cancellation policy you set in situations where they allow for the cancellation of a Reservation and/or the issuance of refunds to Guests. If we reasonably expect to provide a refund to a Guest under one of these policies, we may delay release of any payout for that Reservation until a refund decision is made. If you host an Experience please note that the Experience Cancellation Policy, Experiences Guest Refund Policy and different cancellation fees and consequences apply to your Reservations. See each Policy for details about what is covered, and what your payout will be in each situation.

You may appeal a decision by Airbnb by contacting our customer service.

6.2 Booking Modifications. Hosts and Guests are responsible for any Booking Modifications they agree to make via the Airbnb Platform or direct Airbnb customer service to make on their behalf, and agree to pay any additional amounts, fees or taxes associated with a Booking Modification which are notified to them prior to choosing to proceed with the Booking Modification.

7. Taxes.

7.1 Host Taxes. As a Host, you are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit or include in your price any applicable GST or other indirect taxes, occupancy taxes, sales, tourist or other taxes ("Taxes").

7.2 Collection and Remittance by Airbnb. In jurisdictions where Airbnb facilitates the collection and/or remittance of Taxes on behalf of Hosts, you instruct and authorize Airbnb to collect Taxes on your behalf, and/or to remit such Taxes to the relevant Tax authority. Any Taxes that are collected and/or remitted by Airbnb are identified to Members on their transaction records, as applicable. Airbnb may seek additional amounts from Members (including by deducting such amounts from future payouts) where Taxes collected and/or remitted are insufficient to fully discharge that Members’ tax obligations, and you agree that your sole remedy for Taxes collected by Airbnb is a refund from the applicable Tax authority. You acknowledge and agree that we retain the right, with prior notice to affected Members, to cease the collection and remittance of Taxes in any jurisdiction for any reason.

7.3 Tax Information. In certain jurisdictions, Tax regulations may require that we collect and/or report Tax information about you, or withhold Taxes from payouts to you, or both. Where applicable, if you fail to provide us with documentation that we determine to be sufficient to support any such obligation to withhold Taxes from payouts to you, we may withhold payouts up to the amount as required by law, until sufficient documentation is provided. You agree that Airbnb may issue on your behalf invoices or similar documentation for GST or other Taxes for your Host Services to facilitate accurate tax reporting.

General Terms

8. Reviews.

After each Host Service, Guests and Hosts will have an opportunity to review each other. Your review must be accurate and may not contain any discriminatory, offensive, defamatory, or other language that violates these Terms, applicable law, or our Content Policy or Review Policy. Reviews are not verified by Airbnb for accuracy and may be incorrect or misleading.

9. Content.

Parts of the Airbnb Platform enable you to provide feedback, text, photos, audio, video, information and other content (“Content”). By providing Content, in whatever form and through whatever means, you grant Airbnb a non-exclusive, worldwide, royalty-free, perpetual, sub-licensable and transferable license, to access, use, store, copy, modify, prepare derivative works of, distribute, publish, transmit, stream, broadcast, and otherwise exploit in any manner such Content to provide and/or promote the Airbnb Platform, in any media or platform, known or unknown to date and in particular on Internet and social networks. If Content includes personal information, such Content will only be used for these purposes if such use complies with applicable data protection laws in accordance with our Privacy Policy. Where Airbnb pays for the creation of Content or facilitates its creation, Airbnb may own that Content, in which case supplemental terms or disclosures will say that. You are solely responsible for all Content that you provide and warrant that you either own it or are authorized to grant Airbnb the rights described in these Terms. You are responsible and liable if any of your Content violates or infringes the intellectual property or privacy rights of any third party. Content must comply with our Content Policy and Nondiscrimination Policy, which prohibit, among other things, discriminatory, obscene, harassing, deceptive, violent and illegal content. You agree that Airbnb may make available services or automated tools to translate Content and that your Content may be translated using such services or tools. Airbnb does not guarantee the accuracy or quality of translations and Members are responsible for confirming the accuracy of such translations.

10. Fees.

Airbnb may charge fees (and applicable Taxes) to Hosts and Guests for the right to use the Airbnb Platform. More information about when service fees apply and how they are calculated can be found on our Service Fees page. Any applicable fees are disclosed to Guests before making a booking. Except as otherwise provided on the Airbnb Platform and to the extent permitted by law, service fees are non-refundable. Airbnb reserves the right to change the service fees at any time, and will provide Members at least 30 days’ notice of any fee changes before they become effective. Fee changes will not affect bookings made prior to the effective date of the fee change. If you disagree with a fee change you may terminate this agreement at any time pursuant to Section 12.2.

