유럽, 영국, 호주 외 지역 사용자에게 적용되는 결제 서비스 약관

회원님의 거주국이나 대표하는 기관의 사업장 소재지가 미국인 경우, 제15조의 중재 합의 및 집단소송 포기가 적용됩니다. 약관의 해당 조항을 주의 깊게 읽으시기 바랍니다.

영국, 유럽 및 호주 외 사용자에게 적용되는 본 결제 서비스 약관('결제 약관')은 에어비앤비 플랫폼을 통해서, 또는 그와 관련하여 수행되는 결제 서비스(아래에서 정의됨)를 규율하는 회원님과 에어비앤비 페이먼츠(Airbnb Payments) 사이의 구속력 있는 법적 계약입니다. 본 결제 약관에서 사용되는 '에어비앤비 페이먼츠' 또는 '당사'라는 용어는 회원님이 결제 서비스를 위해 계약을 체결하는 상대방인 에어비앤비 페이먼츠 회사를 지칭합니다.

에어비앤비 페이먼츠는 에어비앤비 플랫폼을 통해 제공되는 숙소, 체험 또는 기타 호스트 서비스(Open Homes 프로그램 관련 서비스 및 그 밖의 현재와 미래의 서비스 포함)를 게시, 제공 및 예약하는 회원에게 결제 서비스를 제공합니다. 이러한 결제 서비스는 호스트의 이익을 위해 제공되며, (이용 가능한 경우) 다음 사항이 포함될 수 있습니다(통칭하여 '결제 서비스').

  • 신용카드나 직불카드, 은행 계좌, 페이팔(PayPal) 계정, 디지털 지갑, 신용제공사의 할부 상품 등 에어비앤비 계정과 연결된 결제 수단('결제 수단')을 통해 게스트에게 청구된 결제액을 징수('입금')
  • 페이팔 계정이나 은행 계좌, 선불카드, 직불카드 등 에어비앤비 계정과 연결된 금융기관('지불 수단')을 통해 호스트에게 결제액 지급('지급')
  • 호스트가 지정한 제3자 지불 수단으로 결제액 지급
  • 자선 기부금의 수금 및 결제
  • 호스트 서비스와 관련된 기타 결제 관련 서비스

결제 서비스를 이용하려면 만 18세 이상이어야 하고, 에어비앤비 이용 약관('약관')에 따라 에어비앤비 계정을 적정하게 보유해야 하며, 결제 정보와 개인정보를 정확하고 완전하게 유지해야 합니다.

결제 서비스는 아래에 기술된 예외를 전제로, 회원의 거주국에 기반을 둔 계약 주체에 의해 제공됩니다.

인도에어비앤비 페이먼츠 인디아 사모 유한회사(Airbnb Payments India Pvt. Ltd., '에어비앤비 페이먼츠 인디아'). 단, 다음 경우는 예외입니다.
    • 인도 외부에서 호스트 서비스를 예약하는 경우
    • 인도 외부에 소재하는 리스팅을 등록하는 경우
위와 같은 경우에는 에어비앤비 페이먼츠 UK와 계약을 체결하게 됩니다. 이 표에 기재된 상반되는 규정에도 불구하고, 인도에 소재한 리스팅을 등록하는 경우, 다음 규정이 적용됩니다.
  • 호스트의 거주국을 불문하고, 인도 거주자인 게스트의 예약을 수락하는 경우, 호스트는 에어비앤비 페이먼츠 인디아와 계약을 체결하게 됩니다.
  • 호스트의 거주국을 불문하고, 인도 거주자가 아닌 게스트의 예약을 수락하는 경우, 호스트는 에어비앤비 페이먼츠 UK와 계약을 체결하게 됩니다.
브라질에어비앤비 플라타포르마 디지털 유한회사(Airbnb Plataforma Digital Ltda., '에어비앤비 브라질')
기타 국가에어비앤비 페이먼츠 UK

회원님이 거주 국가를 변경하는 경우, 계약을 체결하는 에어비앤비 주체 및 적용되는 결제 약관은 해당 변경일로부터 새로운 거주 국가에 따라 결정됩니다. 단, 거주 국가 변경 이전에 이루어진 모든 예약에 대해서는 원래 계약 주체인 에어비앤비 페이먼츠 회사가 동일하게 유지됨을 유의하시기 바랍니다.

에어비앤비 플랫폼 이용에는 이용 약관이 별도로 적용됩니다. 본 결제 약관에 대문자로 표기되었으나 별도의 정의가 없는 용어는 이용 약관에 명시된 것과 동일한 의미를 갖습니다.

1. 결제 서비스 이용

1.1 에어비앤비 결제 서비스. 결제 서비스를 이용하는 경우, 결제 약관 준수에 동의하는 것입니다. 에어비앤비 페이먼츠는 결제 서비스가 적정히 기능하도록 보장하는 유지보수 조치를 수행하기 위해 결제 서비스 또는 그 기능에 대한 접근 또는 이용을 일시적으로 제한하거나 중지할 수 있습니다. 에어비앤비 페이먼츠는 결제 서비스를 개선, 강화 및 수정하고 수시로 새로운 결제 서비스를 도입할 수 있습니다. 에어비앤비 페이먼츠는 해당 변경이 본 결제 약관에 따른 회원의 계약상 의무를 중대하게 증가시키거나 권리를 감소시키지 않는 한, 결제 서비스 변경 사실을 회원에게 통지합니다.

1.2 제3자 서비스. 결제 서비스에는 제3자 웹사이트 또는 리소스('제3자 서비스')에 대한 링크가 포함될 수 있습니다. 이러한 제3자 서비스에 대해서는 다른 서비스 약관 및 개인정보 처리방침이 적용되며, 회원은 이를 검토해야 합니다. 에어비앤비 페이먼츠는 이러한 제3자 서비스 이용에 대해 책임지지 않습니다. 제3자 서비스에 대한 링크는 에어비앤비 페이먼츠가 해당 제3자 서비스를 보증한다는 의미가 아닙니다.

1.3 에어비앤비 계정. 에어비앤비 페이먼츠는 회원님이 다른 회원이나 제3자가 회원님의 에어비앤비 계정에 영향을 미치는 특정 조치를 취하는 것을 허용하는 기능을 제공할 수 있습니다. 이러한 기능이 에어비앤비 계정에 활성화되는 경우, 회원님은 제3자가 본인의 에어비앤비 계정을 사용하도록 허락할 수 있습니다. 회원님은 본인의 에어비앤비 계정을 이용하도록 허용한 사람이 본인을 대신해 결제 서비스를 이용할 수 있으며, 허용받은 사람이 진행한 모든 결제에 대한 책임은 본인에게 있다는 것을 인정하고 이에 동의합니다.

1.4 신원 확인 및 인증. 회원님은 에어비앤비 페이먼츠가 회원님의 신원 또는 제공된 정보의 검증을 위해 필요하다고 판단하는 조회를 직접 또는 제3자를 통해서 수행하고, 해당하는 경우 대리인 및 수익적 소유자의 신원을 확인하는 것을 허락합니다. 여기에는 (i) 제3자 데이터베이스 또는 기타 출처를 통한 회원님 및 (해당하는 경우) 대리인과 수익적 소유자에 대한 신원 조회, (ii) 서비스 제공자에 대한 보고서 요청, (iii) 이름, 출생지 및 생년월일, 주소, 국적 및/또는 관련 법률에 따라 필요하다고 판단되는 기타 정보를 확인하기 위해 회원님 및 (해당하는 경우) 대리인과 수익적 소유자에게 정부 발급 신분증(예: 운전면허증 또는 여권) 제공 요청, 또는 (iv) 이메일 주소, 결제 수단 또는 지불 수단의 소유권을 확인하기 위한 조치의 이행 요구가 포함될 수 있습니다. 당사가 이러한 정보를 취득하거나 검증할 수 없는 경우, 에어비앤비 페이먼츠는 결제 서비스를 종료, 일시 중지하거나, 그에 대한 액세스를 제한할 수 있는 권리를 보유합니다.