11. Airbnb Platform Rules.

11.1 Rules. You must follow these rules and must not help or induce others to break or circumvent these rules.

  • Act with integrity and treat others with respect.
    • Do not lie, misrepresent something or someone, or pretend to be someone else.
    • Be polite and respectful when you communicate or interact with others.
    • Do not attempt to evade enforcement of these Terms, our Additional Legal Terms, Policies, or our Standards, such as by creating a duplicate account or listings.
    • Follow our Nondiscrimination Policy and do not discriminate against or harass others.
  • Do not scrape, hack, reverse engineer, compromise or impair the Airbnb Platform.
    • Do not use bots, crawlers, scrapers, or other automated means to access or collect data or other content from or otherwise interact with the Airbnb Platform.
    • Do not hack, avoid, remove, impair, or otherwise attempt to circumvent any security or technological measure used to protect the Airbnb Platform or Content.
    • Do not decipher, decompile, disassemble, or reverse engineer any of the software or hardware used to provide the Airbnb Platform.
    • Do not take any action that could damage or adversely affect the performance or proper functioning of the Airbnb Platform.
  • Only use the Airbnb Platform as authorized by these Terms or another agreement with us.
    • You may only use another Member’s personal information as necessary to facilitate a transaction using the Airbnb Platform as authorized by these Terms.
    • Do not use the Airbnb Platform, our messaging tools, or Members’ personal information to send commercial messages without their express consent.
    • You may use Content made available through the Airbnb Platform solely as necessary to enable your use of the Airbnb Platform as a Guest or Host.
    • Do not use Content unless you have permission from the Content owner or the use is authorized by us in these Terms or another agreement you have with us.
    • Do not request, make or accept a booking or any payment outside of the Airbnb Platform to avoid paying fees, taxes or for any other reason. See our Offline Fee Policy for exceptions.
    • Do not require or encourage Guests to open an account, leave a review, complete a survey, complete a survey, or otherwise interact, with a third party website, application or service before, during or after a Reservation, unless authorized by Airbnb.
    • Do not engage in any practices that are intended to manipulate our search algorithm.
    • Do not book Host Services unless you are actually using the Host Services.
    • Do not use, copy, display, mirror or frame the Airbnb Platform, any Content, any Airbnb branding, or any page layout or design without our consent.
  • Honor your legal obligations.
    • Understand and follow the laws that apply to you, including privacy, data protection, and export laws.
    • If you provide us with someone else’s personal information, you: (i) must do so in compliance with applicable law, (ii) must be authorized to do so, and (iii) authorize us to process that information under our Privacy Policy.
    • Read and follow our Terms, Additional Legal Terms, Policies and Standards.
    • Do not organize or facilitate unauthorized parties or events. You are responsible and liable for any party or event during your Reservation that violates our rules for parties and events, as incorporated by reference herein.
    • Do not use the name, logo, branding, or trademarks of Airbnb or others without permission, and only as set forth in our Trademark Guidelines.
    • Do not use or register any domain name, social media handle, trade name, trademark, branding, logo or other source identifier that is confusingly similar to any Airbnb trademarks, logos or branding. See our Trademark Guidelines for additional details.
    • Do not offer Host Services that violate the laws or agreements that apply to you. Do not offer or solicit prostitution or participate in or facilitate human trafficking.

11.2 Reporting Violations. If you believe that a Member, Listing or Content poses an imminent risk of harm to a person or property, you should immediately contact local authorities before contacting Airbnb. In addition, if you believe that a Member, Listing or Content has violated our Standards, you should report your concerns to Airbnb. If you reported an issue to local authorities, Airbnb may request a copy of that report. Except as required by law, we are not obligated to take action in response to any report.

11.3 Copyright Notifications. If you believe that Content on the Airbnb Platform infringes copyrights, please notify us in accordance with our Copyright Policy.

12. Termination, Suspension and other Measures.

12.1 Term. The agreement between you and Airbnb reflected by these Terms is effective when you access the Airbnb Platform (for example to create an account) and remains in effect until either you or we terminate the agreement in accordance with these Terms.

12.2 Termination. You may terminate this agreement for any reason and at any time by sending us an email or by deleting your account, or in the case of Experiences, by removing all of your Experiences from the Airbnb Platform. Airbnb may terminate this agreement, stop providing access to the Airbnb Platform, deactivate your account, remove your Listing(s), or any combination thereof, for any reason (including if your account has been inactive for more than two years) by providing you 30 days’ notice via email or using any other contact information you have provided for your account. Airbnb may also terminate this agreement, stop providing access to the Airbnb Platform, deactivate your account, remove your Listing(s), or any combination thereof, immediately and without prior notice if (i) you materially breach these Terms or our Additional Legal Terms, or Policies, (ii) you materially fail to comply with the standards and requirements for Experiences; (iii) you violate applicable laws, or (iv) such action is necessary to protect the personal safety or property of Airbnb, its Members, or third parties (for example in the case of fraudulent behavior of a Member).

Airbnb reserves the right to change our services, including to add or remove features and functionalities or change the types of Listings we accept or allow on the platform, including but not limited to: improve or update our services, prevent abuse, or respond to legal requirements. If we make material changes, we will provide you with 30 days’ advance notice, unless the changes are to prevent abuse or respond to legal requirements.

12.3 Member Violations. If (i) you breach these Terms, our Additional Legal Terms, Policies, or our Standards, (ii) you violate applicable laws, regulations, or third-party rights, (iii) you provide Content that is illegal or incompatible with these Terms, (iv) you have repeatedly received poor reviews or Airbnb otherwise becomes aware of or has received complaints about your performance or conduct, (vi) you have repeatedly canceled confirmed bookings or failed to respond to booking requests without a valid reason, or (vii) such action is reasonably necessary to protect the personal safety or property of Airbnb, its Members, or third parties, Airbnb may:

  • suspend or limit your access to or use of the Airbnb Platform and/or your account;
  • suspend, remove, disable access to, or restrict visibility of Listings, reviews, or other Content;
  • cancel pending or confirmed bookings; or
  • suspend or revoke any special status associated with your account.

In case of non-material breaches or where otherwise reasonable, you will be given reasonable notice of any actions that Airbnb proposes to take and an opportunity to remedy the non-material breach (if it is capable of remedy), unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other Members or third parties, or (iii) contravene applicable laws.

12.4 Legal Mandates. Airbnb may take any action it determines is reasonably necessary to comply with applicable law, or the order or request of a court, law enforcement or other administrative agency or governmental body, including the measures described above in Section 12.3.

12.5 Effect of Termination. If you are a Host and terminate your Airbnb account, any confirmed booking(s) will be automatically cancelled and your Guests will receive a full refund. If you terminate your account as a Guest, any confirmed booking(s) will be automatically cancelled and any refund will depend upon the terms of the Listing’s cancellation policy as specified on the Listing at the time of booking. When this agreement has been terminated, you are not entitled to a restoration of your account or any of your Content. If your access to or use of the Airbnb Platform has been limited, or your Airbnb account has been suspended, or this agreement has been terminated by us, you may not register a new account or access or use the Airbnb Platform through an account of another Member.

12.6 Survival. Sections 1, 2.1, 3, 4.2, 4.3, 5.2, 5.4, 5.5, 6.1, 7, 8, 9, 10, 11, 12.3, 12.4, 12.5, 12.7, 14, 15, 16, 17, 18, 19, 20, 21 and 22 survive expiry or termination, together with any other terms that, by reasonable implication or to give them efficacy are, or are intended, to be performed in whole or in part after the expiry or termination of this agreement.

12.7 Appeal. If Airbnb takes any of the measures described in this Section 12 you may appeal such a decision by contacting our customer service.

13. Modification of these Terms.

Airbnb may modify these Terms at any time. When we make material changes to these Terms, we will post the revised Terms on the Airbnb Platform and update the “Last Updated” date at the top of these Terms. We will also provide you with notice of any material changes by email, notifications through the Airbnb Platform, messaging service, or any other contact method made available by us and selected by you at least 30 days before the date they become effective. If you disagree with the revised Terms, you may terminate this agreement immediately as provided in these Terms. If you do not terminate your agreement before the date the revised Terms become effective, your continued access to or use of the Airbnb Platform will constitute acceptance of the revised Terms.

14. Resolving Complaints and Damage Claims.

14.1 If a Member provides valid evidence that you, your guest(s), or your pet(s) have culpably:

(i) damaged the complaining Member’s, or the Accommodation owner’s (where the Accommodation owner is not also the Host), real or personal property, or real or personal property the complaining Member is responsible for, or has an economic interest in;

(ii) caused loss of booking income for bookings via the Airbnb Platform or other consequential damages which result directly from the damage caused under (i) above; or

(iii) otherwise caused the complaining Member to incur cleaning costs in excess of the Member’s cleaning fee (each of (i), (ii), and (iii) being a "Damage Claim"),

the complaining Member can notify Airbnb and/or seek compensation through the Resolution Center. You will be notified of the Damage Claim and given an opportunity to respond. If you agree to pay, or if the Damage Claim is escalated to Airbnb and Airbnb reasonably determines that the Damage Claim is valid and you are responsible for the Damage Claim, Airbnb via Airbnb Payments can collect the amount of the Damage Claim from you.

14.2 If the Host and Guest cannot resolve, or a Guest fails to pay a Damage Claim, the Host may notify Airbnb through the Resolution Center under the terms of the Host Damage Protection Terms and seek compensation. Airbnb will review the Damage Claim and ask the Host to provide any required evidence (e.g. through appropriate documents, photos, invoices, or third- party experts) which substantiates the Damage Claim and the Damage Claim amount. The Guest will be given the opportunity to respond and provide any relevant counter evidence. If Airbnb reasonably determines, under (i) consideration of the evidence provided; (ii) the Host Damage Protection Terms; and (iii) applicable statutory rules on the burden of proof, that the Guest is responsible for the Damage Claim, Airbnb (via Airbnb Payments) will pay out the Damage Claim to the Host. If Airbnb pays out the Damage Claim to the Host, Airbnb may collect the amount of the Damage Claim from the Guest, including by charging the Guest’s Payment Method up to a maximum amount of $500 USD. Airbnb may also pursue claims for recovering Damage Claims amounts, including amounts exceeding the maximum amount applicable for charging the Guest’s Payment Method, against a Guest using any remedies it may have available under applicable law, including referral of the matter to a collections agency, and/or pursuit of available causes of action and/or claims against a Guest. Members may appeal a decision by Airbnb by contacting our customer service. As between Members and Airbnb, the burden of proof regarding the Damage Claim and the Damage Claim amount always lies with Airbnb.

14.3 You agree to cooperate in good faith, provide any information Airbnb requests, execute documents, and take further reasonable action, in connection with Damage Claims, Member complaints, claims under insurance policies, or other claims related to your provision or use of Host Services.

14.4 Any decisions made by Airbnb in relation to a Damage Claim will not affect your contractual or statutory rights.

      15. Airbnb’s Role.

      We offer you the right to use a platform that enables Members to publish, offer, search for, and book Host Services. When Members make or accept a booking, they are entering into a contract directly with each other. Airbnb is not and does not become a party to or other participant in any contractual relationship between Members. Airbnb is not acting as an agent for any Member except for where Airbnb Payments acts as a collection agent as provided in the Payments Terms. While we work hard to ensure our Members have great experiences using Airbnb, we do not and cannot control the conduct or performance of Guests and Hosts and do not guarantee (i) the existence, quality, safety, suitability, or legality of any Listings or Host Services or (ii) the truth or accuracy of any Listing descriptions, Reviews, or other Content provided by Members. You acknowledge that Airbnb has the right, but does not have any obligation to monitor the use of the Airbnb Platform and verify information provided by our Members. For example, we may review, disable access to, remove, or edit Content to: (i) operate, secure and improve the Airbnb Platform (including for fraud prevention, risk assessment, investigation and customer support purposes); ensure Members’ compliance with these Terms; (iii) comply with applicable law or the order or requirement of a court, law enforcement or other administrative agency or governmental body; (iv) address Member Content that we determine is harmful or objectionable; (v) take actions set out in these Terms; and (vi) maintain and enforce any quality or eligibility criteria, including by removing Listings that don’t meet quality and eligibility criteria. Where we remove or disable Content, we will notify a Member and provide the reasons for such a measure, unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other Members or third parties, or (iii) contravene applicable laws. You may appeal such a decision by contacting our customer service. Members agree to cooperate with and assist Airbnb in good faith, and to provide Airbnb with such information and take such actions as may be reasonably requested by Airbnb with respect to any investigation undertaken by Airbnb regarding the use or abuse of the Airbnb Platform.