1.5 추가 약관. 특정 결제 서비스의 액세스 또는 이용에 대해서는 추가 약관이 적용되거나, 추가 약관 수락이 필요할 수 있습니다. 본 결제 약관과 특정 결제 서비스에 적용되는 약관이 상충하는 경우, 달리 명시되지 않은 한, 해당 결제 서비스 이용 또는 액세스에 관해서는 후자의 약관이 우선합니다.

2. 게스트 약관

2.1 결제 수단 추가. 에어비앤비 계정에 결제 수단을 추가하는 경우, 에어비앤비 페이먼츠나 제3자 결제 처리자에게 성명, 청구지 주소, 금융 수단 정보 등의 대금 청구 정보를 제공하라는 요청을 받으시게 됩니다. 회원님은 에어비앤비 페이먼츠 및 결제 서비스 제공자의 결제 수단 정보 수집 및 저장을 허락합니다.

2.2 결제 수단 인증. 새로운 결제 수단을 추가하거나 사용하는 경우, 에어비앤비 페이먼츠는 (i) 결제 서비스 제공자를 통해 결제 수단에 한두 건의 소액 결제를 승인한 다음에 해당 금액을 확인하도록 요청하거나, (ii) 대금 청구서 업로드를 요청함으로써 결제 수단을 인증할 수 있습니다. 당사는 회원님의 결제 수단으로 해당 결제액을 환불할 수 있으며, 이에 대한 권리를 보유합니다. 결제 과정에서 결제 수단을 추가하는 경우, 당사는 해당 결제 수단이 향후 거래에 사용될 수 있도록 자동으로 회원님의 에어비앤비 계정에 저장 및 추가합니다. 예약일부터 체크아웃 날짜 후 14일이 경과한 시점까지의 기간 및 해당 예약과 관련된 미해결 손해배상 청구를 해결하는 데 필요한 추가 기간 동안 회원님은 예약과 연계된 결제 수단을 삭제할 수 없습니다. 은행 계좌를 결제 수단으로 추가하거나 사용하는 경우(미국에서 이용 가능), 회원님의 은행 계좌는 미화(USD)로 표시된 인출을 수락할 수 있어야 합니다.

2.3 결제 승인. 회원님은 에어비앤비 계정과 관련하여 납부해야 할 모든 수수료(관련 세금 포함)에 대해 에어비앤비 페이먼츠가 직접 또는 간접으로 결제 수단을 통해 청구(둘 이상의 결제 수단을 통한 청구도 포함)하도록 허용합니다. 여기에는 약관 및 본 결제 약관의 제6조에 따른 손해배상 청구 금액이 포함됩니다. 은행 계좌를 사용하여 결제하는 경우, 회원님은 에어비앤비 페이먼츠가 결제 시 표시된 결제 일정에 따라 본인의 은행 계좌에서 인출하는 것을 승인합니다. 또한, 회원님은 에어비앤비 페이먼츠가 잘못된 인출 건을 시정하거나, 필요에 따라 결제 건을 조정하거나, 환불금을 은행 계좌로 환급하기 위해 회원님의 은행 계좌에서 추가로 인출하거나 계좌에 입금하는 것을 승인합니다.

2.4 결제 수단 자동 갱신. 재발급 등으로 인하여 결제 수단의 계좌 정보(계좌 번호, 식별 번호, 만료일 등)가 변경되는 경우, 당사는 금융 서비스 제휴사나 회원님의 은행으로부터 해당 정보를 취득하여 보관 중인 기록상 결제 수단을 자동으로 갱신할 수 있습니다.

2.5 결제 시기. 에어비앤비 페이먼츠는 일반적으로 호스트가 회원님의 예약 요청을 수락한 후에 납부 의무가 있는 총 요금을 청구합니다. 단, 푸시 결제 수단(소포트(Sofort) 등)으로 결제하는 경우, 에어비앤비 페이먼츠는 회원님의 예약 요청 시점에, 또는 호스트가 예약 요청을 수락한 후에, 납부 의무가 있는 총 요금을 징수합니다. 에어비앤비는 결제 시점 및 방식에 대해 대체 결제 옵션을 제공할 수 있습니다. 이러한 대체 결제 옵션 이용에 대한 추가 수수료는 에어비앤비 플랫폼을 통해 표시되고 총 요금에 포함되며, 해당 결제 옵션을 선택하는 경우에는 이러한 수수료 납부에 동의하시는 것입니다. 대체 결제 옵션 이용에 대해서는 추가 약관이 적용될 수 있습니다. 일정대로 총 요금을 징수할 수 없는 경우, 에어비앤비 페이먼츠는 제5조3항에 따라 추후에 총 요금을 징수합니다. 요청한 예약에 대한 결제가 성공적으로 완료되면 회원님에게 확인 이메일이 전송됩니다.

2.6 통화

2.6.1 결제할 수 있는 통화는 선택한 결제 수단, 거주 국가 및/또는 에어비앤비 페이먼츠 계약 주체 등의 요인에 기초하여 규제상 또는 운영상 이유로 제한될 수 있습니다. 통화 선택에 제한이 있는 경우 에어비앤비 플랫폼을 통해 고지되며, 선호 통화 이용이 불가능한 경우 다른 통화 또는 결제 수단을 선택하라는 요청을 받으시게 됩니다.

2.6.2. 에어비앤비 페이먼츠 계약 주체의 소재지가 결제 수단 제공자의 소속 국가와 다르거나, 선택하신 통화가 결제 수단의 청구 통화와 다를 경우, 결제는 거주 국가가 아닌 곳에서 처리될 수 있습니다. 그 결과, 결제 수단 제공자가 일정 금액의 수수료를 부과할 수 있으며, 결제 수단 명세서에 기재된 금액이 결제 시 표시된 금액과 다를 수 있습니다. 예를 들어, 미국에서 발행된 카드를 사용하여 예약하였으나 유로화를 결제 통화로 선택한 경우, 해당 결제는 미국이 아닌 곳에서 처리될 수 있으며, 은행과 신용카드 회사에서 국제 거래 수수료와 환전 수수료를 부과할 수 있습니다. 또한, 결제 수단의 청구 통화와 다른 통화로 결제하기로 선택하는 경우, 은행 또는 신용카드 회사에서는 은행이 단독 재량으로 결정한 환율과 수수료에 기초해서 결제 금액을 결제 수단과 연계된 통화로 변환할 수 있습니다. 에어비앤비 페이먼츠는 이러한 수수료에 대해 책임지지 않으며 이와 관련된 모든 책임을 부인합니다. 결제 수단 제공자가 부과하는 이러한 수수료나 적용 환율과 관련해 궁금한 사항은 결제 수단 제공자에게 문의하시기 바랍니다.

2.7 예약 요청 상태. 호스트가 예약 요청을 수락하지 않아 예약 요청이 거절된 경우, 호스트가 예약 요청을 수락하기 전에 회원님이 예약 요청을 취소한 경우, 또는 에어비앤비에서 예약을 취소한 경우, 에어비앤비 페이먼츠가 징수하고 제5조5항에 명시된 정책에 따라 회원님에게 청구된 금액이 회원님에게 환불되며, (해당되는 경우) 회원님의 결제 수단에 취해진 가승인은 제5조5항2호에 따라 해제됩니다.