      16. Member Accounts.

      You must register an account to access and use many features of the Airbnb Platform. Registration is only permitted for legal entities, partnerships and natural persons who are 18 years or older. You represent and warrant that you are not a person or entity barred from using the Airbnb Platform under the laws of the United States, your place of residence, or any other applicable jurisdiction. You must provide accurate, current, and complete information during registration and keep your account information up-to-date. You may not transfer your account to someone else. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You must immediately notify Airbnb if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised. You are responsible and liable for activities conducted through your Airbnb Account, unless such activities are not authorized by you and you are not otherwise negligent (such as failing to report the unauthorized use or loss of your credentials). If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.

      17. Warranties.

      We do not endorse or warrant the existence, conduct, performance, safety, quality, legality or suitability of any Guest, Host, Host Service, Listing or third party. To the maximum extent permitted by law, we do not warrant the performance or non-interruption of the Airbnb Platform and we do not warrant that verification, identity or background checks conducted on Listings or Members (if any) will identify past misconduct or prevent future misconduct. Any references to a Member or Listing being "verified" (or similar language) indicate only that the Member or Listing or Airbnb has completed a relevant verification or identification process and nothing else. We are not responsible for outages or disruptions of the Internet and telecommunications infrastructure which are beyond our control and can lead to interruptions in the availability of the Airbnb Platform. Airbnb may, temporarily and under consideration of the Members’ legitimate interests (e.g. by providing prior notice), restrict the availability of the Airbnb Platform or certain features thereof, if this is necessary in view of capacity limits, the security or integrity of our servers, or to carry out maintenance measures that ensure the proper or improved functioning of the Airbnb Platform.

      18. Limitations on Liability.

      To the maximum extent permitted by law, no party, including Airbnb’s affiliates and personnel, or any other party involved in creating, producing, or delivering the Airbnb Platform or any Content, will be liable for any incidental, special, exemplary or consequential damages. Incidental, special, exemplary or consequential damages include, to the maximum extent permitted by law, lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services. Neither is Airbnb liable nor any other party liable, to the extent permitted by law, for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Terms, (ii) the use of or inability to use the Airbnb Platform or any Content, (iii) any communications, interactions or meetings you may have with someone you interact or meet with through, or as a result of, your use of the Airbnb Platform, or (iv) the publishing or booking of a Listing, including the provision or use of Host Services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not Airbnb has been informed of the possibility of such damage, even if a limited remedy set out in these Terms is found to have failed of its essential purpose.

      Except for (i) Airbnb’s obligation to transmit payments to Hosts under these Terms, (ii) Airbnb’s obligation to make payments under the Airbnb Host Damage Protection, which contains its own limitations of liability, and (iii) Airbnb’s wilful breach of these Terms, to the maximum extent permitted by law, in no event shall Airbnb’s aggregate liability for any claim or dispute arising out of or in connection with these Terms, interaction with any Members, or use of or inability to use the Airbnb Platform, any Content, or any Host Service, exceed: (A) to Guests, three (3) times the amount you paid for the relevant Reservation(s) giving rise to the liability, or (B) to Hosts, three (3) times the amount paid to you for the relevant Reservation(s) giving rise to the liability.

      Except in the case of a Member’s wilful breach of these Terms, to the maximum extent permitted by law, in no event shall a Member’s liability to Airbnb or any other party involved in creating, producing, or delivering the Airbnb Platform or any Content for any claim or dispute arising out of or in connection with these Terms, interaction with any Member, or use of or inability to use the Airbnb Platform, any Content, or any Host Service exceed: (A) in the case of Guests, three (3) times the amount you paid for the relevant Reservation(s) giving rise to the liability, or (B) in the case of Hosts, three (3) times the amount paid to you for the relevant Reservation(s) giving rise to the liability.

      19. Indemnification.

      To the maximum extent permitted by applicable law, you agree to release, defend (at Airbnb’s option), indemnify, and hold Airbnb (including Airbnb Payments, other affiliates, and their personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of: (i) your breach of these Terms (including any supplemental or additional terms that apply to a product or feature) or our Additional Legal Terms, Policies or Standards, (ii) your improper use of the Airbnb Platform, (iii) your interaction with any Member, stay at an Accommodation, participation in an Experience or other Host Service, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use, (iv) your failure, or our failure at your direction, to accurately report, collect or remit Taxes, or (v) your breach of any laws, regulations or third party rights such as intellectual property or privacy rights. The indemnification obligation only applies if and to the extent that the claims, liabilities, damages, losses, and expenses have been adequately caused by your negligence or breach of a contractual obligation or, to the maximum extent permitted by law, the negligence and breach of a contractual obligation by those third parties for whose acts and omissions you are responsible under Sections 3.1 and 5.4 above.

      20. Contracting Entities.

      Based on your country of residence or establishment and what you are doing on the Airbnb Platform, Schedule 1 below sets out the Airbnb entity with whom you are contracting. If we identify through the Airbnb Platform, an Airbnb entity other than the one set out on Schedule 1 as being responsible for a product, feature or transaction, the Airbnb entity so identified is your contracting entity with respect to that product, feature or transaction. If you change your country of residence or establishment to a country outside of Australia, the Airbnb company you contract with and the applicable version of the Terms of Service will be determined by your new country of residence or establishment, from the date on which your country of residence or establishment changes.

      21. Applicable law and Jurisdiction.

      These Terms are governed by and construed in accordance with Irish law. If you are acting as a consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of Irish law. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. As a consumer, you may bring any judicial proceedings relating to these Terms before the competent court of your place of residence or the competent court of Airbnb's place of business in Ireland. If Airbnb wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the Irish courts.