2.8 결제 제한. 에어비앤비 페이먼츠는 (i) 당사의 위험 관리 정책 또는 절차를 위반하거나, (ii) 본 결제 약관 또는 약관을 위반하거나, (iii) 승인되지 않거나, 기만적이거나, 불법적이거나, (iv) 회원님, 에어비앤비, 에어비앤비 페이먼츠 또는 타인을 당사가 용납할 수 없는 위험에 노출시킬 수 있다고 판단되는 결제를 거절하거나 제한할 수 있는 권리를 보유합니다.

2.9 결제 서비스 제공자. 결제 수단과 관련하여 제3자 결제 서비스 제공자가 사용될 수 있습니다. 이러한 결제 서비스 제공자는 결제 서비스와 관련된 결제를 처리할 때 회원님에게 추가 수수료를 청구할 수 있고, 에어비앤비 페이먼츠는 이러한 수수료에 대해 책임지지 않으며 이에 관한 모든 책임을 부인합니다. 결제 수단에 대해서 추가 이용 약관이 적용될 수도 있으니, 결제 수단을 사용하기 전에 해당 약관을 검토하시기 바랍니다.

2.10 결제 수단에 대한 책임. 회원님이 부정확한 결제 수단 정보를 제공하여 손실을 입을 경우, 에어비앤비 페이먼츠는 이에 대한 책임을 부담하지 않습니다.

2.11 다양한 결제 방법

2.11.1 요금 일부는 지금 결제, 나머지는 나중에 결제

2.11.1.1 에어비앤비는 예약 총 요금의 일부는 예약 시에 결제하고, 총 요금 중 잔여액은 나중에 체크인하기 전에 결제할 수 있는 옵션('요금 일부는 지금 결제, 나머지는 나중에 결제')을 게스트에게 제공할 수도 있습니다. 이 옵션의 이용 가능 여부는 리스팅 및/또는 결제 수단에 따라 달라질 수 있습니다.

2.11.1.2 '요금 일부는 지금 결제, 나머지는 나중에 결제'를 선택하면, 결제를 진행하는 동안 납부해야 하는 각 결제액의 금액, 통화 및 결제 일정을 에어비앤비 플랫폼에서 안내해 드립니다. 다음 결제일에 에어비앤비 페이먼츠는 예약 시 사용한 결제 수단으로 결제액을 자동 청구합니다.

2.11.1.3 '요금 일부는 지금 결제, 나머지는 나중에 결제'로 이루어진 예약을 변경하는 경우, 에어비앤비에서 해당되는 바에 따라 변경된 결제 일정을 안내해 드리며, 에어비앤비 페이먼츠에서 변경된 결제 기한에 예약 시 사용한 결제 수단으로 결제액을 자동 청구합니다. 예약 변경으로 인해 총 요금이 증가하는 경우, 변경 시점에 새로운 총 요금 중 일부 금액을 추가로 결제해야 할 수도 있습니다.

2.11.1.4 '요금 일부는 지금 결제, 나머지는 나중에 결제'를 선택하는 경우, 예약에 대해서 다른 결제 수단으로 결제하거나 다른 결제 일정에 따라 결제할 수 없을 수도 있다는 점에 동의하는 것입니다.

2.11.1.5 에어비앤비 페이먼츠가 결제금을 징수할 수 없는 경우, 회원님에게 해당 결제가 거절되었음을 통지하고, 통지 후 72시간 이내에 대체 결제 수단을 사용해서 결제를 완료하라고 요청합니다. 회원님이 결제를 완료하지 못할 경우, 에어비앤비가 회원님을 대신하여 예약을 취소할 수 있는 권한이 부여됩니다. 예약이 취소되면 호스트의 환불 정책에 따라 환불됩니다.

2.11.2 반복 결제

2.11.2.1 특정 예약의 경우(28박 이상의 숙소 예약 등), 에어비앤비 페이먼츠는 납부해야 할 총 요금에 도달할 때까지 반복적으로 이뤄지는 결제(‘반복 결제’)를 요구할 수 있습니다. 반복 결제가 예약에 적용 가능한 경우, 이에 관한 자세한 정보(결제 금액과 빈도 포함)는 에어비앤비 플랫폼을 통해 제공됩니다.

2.11.2.2 반복 결제가 확정된 예약에 적용되는 경우, 게스트는 납부해야 할 총 요금을 에어비앤비 페이먼츠가 징수하도록 허용하는 것입니다.

2.11.2.3 게스트는 예정된 결제일보다 최소 영업일 기준 3일 전까지 구두 또는 서면으로 에어비앤비 페이먼츠에 통지하여 반복 결제를 중단할 수 있습니다. 에어비앤비 페이먼츠는 구두 통지일로부터 14일 이내에 결제 중단 확인서를 제출하도록 게스트에게 요청할 수 있습니다. 상기 14일 이내에 확인서를 제출하지 않는 경우, 에어비앤비 페이먼츠는 향후 반복 결제 중단 요청에 따라야 할 의무가 없습니다. 반복 결제에 관해 문의 사항이 있는 경우, 에어비앤비 페이먼츠에 연락하시기 바랍니다.

2.12 지금 구매, 나중에 결제

게스트는 때로 신용이나 기타 할부 결제 옵션을 통해 숙소 예약 요금을 결제하는 방법을 제공받아 일정 기간에 걸쳐 해당 요금을 결제할 수 있습니다('지금 구매, 나중에 결제'). 이러한 결제 수단은 에어비앤비가 아닌 클라르나 은행(Klarna Bank AB) 또는 그 계열사에서 제공하며, 결제 시 안내되는 추가 이용 약관이 적용되고, 클라르나가 결제에 대한 채권자가 됩니다. 결제 수단에 따라, 이로 인해 차용자인 회원님과 대출기관인 클라르나 사이에 별도의 관계가 형성됩니다. 이러한 결제 수단을 사용하기 전에 적용 가능한 추가 약관을 모두 검토하시기 바랍니다.

3. 호스트 약관

3.1 결제 징수. 에어비앤비 페이먼츠는 달리 명시되지 않은 한, 일반적으로 게스트의 예약 요청을 호스트가 수락하는 시점에 예약에 대한 총 요금을 징수합니다.

3.2 유효한 지불 수단. 지불액을 수령하려면, 에어비앤비 계정에 유효한 지불 수단이 등록되어 있어야 합니다. 에어비앤비 계정에 지불 수단을 추가하는 경우, 에어비앤비 페이먼츠나 제3자 결제 처리자에게 성명, 정부 발급 신분증, 납세자 번호, 청구지 주소 및 금융 수단 정보 등의 정보를 제공하라는 요청을 받으시게 됩니다. 선택된 지불 수단에 따라서는, 거주지 주소, 계좌주 성명, 계좌 유형, 식별 번호, 계좌 번호, 이메일 주소, 지불 통화, 신분증 번호 및 특정 결제 처리자와 연결된 계정 정보 등의 추가 정보가 필요할 수 있습니다. 요청된 정보를 제공한 경우에만 지불 수단이 유효합니다. 유효한 지불 수단에 대해 에어비앤비 페이먼츠가 요구하는 정보는 변경될 수 있으며, 에어비앤비 페이먼츠는 언제든지 추가 정보를 요구할 수 있습니다. 요청된 정보를 제공하지 않거나 못할 경우, 해당 정보가 제공되고 필요한 경우 확인될 때까지 에어비앤비 페이먼츠가 일시적으로 지급을 보류, 일시 중지 또는 취소할 수 있습니다. 회원님은 에어비앤비 페이먼츠가 에어비앤비 개인정보 처리방침에 따라 지불 수단 정보를 수집하고 저장하는 것을 허락합니다. 에어비앤비 페이먼츠는 관련 법규에서 요구되는 바에 따라 정부 당국과 회원 정보를 공유할 수도 있습니다.

3.3 지불 시기

3.3.1 게스트로부터 결제액을 성공적으로 수령하는 것을 전제와 조건으로 하여, 에어비앤비 페이먼츠는 일반적으로 다음 시점에 선택하신 지불 수단으로 지불을 실행합니다. (i) 숙소에 대하여는 게스트의 예정 체크인 시간(체크인 시간이 가변적이거나 명시되지 않은 경우, 현지 시간으로 오후 3시 또는 현지 시간을 알 수 없는 경우에는 UTC 기준 오후 3시)으로부터 24시간 이내에, (ii) 체험에 대하여는 체험 시작 후 24시간 이내에, 그리고 (iii) 기타 모든 호스트 서비스에 대하여는 에어비앤비 플랫폼을 통해 명시되는 시점. 28박 이상의 숙소 예약의 경우, 일반적으로 게스트의 예정된 체크인 시간으로부터 24시간 후에 첫 번째 지불을 실행하며, 예약 기간 동안 최초 지불 후 30일마다 향후 지불을 실행합니다.

3.3.2 에어비앤비 페이먼츠는 결제액에 대해 다른 지불 시점이나 지불 유발 요인을 제공할 수 있으며, 이에 대해서는 추가 약관이 적용될 수 있습니다. 에어비앤비 페이먼츠가 지급한 지불액을 받는 데 소요되는 시간은 지불 수단에 따라 다를 수 있습니다.

3.4 지불. 예약에 대해 회원님에게 지급되는 지불액은 총 요금에서 에어비앤비 서비스 수수료 등의 관련 수수료와 세금, 회원님이 공동 호스트, 숙소 소유주, 주택 소유주 협회 및/또는 그 대리인(예: 건물 운영자 또는 부동산 관리 회사)에게 할당하는 데 동의한 금액을 차감한 금액입니다. 확정된 예약이 취소되는 경우, 에어비앤비 페이먼츠는 약관 및 해당 환불 정책에 규정된 바에 따라 회원님이 지급해야 하는 금액(있는 경우)을 송금합니다.

3.5 지불 제한. 에어비앤비 페이먼츠는 불법 행위나 부정행위의 방지, 위험 평가, 보안 또는 조사 완료를 목적으로, 또는 회원님의 신원을 확인할 수 없는 경우, 또는 요청된 정보를 얻거나 검증할 수 없는 경우, 지불을 일시적으로 보류, 일시 중지 또는 취소할 수 있습니다. 더 나아가, 에어비앤비 페이먼츠는 불가항력 사유(아래에서 정의됨)로 발생하는 대규모 예약 취소 또는 변경이 있을 경우 약관에 따라 회원님에게 지급해야 하는 지불의 개시나 처리를 일시적으로 보류, 일시 중지 또는 지연시킬 수 있습니다.

3.6 지급 통화. 에어비앤비 페이먼츠는 회원님이 에어비앤비 플랫폼을 통해 선택한 통화로 지불액을 송금합니다. 이용할 수 있는 통화는 선택한 지불 수단, 거주 국가 및/또는 에어비앤비 계약 주체 등의 요인에 기초하여 규제상 또는 운영상 이유로 제한될 수 있습니다. 이용 가능한 통화에 제한이 있는 경우 에어비앤비 플랫폼을 통해 고지되며, 다른 통화 또는 지불 수단을 선택하라는 요청을 받으시게 됩니다. 결제 서비스 제공자는 선택된 통화 또는 지불 수단에 기초해서 거래 수수료, 환전 수수료 또는 기타 수수료를 부과할 수 있고, 에어비앤비 페이먼츠는 이러한 수수료에 대해 책임지지 않으며 이에 관한 모든 책임을 부인합니다.

3.7 지불 한도. 에어비앤비 페이먼츠는 규정 준수 또는 운영상의 이유로 지불 금액을 제한할 수 있습니다. 회원님에게 해당 한도를 초과하는 금액이 지급되어야 하는 경우, 에어비앤비 페이먼츠는 지불액 전액을 지급하기 위해서 여러 회에 걸쳐 지불을 실행할 수 있습니다(수일에 걸쳐 진행될 가능성도 있음).

3.8 결제 서비스 제공자. 지불 수단과 관련하여 제3자 결제 서비스 제공자가 사용될 수 있습니다. 이러한 결제 서비스 제공자는 결제 서비스와 관련된 지불을 처리할 때 회원님에게 추가 수수료를 청구(지불액에서 수수료 차감 포함)할 수 있고, 에어비앤비 페이먼츠는 이러한 수수료에 대해 책임지지 않으며 이에 관한 모든 책임을 부인합니다. 회원님의 지불 수단에 해당 제3자 결제 서비스 제공자의 추가 이용 약관이 적용될 수도 있습니다. 지불 수단을 사용하기 전에 해당 약관을 검토하시기 바랍니다.

3.9 자금 취급. 에어비앤비 페이먼츠는 게스트로부터 징수한 금액을 통합하여 관련 법률에서 허용되는 바에 따라 해당 자금을 투자할 수 있습니다. 에어비앤비 페이먼츠는 해당 투자에서 발생한 이자를 보유합니다.

3.10 지불 수단에 대한 책임. 회원님이 부정확한 지불 수단 정보를 제공하여 손실을 입을 경우, 에어비앤비 페이먼츠는 이에 대한 책임을 부담하지 않습니다.

3.11 다양한 대금 수령 방법

3.11.1 분할 지급

팀, 기업 또는 기타 조직의 일원으로 한 명 이상의 다른 호스트와 공동으로 호스트 서비스를 제공하는 호스트의 경우('호스트 팀'), 에어비앤비는 호스트 팀 구성원 간에 예약에 대한 총 호스트 지불액을 나눌 수 있는 옵션을 제공할 수 있습니다. 에어비앤비 페이먼츠는 호스트 팀의 구성원 한 명 이상의 지시에 따라 이러한 지급을 실행하며, 이러한 지급 지시 과정에서 호스트에 의해 이루어진 오류 또는 누락과 관련된 손실에 대해 책임지지 않습니다.

3.11.2 에어비앤비 페이먼츠 US와 계약을 체결한 호스트를 위한 가상 신용카드

3.11.2.1 일부 호스트는 가상 신용카드('VCC')를 통해 대금을 수령할 자격이 있을 수도 있습니다. VCC를 통해 호스트에게 대금이 지급되는 경우, 에어비앤비 페이먼츠에서 각 예약의 VCC 번호와 승인된 금액을 알려드립니다. 게스트의 예정 체크인 시간(체크인 시간이 가변적이거나 명시되지 않은 경우, 현지 시간으로 오후 3시 또는 현지 시간을 알 수 없는 경우에는 UTC 기준 오후 3시) 24시간 전에 VCC에 요금을 청구할 수 있으며, 게스트의 예정 체크인 시간으로부터 180일이 지나면 VCC가 만료됩니다.