      22. Miscellaneous

      22.1 Other Terms Incorporated by Reference. There are documents, policies and standards referred to in and linked from these Terms (including on our Additional Legal Terms page), which apply to your use of the Airbnb Platform, which are incorporated by reference to these Terms, and form part of the binding legal agreement between you and Airbnb.

      22.2 Interpreting these Terms. Except as they may be supplemented by additional terms, conditions, policies, guidelines, standards, and in-product disclosures, these Terms (including those items incorporated by reference) constitute the entire agreement between Airbnb and you pertaining to your access to or use of the Airbnb Platform and supersede any and all prior oral or written understandings or agreements between Airbnb and you. This Section does not exclude a party’s liability for prior false, misleading or deceptive statements or misrepresentations, where oral or written. These Terms do not and are not intended to confer any rights or remedies upon anyone other than you and Airbnb. If any provision of these Terms is held to be invalid or unenforceable, except as otherwise indicated in Section 23.12 below, such provision will be struck and will not affect the validity and enforceability of the remaining provisions.

      22.3 No Waiver. Subject to any limitation expressly stated in these Terms, or any document policy or standard incorporated into them, neither Airbnb’s or a Member’s failure to enforce any right or provision in these Terms will constitute a waiver of such right or provision unless acknowledged and agreed between the relevant parties in writing. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise permitted under law.

      22.4 Assignment. You may not assign, transfer or delegate this agreement or your rights and obligations hereunder without Airbnb's prior written consent (not to be unreasonably withheld or delayed). Airbnb may without restriction assign, transfer or delegate this agreement and any rights and obligations hereunder, at its sole discretion, with 30 days’ prior notice. Your right to terminate this agreement at any time pursuant to Section 12.2 remains unaffected.

      22.5 Notice. Unless specified otherwise, any notices or other communications to Members permitted or required under this agreement, will be provided electronically and given by Airbnb via email, Airbnb Platform notification, messaging service (including SMS and WeChat), or any other contact method we enable you to provide. If a notification relates to a booking or Listing in Japan, you agree and acknowledge that such notifications via electronic means in lieu of a written statement, satisfies Airbnb’s obligations under Article 59 (1) of the Japanese Housing Accommodation Business Act.

      22.6 Third-Party Services. The Airbnb Platform may contain links to third-party websites, applications, services or resources (“Third-Party Services”) that are subject to different terms and privacy practices. Airbnb is not responsible or liable for any aspect of such Third-Party Services and links to such Third-Party Services are not an endorsement.

      22.7 Google Terms. Some translations on the Airbnb Platform are powered by Google. Google disclaims all warranties related to the translations, express or implied, including any warranties of accuracy, reliability, and any implied warranties for merchantability, fitness for a particular purpose and non-infringement. Some areas of the Airbnb Platform implement Google Maps/Earth mapping services, including Google Maps API(s). Your use of Google Maps/Earth is subject to the Google Maps/Google Earth Additional Terms of Service.

      22.8 Apple Terms. If you access or download our application from the Apple App Store, you agree to Apple’s Licensed Application End User License Agreement.

      22.9 Airbnb Platform Content. Content made available through the Airbnb Platform, including without limitation trademarks, trade dress, inventions, algorithms, computer programs (in source code and object code), customer and marketing information and other content (“Platform Content”), whether registered or unregistered, may be protected by copyright, trademark, patent, trade secrets, know how, and/or other laws of the United States and other countries. You acknowledge that all intellectual property rights for that Platform Content are the exclusive property of Airbnb and/or its licensors and agree that you will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices. You may not use, copy, adapt, modify, prepare derivative works of, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit any Platform Content accessed through the Airbnb Platform except to the extent you are the legal owner of that Platform Content or as expressly permitted in these Terms. Subject to your compliance with these Terms, Airbnb grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to (i) download and use the Application on your personal device(s); and (ii) access and view the Platform Content made available on or through the Airbnb Platform and accessible to you, solely for your personal and non-commercial use.

      22.10 Airbnb.org. Airbnb.org is a nonprofit corporation exempt from income taxation under U.S. Internal Revenue Code Section 501(c)(3), operating as a public charity. Airbnb.org is not owned or controlled by Airbnb. Airbnb.org administers a number of charitable programs that benefit our Host and Guest communities and the public.

      22.11 Force Majeure. As between Airbnb and a Member, neither shall be liable to the other for any delay or failure to perform resulting from abnormal or unforeseeable circumstances outside their reasonable control, the consequences of which would have been unavoidable despite all efforts to the contrary, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials. For the avoidance of doubt, this Section does not: (i) apply to a Reservation, which is subject to the Host’s cancellation policy and the Extenuating Circumstances Policy; or (ii) operate to extend deadlines applicable to a Resolution Centre Request, a Host Damage Protection claim, an Aircover for guests claim, a Reservation Issue under the Rebooking and Refund Policy, or an Experiences Issue under the Experiences Guest Refund Policy, or other requests, claims or reporting under similar policies that are incorporated by reference into these Terms.

      22.12 Emails and SMS. You will receive administrative communications from us using the email address or other contact information you provide for your Airbnb account. Enrollment in additional email subscription programs will not affect the frequency of these administrative emails, though you should expect to receive additional emails specific to the program(s) to which you have subscribed. You may also receive promotional emails from us. No fee is charged for these promotional emails, but third-party data rates could apply. You can control whether you receive promotional emails using the notification preferences in your account settings. Please note that you will not be able to take advantage of certain promotions if you disable certain communication settings or do not have an Airbnb Account.

        23. United States Dispute Resolution and Arbitration Agreement.

        PLEASE READ THE FOLLOWING PARAGRAPHS CAREFULLY BECAUSE THEY PROVIDE THAT WHERE THIS ARBITRATION AGREEMENT APPLIES IN ACCORDANCE WITH SECTION 23.1, YOU AND AIRBNB AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION AND INCLUDE A CLASS ACTION WAIVER AND JURY TRIAL WAIVER. This Arbitration Agreement supersedes all prior versions.