3.11.2.2 에어비앤비 페이먼츠가 회원님에게 예약 대금을 지급하기 위한 전제 조건으로, 회원님은 예약 체크인 1일 전부터 체크인 후 180일 안에 VCC에 요금을 청구하는 데 동의하며, VCC에 청구하지 않을 경우 이는 에어비앤비 페이먼츠가 회원님에게 지불해야 할 금액이 없다는 것을 확인하는 것입니다(예: 게스트 취소 또는 기타 조정으로 인해). 또한 에어비앤비 페이먼츠는 게스트가 에어비앤비 페이먼츠에 지불한 금액을 에어비앤비 페이먼츠의 서비스 제공 비용에 대한 추가 고려 사항으로서 보유할 수 있습니다. 회원님은 에어비앤비 페이먼츠가 예약 중 발생한 사건(예: 게스트의 실제 도착 또는 출발 날짜, 취소 또는 예약과 관련해 회원님과 게스트 간에 협상된 기타 조정)에 대해 일반적으로 알지 못하며, 이에 따라 회원님이 VCC에 청구하는 금액이 정확하며 지급액을 결정하는 것임을 에어비앤비 페이먼츠가 신뢰하고 이를 수락할 권리가 있다는 점을 인정하고 이에 동의합니다.

3.11.2.3 회원님이 VCC를 부적절하게 사용하거나 과도한 금액을 청구하거나, 회원님이 VCC에 금액을 청구한 후 게스트가 예약을 취소하거나 관련 환불 정책에 따라 환불을 받아야 하는 경우, 에어비앤비 페이먼츠의 요청 시 회원님은 VCC에 환불하는 데 동의합니다. 회원님은 에어비앤비 페이먼츠가 본 결제 약관에 따라 허용된 기타 수단을 이용하거나 회원님에게 지불 거절을 개시함으로써 에어비앤비 페이먼츠에 지급되어야 하는 금액을 회수할 권리가 있음을 인정합니다.

3.11.2.4 게스트가 숙소에 머무는 동안 요청한 부수적인 사항이나 업그레이드에 대해 게스트로부터 직접 결제액을 징수할 책임은 전적으로 회원님에게 있습니다. 에어비앤비 페이먼츠가 총 요금의 일부를 환불하게 될 수 있는 게스트 요청의 경우, 회원님은 에어비앤비 페이먼츠가 이러한 요청을 수락할 수 있는지 먼저 확인하지 않은 상태에서 게스트 요청을 들어주지 않기로 동의합니다.

3.11.2.5 에어비앤비 페이먼츠는 게스트 예약과 관련하여 VCC에 청구된 날로부터 1년 이내에 VCC 청구에 대한 감사를 실시하고 청구 금액을 뒷받침하는 증빙 서류를 회원님에게 요청할 권리를 보유합니다. 에어비앤비 페이먼츠가 해당 기간 내에 이 권리를 행사하지 않는 경우, VCC 청구가 정확한 것으로 간주됩니다. 회원님이 VCC 청구를 뒷받침할 수 있는 충분한 서류를 제공할 수 없는 경우, 에어비앤비 페이먼츠는 회원님에게 지불 거절을 개시하거나 본 결제 약관에 따라 허용된 기타 수단으로 해당 금액을 회수할 권리가 있습니다.

3.12 지금 구매, 나중에 결제

독일에 거주하는 게스트가 클라르나 '지금 구매, 나중에 결제' 옵션을 통해 숙소 예약 요금을 결제하는 경우(3회 할부 결제 옵션 제외), 본 추가 호스트 약관이 적용됩니다.

4. 에어비앤비 페이먼츠를 제한적 결제 징수 대리인으로 임명

4.1 호스트 팀의 개별 구성원을 포함한 각 호스트는 호스트 서비스를 구매하는 게스트의 자금을 대리 수령하고 처리하기 위한 제한적 목적으로 에어비앤비 페이먼츠를 호스트의 결제 징수 대리인으로 임명합니다.

4.2 호스트 팀의 개별 구성원을 포함한 각 호스트는 에어비앤비 페이먼츠를 통한 게스트의 결제가 호스트에게 직접 결제한 것과 동일한 것으로 인정되며, 게스트로부터 직접 결제를 받은 경우와 동일하게 합의된 방식으로 게스트가 예약한 호스트 서비스를 제공할 것이라는 점에 동의합니다. 각 호스트는 에어비앤비 페이먼츠가 약관에 따라 게스트에게 환불할 수 있음에 동의합니다. 각 호스트는 호스트에 대한 에어비앤비 페이먼츠의 지불 의무가 이와 연관된 결제액을 게스트로부터 성공적으로 수령하는 것을 전제 조건으로 한다는 점을 이해합니다. 에어비앤비 페이먼츠는 본 결제 약관에 따라 게스트로부터 성공적으로 수령한 금액에 대해서만 호스트에게 결제를 보증합니다. 호스트의 제한적 결제 징수 대리인 역할을 수락함에 있어, 에어비앤비 페이먼츠는 호스트의 작위 또는 부작위에 대해 어떠한 책임도 부담하지 않습니다.

4.3 각 게스트는 에어비앤비 페이먼츠가 게스트와 호스트(호스트 팀의 개별 구성원 포함) 사이에 체결되는 계약의 당사자가 아님에도 불구하고, 게스트의 결제액을 대리 수령하기 위한 제한적 목적으로 호스트의 결제 징수 대리인 역할을 한다는 점을 인정하고 이에 동의합니다. 게스트가 에어비앤비 페이먼츠에 자금을 결제하는 경우, 합의된 금액에 대해 게스트가 호스트에게 결제할 의무는 소멸되며, 에어비앤비 페이먼츠는 본 결제 약관에 기술된 방식으로 에어비앤비 페이먼츠가 성공적으로 수령한 자금을 호스트에게 송금할 책임이 있습니다. 에어비앤비 페이먼츠가 결제 서비스 제공을 완료하지 않고 해당 금액을 송금하지 않는 경우, 호스트는 에어비앤비 페이먼츠만을 상대로 소구권을 행사하며, 결제 서비스 제공 실패에 대해 게스트를 상대로 직접 소구권을 행사하지는 못합니다.

5. 일반 약관

5.1 수수료. 에어비앤비 페이먼츠는 특정 결제 서비스 이용에 대하여 수수료를 청구할 수 있으며, 모든 관련 수수료는 약관 또는 에어비앤비 플랫폼을 통해 고지됩니다.

5.2 결제 허락. 회원님은 본 결제 약관 및/또는 약관에 따라 납부해야 하는 금액을 에어비앤비 페이먼츠가 다음 방법 중 하나로 징수하는 것을 허락합니다. (i) 관련 예약과 연계된 결제 수단이나 에어비앤비 계정에서 사용하도록 허락한 기타 결제 수단(이러한 결제 수단을 통한 청구나 인출에 대한 허락을 사전에 철회하지 않은 경우에 한함)을 통해 청구 또는 인출하거나, (ii) 향후 회원님에게 지급될 금액에서 해당 금액을 원천징수. 회원님은 구체적으로 다음 항목의 징수 권한을 에어비앤비 페이먼츠에 허락합니다.

  • 회원님을 대신하여 에어비앤비 또는 에어비앤비 페이먼츠가 선지급한 비용에 대한 상환액을 포함하여, 에어비앤비 또는 에어비앤비 페이먼츠에 지급되어야 하는 금액(예: 회원님의 예약, 예약 변경, 취소에 기인하거나 게스트, 호스트 또는 에어비앤비 플랫폼 이용자로서 행한 기타 행위에 기인하는 금액). 에어비앤비 페이먼츠가 징수한 금액은 회원님이 에어비앤비 또는 에어비앤비 페이먼츠에 지급해야 하는 금액을 차감하고, 이로써 해당 채무는 소멸됩니다.
  • 게스트가 호스트에게 지급해야 하는 것으로, 상기 제4조에 규정된 바와 같이 에어비앤비가 호스트의 결제 징수 대리인 자격으로 징수하는 금액
  • 약관에 명시된 관련 세금
  • 회원님이 에어비앤비 계정과 관련하여 해결 센터를 통하여 지급하는 금액
  • 약관 및 제6조에 따라 에어비앤비 또는 에어비앤비 페이먼츠에 지급해야 하는 손해배상 청구액
  • 약관에 따라 부과되는 초과 숙박 페널티 및 이를 징수하는 과정에서 발생하는 모든 비용 및 경비
  • 약관에 따라 부과되는 서비스 수수료 또는 취소 수수료(예: 회원님이 호스트로서 확정된 예약을 취소하는 경우)
  • 게스트가 확정된 예약을 취소하거나 에어비앤비가 약관, 재예약 및 환불 정책, 체험 게스트 환불 정책, 정상참작이 가능한 상황 정책, Luxe 재예약 및 환불 정책, 또는 기타 관련 환불 정책에 따라 예약 취소가 필요하다고 결정했음에도 불구하고, 호스트인 회원님에게 이미 지급된 금액. 회원님은 이미 대금을 지급받은 경우, 에어비앤비 페이먼츠가 향후 지불액에서 해당 환불 금액을 차감하는 등의 방식으로, 게스트에게 환불한 금액을 회원님으로부터 회수할 수 있음에 동의합니다.

예약 후 언제든지 분할 결제 또는 반복 결제 금액, 예약 변경, 해결 센터 결제 또는 손해배상 청구액과 같은 금액('추가 금액')을 납부해야 하는 경우, 회원님은 에어비앤비 페이먼츠가 회원님의 별도 조치 없이도 해당 예약과 연결된 결제 수단을 통해 해당 추가 금액에 대한 결제를 징수하는 것을 허락합니다. 에어비앤비 페이먼츠는 추가 금액이 청구되기 전에 회원님에게 서면으로 통지합니다.

해당하는 예약과 연결된 회원님의 결제 수단이 만료되었거나, 유효하지 않거나, 기타 어떠한 이유로든 결제를 청구할 수 없는 경우(예: 잔고 부족), 회원님은 징수되지 않은 금액에 대한 책임을 집니다. 회원님은 에어비앤비 페이먼츠가 회원님의 예약과 관련된 결제 수단으로 다시 청구 또는 인출하거나, 회원님의 에어비앤비 계정과 연결된 다른 결제 수단이 있는 경우 이를 사용하여 이러한 추가 금액을 징수하는 것을 승인합니다. 결제 실패 시마다 은행에서 초과 인출 또는 기타 수수료를 청구할 수 있습니다. 어떤 이유로든 미납된 금액은 추심기관에 의뢰하거나 회원님에 대해 가용한 소송 또는 청구의 제기를 포함하나 이에 한정되지 않는 구제 수단의 대상이 될 수 있습니다.

에어비앤비로 하여금 회원님이 호스트로서 초과 결제 사기, 예약 사기 또는 그 밖의 부정행위에 가담했다고 판단할 만한 사유가 있고, 에어비앤비 페이먼츠가 해당 숙박에 대한 대금을 지급한 경우, 에어비앤비 페이먼츠는 향후 회원님에게 지급해야 하는 대금에서 해당 금액을 경감, 차감 또는 인출함으로써 해당 금액을 회수할 수 있습니다.

상기 금액 외에 결제 수단과 연관된 연체액 또는 지불거절액이 존재하는 경우, 에어비앤비 페이먼츠가 해당 연체액 또는 지불거절액을 징수하며 이에 수반되는 수수료가 회원님에게 청구될 수 있습니다. 이러한 수수료에는 징수 수수료, 대행 수수료 또는 기타 제3자 수수료가 포함될 수 있습니다.

5.3 징수

5.3.1 에어비앤비 페이먼츠가 약관 및 본 결제 약관에 따라 회원님이 지급해야 할 금액을 징수할 수 없는 경우, 에어비앤비 페이먼츠는 해당 금액을 회수하기 위한 노력을 기울일 수 있습니다.

5.3.2. 에어비앤비 페이먼츠는 다음 시점에 징수 금액의 연체가 발생한 것으로 간주합니다. (a) 승인된 청구액의 경우, 회원님의 결제 수단에 최초로 청구 또는 인출을 시도한 날과 관련 서비스가 제공된 날 중 더 늦은 날로부터 120일이 경과된 시점, (b) 호스트의 향후 지불액에서 원천징수하는 경우, 호스트의 에어비앤비 계정에 대금 조정이 이루어진 날과 관련 서비스가 제공된 날 중 더 늦은 날로부터 270일이 경과된 시점.

5.3.3. 에어비앤비 페이먼츠는 다음 날짜로부터 365일이 경과된 때에 미납 연체액을 채무불이행 상태로 간주합니다. (a) 승인된 청구 또는 인출의 경우, 회원님의 결제 수단에 최초 청구 또는 인출을 시도한 날과 관련 서비스가 제공된 날 중 더 늦은 날짜, (b) 호스트의 향후 지불액에서 원천징수하는 경우, 호스트의 에어비앤비 계정에 대금 조정이 이루어진 날과 관련 서비스가 제공된 날 중 더 늦은 날짜.

5.3.4. 회원님은 지급 의무가 있는 금액과 관련한 모든 의사소통을 에어비앤비 및/또는 에어비앤비 페이먼츠에 전자 메일 또는 전화를 이용해 전달한다는 데 명시적으로 동의합니다. 이러한 의사소통은 에어비앤비, 에어비앤비 페이먼츠 또는 그 대리인(제3자 징수 대리인을 포함하되 이에 국한되지 않음)에 의해서 이루어질 수 있습니다.

5.4 결제 처리 오류

5.4.1 에어비앤비 페이먼츠는 당사가 인지하게 된 결제 처리 오류를 시정하기 위해 필요한 조치를 취할 것입니다. 이러한 조치에는 회원님이 정확한 금액을 수령하거나 지급하도록, 선택 또는 사용하시는 기존 지불 수단이나 결제 수단으로 입금하거나 출금하는 조치가 포함될 수 있습니다. 이러한 조치는 에어비앤비 페이먼츠 또는 제3자(거래하시는 금융 기관 등)에 의해 취해질 수 있습니다. 또한, 당사는 오류(처리 오류로 인해 이루어진 중복 결제를 포함하되 이에 국한되지 않음)로 인해 회원님에게 지급된 금액을 회수하기 위해 향후 회원님에게 지급해야 하는 금액에서 해당 금액을 경감, 차감 및/또는 인출할 수 있습니다.

5.4.2 회원님은 오류로 인해 지급받은 금액의 범위에서 해당 금액을 에어비앤비 페이먼츠에 즉시 반환하기로 동의합니다.

5.5 환불

5.5.1 약관, 정상참작이 가능한 상황 정책, 재예약 및 환불 정책체험 게스트 환불 정책에 따라 회원에게 지급되어야 하는 환불액 또는 크레딧은 본 결제 약관에 따라 에어비앤비 페이먼츠가 지급을 개시하고 송금합니다.