        23.1 Application. This Arbitration Agreement only applies to you if your country of residence or establishment is the United States. If your country of residence or establishment is not the United States, and you nevertheless attempt to bring any legal claim against Airbnb in the United States, this Arbitration Agreement will apply for determination of the threshold issue of whether this Section 23 applies to you, and all other threshold determinations, including residency, arbitrability, venue, and applicable law.

        23.2 Overview of Dispute Resolution Process. Airbnb is committed to participating in a consumer-friendly dispute resolution process. To that end, these Terms provide for a two-part process for individuals to whom this Section 23 applies: (1) an informal negotiation directly with Airbnb’s customer service team (described in Section 23.3, below), and if necessary (2) a binding arbitration in accordance with the terms of this Arbitration Agreement. You and Airbnb each retain the right to seek resolution of the dispute in small claims court as an alternative to arbitration.

        23.3 Mandatory Pre-Arbitration Dispute Resolution and Notification. At least 30 days prior to initiating an arbitration, you and Airbnb each agree to send the other party an individualized notice of the dispute in writing (“Pre-Dispute Notice") and attempt in good faith to negotiate an informal resolution of the individual claim. You must send your Pre-Dispute Notice to Airbnb by mailing it to Airbnb’s agent for service: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833. Airbnb will send its Pre-Dispute Notice to the email address associated with your Airbnb account. A Pre-Dispute Notice must include: the date, your name, mailing address, your Airbnb username, the email address you used to set up your Airbnb account, your signature, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written demand for arbitration with the arbitration provider designated pursuant to Section 23.6, below. A claimant’s Pre-Dispute Notice requirement is a prerequisite to any arbitration, and a copy of the Pre-Dispute Notice and evidence that it was sent as required by this Section must be attached to any arbitration demand.

        23.4 Agreement to Arbitrate. You and Airbnb mutually agree that any dispute, claim or controversy arising out of or relating to these Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of the Airbnb Platform, Host Services, or any Content (collectively, “Disputes”) will be settled by binding arbitration on an individual basis (the “Arbitration Agreement”). If there is a dispute about whether this Arbitration Agreement can be enforced or applies to a Dispute, you and Airbnb agree that an arbitrator will decide that issue. For the avoidance of doubt, you and Airbnb agree that any question regarding arbitrability and the formation, enforceability, validity, scope, or interpretation of all or part of this Section 23, including any dispute over compliance with the Pre-Dispute Notice requirement and a party’s responsibility to pay arbitration fees, shall be resolved exclusively by an arbitrator.

          23.5 Exceptions to Arbitration Agreement. You and Airbnb each agree that the following causes of action and/or claims for relief are exceptions to the Arbitration Agreement and will be brought in a judicial proceeding in state or federal court in San Francisco, California, unless we both agree to some other location: (i) any claim or cause of action alleging actual or threatened infringement, misappropriation or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights; (ii) any claim or cause of action seeking emergency injunctive relief based on exigent circumstances (e.g. imminent danger or commission of a crime, hacking, cyber-attack); (iii) a request for the remedy of public injunctive relief; (iv) any claim or cause of action for vexatious litigation; or (v) any individual claim of sexual assault or sexual harassment arising from your use of the Airbnb Platform or Host Services. You and Airbnb agree that any request for the remedy of public injunctive relief will proceed after the arbitration of all arbitrable claims, remedies, or causes of action, and will be stayed pending the outcome of the arbitration pursuant to section 3 of the Federal Arbitration Act.

          23.6 Arbitration Rules and Governing Law. This Arbitration Agreement evidences a transaction in interstate commerce and the Federal Arbitration Act governs all substantive and procedural interpretation and enforcement of this Arbitration Agreement, and not state law. The arbitration will be administered by ADR Services, Inc. (“ADR”) (www.adrservices.com) in accordance with Rules 1, 6–7, 8–9, and 11–12, 45, 54, and 56 of the Federal Rules of Civil Procedure (“Selected Federal Rules") (https://www.uscourts.gov/rules-policies/current-rules-practice-procedure/federal-rules-civil-procedure) and ADR’s Arbitration Rules then in effect (the “ADR Rules”), except as the Selected Federal Rules or ADR Rules are modified by or conflict with this Arbitration Agreement. The ADR Rules are available at www.adrservices.com. If an arbitration demand is submitted to ADR Services in accordance with this agreement and the ADR Rules, and ADR Services cannot or will not administer the arbitration, the arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Selected Federal Rules and the AAA’s Consumer Arbitration Rules and/or other AAA arbitration rules determined to be applicable by the AAA (the “AAA Rules”) then in effect, except as modified here. The AAA Rules are available at www.adr.org. If the AAA cannot and will not administer the arbitration, you and Airbnb shall confer and select an alternative arbitral forum, and if we are unable to agree, either you or Airbnb may ask a court to appoint an arbitrator pursuant to 9 U.S.C. § 5. In that event, the arbitration will be conducted in accordance with the rules of the appointed arbitral forum, unless those rules are inconsistent with the provisions of this Arbitration Agreement.

          23.7 Modification of Arbitration Rules - Arbitration Hearing/Location. In order to make the arbitration most cost-effective, efficient, and convenient, any required arbitration hearing in an arbitration wherein the amount in controversy does not exceed $1,000,000 USD shall be conducted remotely via video conference except as otherwise agreed by the parties or instructed by the arbitrator. Any required arbitration hearing in an arbitration wherein the amount in controversy exceeds $1,000,000 USD shall be conducted in San Francisco County except as otherwise agreed by the parties or instructed by the arbitrator. If the amount in controversy is $10,000 USD or less, the parties agree to proceed solely on the submission of documents to the arbitrator.