5.5.2 본 제5조5항2호를 전제로, 에어비앤비 페이먼츠는 환불 절차를 즉시 개시합니다. 호스트가 예약을 취소하는 경우, 에어비앤비 페이먼츠는 게스트에게 환불이 이뤄지거나 게스트가 에어비앤비에 다른 호스트와의 재예약에 환불금을 사용하도록 지시할 때까지 최대 72시간 동안 환불금 지급을 보류합니다. 경우에 따라 환불 절차에는 현금 환불 대신 크레딧을 받는 옵션이 포함될 수 있습니다. 이 옵션을 이용할 수 있는 경우, 환불 시점은 에어비앤비 플랫폼을 통해 안내됩니다. 현금 환불 또는 결제 수단 가승인 해제 시점은 결제 수단 및 해당 결제 시스템(예: 비자, 마스터카드 등) 규정에 따라 달라집니다. 환불 처리 및 정산에 영향을 미칠 수 있는 불가항력적 사유가 발생하는 경우, 에어비앤비 페이먼츠는 실행 가능한 한 신속히 환불을 개시하고 처리할 것입니다.

6. 손해배상 및 손해배상액

6.1 약관 제15조에 따라 회원님이 손해배상 청구액에 대한 책임이 있는 경우, 에어비앤비는 에어비앤비 페이먼츠를 통해 예약 시 사용된 결제 수단 또는 손해배상 청구 시점 또는 그 후 합리적인 시점에 에어비앤비 계정에 등록된 기타 결제 수단으로 청구하여 손해배상 청구액을 징수할 수 있으며, 손해배상 청구액의 최대 한도는 약관 제15조에 정의된 바와 같습니다. 청구를 원활히 하기 위해, 회원님이 리스팅을 예약할 경우 에어비앤비가 에어비앤비 페이먼츠를 통해 손해배상 청구액을 수금하기 위해 예약 시 사용한 결제 수단으로 청구할 수 있음에 동의하시는 것으로 간주됩니다.

6.2 회원님은 가입하신 보험 정책에 따라 에어비앤비 페이먼츠가 손해배상액 회수를 시도할 수 있고, 추심기관 의뢰, 회원님에 대해 소송 또는 청구 제기(손해배상 청구 또는 호스트 손해보상에 따른 호스트의 지급 요청과 관련된 것 포함) 등 가능한 모든 구상권을 회원님을 상대로 청구할 수 있다는 점에 동의합니다.

7. 유기 재산

에어비앤비 페이먼츠가 회원님에게 지급되어야 하는 금액을 보류하거나(예: 지급이나 환불을 실행할 수 없는 경우), 회원님이 미청구 재산 관련 법률에서 주, 국가 또는 기타 관할 기관이 규정한 일정 기간 동안 기프트카드나 기프트 크레딧을 사용하지 않은 경우, 당사는 법적 의무에 따라 회원님에게 지급되어야 하는 금액을 처리할 수 있으며, 여기에는 해당하는 미청구 재산 관련 법률에서 요구되는 바에 따라 적절한 관할 당국에 해당 금액을 신고하고 귀속(송부)시키는 조치가 포함됩니다.

8. 금지 행위

8.1 회원님은 결제 서비스 이용에 적용되는 일체의 법률, 규칙, 규정 및 납세 의무를 준수할 전적인 책임을 부담합니다. 결제 서비스 이용과 관련하여 다음과 같은 행위가 금지되며, 이러한 행위를 스스로 하거나 다른 사람이 하도록 허용하거나 돕지 않을 것이라는 데 동의합니다.

  • 관련 법률 또는 규정을 위반하거나 우회하는 행위
  • 제3자와의 계약, 제3자의 권리, 약관, 추가 법률 약관, 정책 또는 기준을 위반하거나 우회하는 행위
  • 본 결제 약관에서 명시적으로 허용하지 않은 상업적 또는 기타 목적을 위해 결제 서비스를 이용하는 행위
  • 본인 소유가 아니거나 사용 권한이 없는 결제 수단 또는 지불 수단을 본인의 에어비앤비 계정에 등록하거나 이용하는 행위
  • 결제 서비스를 보호하기 위해서 에어비앤비 페이먼츠 또는 에어비앤비 페이먼츠의 서비스 제공자나 제3자가 구현한 기술적 조치를 회피, 우회, 제거, 비활성화, 훼손, 디스크램블(descramble)하거나 그 밖의 방식으로 우회하는 행위
  • 결제 서비스의 성능이나 적절한 기능을 손상하거나 악영향을 미치거나, 그러할 가능성이 있는 행위
  • 결제 서비스를 제공하는 데 사용되는 소프트웨어의 해독, 역컴파일링, 분해 또는 역엔지니어링을 시도하는 행위
  • 타인의 권리를 위반 또는 침해하거나 달리 타인에게 피해를 야기하는 행위

8.2 당사는 자금 세탁 방지 및 제재 이행과 관련된 당사의 내부 정책 및 다양한 관할권의 법률에 따라 행동해야 하며, 이러한 제재에는 (i) 해외 자산 통제국 또는 미국 국무부가 관리하는 것을 포함하여 미국 정부가 수시로 부과, 관리 또는 시행하는 경제·금융 제재나 무역 금수 조치, 또는 (ii) 유엔 안전 보장 이사회, 유럽 연합 또는 영국 재무부에 의한 조치 등이 포함됩니다. 회원님은 본인과 현지 관할권에 적용되는 관련 금융 제재 및 수출 관리법을 모두 준수해야 합니다.

9. 불가항력

에어비앤비 페이먼츠는 천재지변, 자연재해, 전쟁, 테러, 폭동, 금수 조치, 민병대 또는 군사 당국의 행위, 화재, 홍수, 사고, 팬데믹, 전염병이나 질병, 파업, 또는 교통 시설·연료·에너지·인력·자재 부족 등 에어비앤비 또는 에어비앤비 페이먼츠가 합리적으로 통제할 수 없으며, 모든 노력을 기울인다고 하더라도 그 결과를 피할 수 없는 비정상적이거나 예측 불가능한 상황('불가항력 사유')으로 발생하는 본 결제 약관에 따른 의무 이행의 지연 또는 불이행에 대한 책임을 지지 않습니다.

10. 책임의 부인

10.1 결제 서비스를 이용하기로 결정하는 것은 회원님의 자의적이고 독자적인 책임입니다. 법률에 의해 허용되는 최대 한도까지, 결제 서비스는 명시적 또는 묵시적인 여하한 보증 없이 '있는 그대로'의 조건으로 제공됩니다.

10.2 에어비앤비 페이먼츠가 제4조에 따라 호스트의 제한적 결제 징수 대리인으로 임명됨에도 불구하고, 에어비앤비 페이먼츠는 회원 또는 기타 제3자의 작위 또는 부작위에 대한 일체의 책임을 명시적으로 부인합니다. 에어비앤비 페이먼츠는 본 결제 약관에 명시적으로 규정된 범위 외에는 각 호스트에 대해 대리인으로서의 임무 또는 의무를 부담하지 않으며, 법률에 따라 수반될 수 있는 일체의 추가적 임무 또는 의무는 관련 법률에서 허용하는 최대한의 범위에서 명시적으로 배제됩니다.

10.3 당사가 회원의 신원 확인을 실시하기로 선택하는 경우, 관련 법률이 허용하는 범위에서 당사는 이러한 확인이 회원의 과거의 위법행위를 밝히거나 회원이 장래에 위법행위에 관여하지 않을 것을 보장하는 모든 종류의 명시적 또는 묵시적 보증임을 부인합니다.

10.4 위와 같은 책임의 부인은 법률에서 허용하는 최대한의 범위까지 적용됩니다. 회원님은 법적으로 배제될 수 없는 그 밖의 법적 권리 또는 보증 책임을 주장할 수 있습니다. 단, 법적으로 요구되는 보증 책임의 존속 기간은 법적으로 허용되는 최장 기간으로 제한됩니다.