          23.8 Modification of AAA Rules - Arbitration Fees and Costs. Your arbitration fees and your share of arbitrator compensation shall be governed by the ADR Rules and the ADR Services fee schedule (available at www.adrservices.com). If you have a gross monthly income of less than 300% of the federal poverty guidelines, you are entitled to a waiver of arbitration fees and costs, exclusive of arbitrator fees. You may request a fee waiver by providing the arbitration provider with a declaration under oath stating your monthly income and the number of persons in your household. If a fee waiver is granted by the arbitration provider and you provide Airbnb with documents necessary to prove that your gross monthly income is less than 300% of the federal poverty guidelines, Airbnb will pay your share of any arbitrator fees.

          23.9 Modification of Arbitration Rules - Claims Brought for an Improper Purpose or In Violation of This Arbitration Agreement. Either party may make a request that the arbitrator impose sanctions upon proving that the other party or its attorney(s) has asserted a claim or defense that is groundless in fact or law, brought in bad faith or for the purpose of harassment, or is otherwise frivolous. As allowed by applicable law, the arbitrator shall impose sanctions equal to the requesting party’s reasonable attorneys’ fees and costs upon finding that a claim or defense is groundless in fact or law, brought in bad faith or for the purpose of harassment, asserted in violation of Fed. R. Civ. P. 11(b) (treating the arbitrator as “the court”), or is otherwise frivolous. Either party may seek dismissal of any arbitration filed in violation of any provision of this Arbitration Agreement. Either party may assert in arbitration a counterclaim for the other party’s initiation of proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement. Upon finding that a party has initiated proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement, the arbitrator shall award the other party its actual damages, including but not limited to reasonable attorneys’ fees and costs.

          23.10 Arbitrator’s Decision. The arbitrator will issue a written decision which shall include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court with proper jurisdiction. The arbitrator may award any relief allowed by law or the ADR Rules, but declaratory or injunctive relief may be awarded only on an individual basis and only to the extent necessary to provide relief warranted by the claimant’s individual claim.

          23.11 Jury Trial Waiver. You and Airbnb acknowledge and agree that we are each waiving the right to a trial by jury as to all arbitrable Disputes.

          23.12 No Class Actions or Representative Proceedings. You and Airbnb acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate as a plaintiff or class member in any purported class action lawsuit, class-wide arbitration, private attorney general action, or any other representative or consolidated proceeding. Unless we agree in writing or as provided in this agreement, the arbitrator may not consolidate more than one party’s claims and may not otherwise preside over any form of any class or representative proceeding. If there is a final judicial determination that applicable law precludes enforcement of the waiver contained in this paragraph as to any claim, cause of action or requested remedy, then that claim, cause of action or requested remedy, and only that claim, cause of action or requested remedy, will be severed from this agreement to arbitrate and will be brought in a court of competent jurisdiction. In the event that a claim, cause of action or requested remedy is severed pursuant to this paragraph, then you and we agree that the claims, causes of action or requested remedies that are not subject to arbitration will be stayed until all arbitrable claims, causes of action and requested remedies are resolved by the arbitrator.

          23.13 Mass Action Waiver. You and Airbnb acknowledge and agree that the relative benefits and efficiencies of arbitration may be lost when 100 or more arbitration claims are filed within 180 days which (1) involve the same or similarly situated parties; (2) are based on the same or similar claims which arise from the same or substantially identical transactions, incidents, alleged violations or events requiring the determination of the same or substantially identical questions of law or fact; and (3) involve the same or coordinated counsel for the parties (“Mass Action”). Accordingly, you and Airbnb agree to waive the right to have any Dispute administered, arbitrated, or resolved as part of a Mass Action (though Sections 22 and 23.12 of these Terms will continue to apply to the Dispute). In case of a dispute, the appointed arbitrator for the first matter instituted within a set of claims identified by either party shall decide whether those claims are part of a Mass Action. If no arbitrator has yet been appointed, an arbitrator shall be appointed solely to determine whether claims identified by either party are part of a Mass Action. Nothing in this provision prevents you or Airbnb from participating in a mass settlement of claims.

          23.14 Modification of Arbitration Rules – Mass Action Batching Requirements. If for any reason, notwithstanding Section 23.13, an arbitration proceeds as part of a Mass Action, the parties shall group the arbitration demands into batches of no more than 200. The batches shall be determined by listing the claimants’ alphabetically (by last name or business name, as applicable)—for example, the first 200 claimants listed will be the first batch, the next 200 claimants listed will be the second batch, and so forth. The parties shall randomly assign each batch a sequential number and arbitrate the batches one at a time, in sequential order. While one batch is being arbitrated, the arbitration provider shall hold the remainder in abeyance unless otherwise agreed by the parties or instructed by the arbitration provider. Each batch shall be resolved within 240 days of the pre-hearing conference for that batch. Notwithstanding the forgoing, if any claimant’s demand has not been the subject of a pre-hearing conference within 2 years of the latest-filed demand in the Mass Action, such claimant may elect to pursue the claims asserted in the claimant’s demand in court subject to Sections 21 and 23.12 of these Terms.

          23.15 Modifications of Arbitration Rules - Offers of Judgment. At least ten (10) days before the date set for the arbitration hearing, you or Airbnb may serve a written offer of judgment on the other party to allow judgment on specified terms. If the offer is accepted, the offer with proof of acceptance shall be submitted to the arbitration provider, who shall issue an award accordingly. If the offer is not accepted prior to the arbitration hearing or within thirty (30) days after it is made, whichever occurs first, it shall be deemed withdrawn and cannot be given as evidence in the arbitration, other than with respect to costs (including all fees paid to the arbitration provider). If an offer made by one party is not accepted by the other party, and the other party fails to obtain a more favorable award, the other party shall not recover their post-offer costs and shall pay the offering party’s costs (including all fees paid to the arbitration provider) from the time of the offer.

          23.16 Severability. Except as provided in Section 23.12, in the event that any portion of this Arbitration Agreement is deemed illegal or unenforceable, such provision will be severed and the remainder of the Arbitration Agreement will be given full force and effect.

          23.17 Amendment to Agreement to Arbitrate. If Airbnb amends this Section 23 after the date you last accepted these Terms (or accepted any subsequent changes to these Terms), you may reject the change by sending us written notice no later than 30 days of the date the change is effective. Your notice must include your name, mailing address, the date of the notice, your Airbnb username, the email address you used to set up your Airbnb account, your signature, and an unequivocal statement that you want to opt out of the amended Section 23. You must either mail your notice to this address: 888 Brannan St, San Francisco, CA 94103, Attn: Arbitration Opt-Out, or email the opt-out notice to arbitration.opt.out@airbnb.com. Rejecting a new change, however, does not revoke or alter your prior consent to any earlier agreements to arbitrate any Dispute between you and Airbnb (or your prior consent to any subsequent changes thereto), which will remain in effect and enforceable as to any Dispute between you and Airbnb.

            23.18 Survival. Except as provided in Section 23.16, and subject to Section 12.6, this Section 23 will survive any termination of these Terms and will continue to apply even if you stop using the Airbnb Platform or terminate your Airbnb Account.

            Additional Terms for Experience Hosts

            Nothing in this Additional Terms for Experience Hosts section (“Experience Host Terms”) should be interpreted to amend or contradict the Terms unless explicitly stated. If there is a conflict between the Terms and the Experience Host Terms with respect to an Experience, the Experience Host Terms control.

            24. Experience Host Terms

            24.1 Listing an Experience. To list an Experience, you must create a Listing and submit the Experience to Airbnb. Experiences must at all times meet the standards and requirements for Experiences. When listing an Experience you must, where applicable, fully educate and inform Guests about (i) any risks inherent or incidental to the Experience, (ii) any requirements for participation, such as the minimum age, related skills, or level of fitness, and (iii) anything else they may need to know to safely participate in the Experience (including dress codes, equipment, special certifications or licenses, etc.). Airbnb reserves the right to decide, in its sole discretion, whether a submitted Experience will be published on or remains on the Airbnb Platform.

            24.2 Hosting Airbnb Guests. Once your Experience is published on the Airbnb Platform, you will have the ability to add dates and times when you offer your Experience through the Airbnb Platform (an "Instance"). By making an Instance of your Experience available on the Airbnb Platform, you agree that only people who book through Airbnb can attend that Instance of the Experience. You further agree that you will not allow people to attend any Instance of your Experience available on the Airbnb Platform unless that person booked through Airbnb (or was added as an additional Guest for a spot booked through the Airbnb Platform).

            24.3 Social Impact Experiences. If you wish to provide an Experience that benefits a social impact organization (a "Social Impact Experience"), you and the benefitting organization must comply with the Social Impact Experience eligibility requirements. When listing a Social Impact Experience you (i) represent and warrant that you are duly authorized to act on behalf of the benefitting organization and (ii) acknowledge and agree that all payouts will be directed to an account owned by the benefitting organization unless the benefitting organization has obtained authorization from Airbnb as outlined in the Social Impact Experience eligibility requirements. You and the benefitting organization acknowledge that listing a Social Impact Experience does not create a commercial fundraising or co-venturer, or charitable trust relationship with Airbnb, and Airbnb is not a professional fundraiser or commercial participator. If the benefitting organization is a nonprofit, the nonprofit, and not Airbnb, is responsible for determining what, if any, portion of its Total Price is a charitable contribution and for providing Guests charitable tax receipts for any applicable charitable contributions. You and the benefitting organization are solely responsible for complying with all laws that apply to the organization and your Social Impact Experience.

            24.4 Equipment. You are responsible for providing all equipment, including supplies, vehicles, venues and other materials ("Equipment") necessary to host your Experience. You are solely responsible for ensuring that the Equipment used in your Experience is in good working order and conforms to all laws pertaining to safety, equipment, inspection, and operational capability. Except as otherwise required by law, you assume all risk of damage or loss to your Equipment.

            24.5 Additional Experience Host Responsibilities. You are responsible for (i) understanding and complying with all laws, rules and regulations that may apply to your Experience, (ii) obtaining any required licenses, permits, or registrations prior to providing your Experience; and (iii) ensuring that your Listing and/or Hosting of an Experience will not breach any agreement you may have with any third party.             24.6 Hosting as a Team or Organization. You must provide your Experience in person and may not allow any third party to provide the Experience on your behalf, unless authorized by Airbnb. Any member of a team, business, or organization that interacts with Guests must be added to an Experience via the method designated by the Airbnb Platform. See Section 5.5 for information about hosting as part of a team, business or organization as well as the Listing Management Terms of Service, which are incorporated herein.

            24.7 Insurance. We may require that you obtain your own insurance in order to publish an Experience on the Airbnb Platform. We will provide you with reasonable notice of any changes to insurance requirements that apply to your Experience. In such cases, you agree to obtain and maintain insurance for you, the members of your team or organization, and/or your Experience with the coverage and in the amounts determined by us in our sole discretion for any and all activities that take place on your Experience. You agree to cooperate with Airbnb to verify such insurance coverage. In the event that Airbnb has obtained its own liability insurance that covers your Experiences, your insurance will be the primary source of coverage and Airbnb's insurance will operate as excess or secondary insurance for any amounts exceeding your coverage. Our procurement of such secondary insurance coverage does not relieve you of your obligation to obtain insurance in amounts required by us.