11. 책임

11.1 회원님은 법률에 따라 허용되는 최대한의 범위까지, 결제 서비스 액세스 및 이용으로 발생하는 모든 위험이 본인 부담임을 인정하고 이에 동의합니다. 어떤 방식으로든 본인의 에어비앤비 계정을 타인이 사용하도록 허용 또는 승인하는 경우, 해당인의 행위에 대한 책임은 회원님이 부담합니다. 에어비앤비 페이먼츠 또는 결제 서비스의 생성, 제작 또는 제공에 관여된 기타 당사자 누구도 부수적, 특별, 징벌적 또는 간접적 손해에 대한 책임을 부담하지 않습니다. 이러한 손해에는 (i) 본 결제 약관, (ii) 결제 서비스 이용 또는 이용 불가능, (iii) 결제 서비스 이용의 결과로 소통하거나 거래하거나 만나는 다른 회원 및 타인과의 모든 의사소통, 상호작용 또는 만남으로 인해 발생하거나 그와 관련된 일실 이익, 데이터 유실 또는 영업권 상실, 서비스 중단, 컴퓨터 파손 또는 시스템 고장 또는 대체 제품 또는 서비스 비용, 또는 개인적∙신체적 상해 또는 정신적 고통에 대한 손해배상이 포함되고, 보증, 계약, 불법행위(과실 포함), 제조물 책임 또는 기타 법리에 기한 것인지 여부 및 에어비앤비 페이먼츠가 해당 손해의 가능성을 고지받았는지 여부를 불문하며, 본 약관에 명시된 제한적 구제수단이 그 주요 목적 달성에 실패한 것으로 판명된 경우에도 적용됩니다. 본 결제 약관 또는 호스트 손해보상이나 일본 호스트 보험하에 승인된 결제 요청에 따라 해당하는 호스트에게 대금을 지급해야 하는 당사의 의무를 제외하고, 본 결제 약관 및 회원님의 결제 서비스의 이용으로 인하여 또는 이와 관련하여 에어비앤비 페이먼츠가 부담하는 책임의 총 금액은 (i) 게스트인 경우, 책임의 원인인 사유가 발생하기 전 12개월 동안 게스트로서 에어비앤비 플랫폼을 통한 예약에 대해 결제하였거나 결제해야 하는 금액, 호스트인 경우, 책임의 원인인 사유가 발생하기 전 12개월 동안 에어비앤비 페이먼츠가 회원님에게 지급한 대금, 또는 (ii) 이러한 지급이 없었을 경우, 미화 1백 달러($100)를 초과할 수 없습니다. 이러한 책임 제한과 손해배상 한도는 회원님과 에어비앤비 페이먼츠 사이 계약의 기초가 되는 사항입니다. 일부 관할권에서는 간접적 또는 부수적 손해에 대한 책임의 배제 또는 제한을 허용하지 않으므로, 위 책임 제한이 적용되지 않을 수도 있습니다. 회원님이 미국 외 지역에 거주하는 경우, 상기 규정은 에어비앤비 페이먼츠의 과실로 발생하는 사망이나 상해에 대한 에어비앤비 페이먼츠의 책임, 기망적 허위 진술이나 근본적 사항에 관한 허위 진술에 대한 에어비앤비 페이먼츠의 책임, 또는 관련 법률에 따라 배제되거나 제한될 수 없는 기타 책임에 영향을 미치지 않습니다.

12. 면책

회원님은 (i) 본 결제 약관 위반, (ii) 결제 서비스의 부적절한 사용, (iii) 세금을 정확하게 신고, 징수 또는 납입하지 않거나, 회원님의 지시에 따라 당사가 이러한 의무를 불이행하는 행위, (iv) 법률, 규정 위반 또는 제3자 권리를 침해하는 행위로 인해 또는 이와 관련하여 발생하는 합법적인 법무 관련 및 회계 수수료를 한도 없이 포함하되 이에 국한하지 않는 모든 청구, 책임, 손해, 손실, 경비에 대한 책임으로부터 관련 법률이 허용하는 최대 범위 내에서 에어비앤비 페이먼츠와 계열사 및 자회사, 소속 임원, 이사, 직원 및 대리인을 면제, 방어(에어비앤비 페이먼츠의 재량에 따라 판단), 면책하고 피해가 없도록 할 것에 동의합니다.

13. 계약 변경, 계약 기간, 해지 및 기타 조치

13.1 계약 변경. 관련 법률에서 달리 요구되는 경우를 제외하고, 에어비앤비 페이먼츠는 언제든지 본 결제 약관을 변경할 수 있습니다. 본 결제 약관에 주요한 변경사항이 있는 경우, 변경된 결제 약관은 에어비앤비 플랫폼에 게시되며, 결제 약관 상단에 '최종 수정일'이 기재됩니다. 아울러, 회원님이 변경 사항의 영향을 받는 경우, 당사는 변경된 약관이 발효되기 최소 30일 전에 변경 사실을 통지합니다. 에어비앤비 페이먼츠 UK와 계약을 체결하는 경우, 변경 통지는 최소 2개월 전에 이뤄집니다. 개정된 결제 약관의 발효일 전까지 계약을 해지하지 않고 계속해서 결제 서비스를 이용하는 경우, 개정된 결제 약관의 변경 사항에 동의하는 것으로 간주합니다.

13.2 계약 기간. 본 결제 약관에 반영된 회원님과 에어비앤비 페이먼츠 사이의 계약은 회원님이 에어비앤비 계정을 생성하거나 결제 서비스를 이용할 때 효력이 발생되며, 회원님 또는 당사가 제13조3항에 따라 본 계약을 해지할 때까지 효력을 유지합니다.

13.3 해지. 당사에 이메일을 보내거나 에어비앤비 계정을 삭제함으로써 언제든 본 계약을 해지하실 수 있습니다. 본 계약의 해지는 약관에 따른 에어비앤비 계정 취소 통지의 기능도 수행합니다. 아래 명시된 당사의 권리를 제한하지 않을 것을 전제로, 에어비앤비 페이먼츠는 회원님의 등록된 이메일 주소로 30일 전(에어비앤비 페이먼츠 UK와 계약을 체결한 경우에는 2개월 전)에 통지함으로써 언제든지 일방적으로 본 계약을 해지할 수 있습니다. (i) 회원님이 본 계약에 따른 의무를 중대하게 위반한 경우, (ii) 부정확하거나, 기만적이거나, 오래되어 유효하지 않거나, 불완전한 정보를 제공한 경우, (iii) 관련 법률, 규정을 위반하거나 제3자의 권리를 침해한 경우, 또는 (iv) 에어비앤비 페이먼츠가 신의성실의 원칙에 따라 다른 회원, 에어비앤비, 에어비앤비 페이먼츠 또는 제3자를 보호하기 위해 합리적으로 필요하다고 판단하는 경우, 에어비앤비 페이먼츠는 통지 없이 본 계약을 즉시 해지할 수도 있습니다.

13.4 일시 중지 및 기타 조치. 에어비앤비 페이먼츠는 (i) 관련 법률, 법원, 법 집행기관 또는 기타 행정기관이나 정부 기관의 명령 또는 요청을 준수하기 위하여, (ii) 회원님이 본 결제 약관, 약관, 관련 법률, 규정을 위반하거나 제3자의 권리를 침해한 경우, (iii) 회원님이 결제 수단 또는 지불 수단에 관해 부정확하거나, 기만적이거나, 오래되어 유효하지 않거나, 불완전한 정보를 제공한 경우, (iv) 본 결제 약관에 따른 회원님의 채무가 연체되었거나 채무불이행 상태에 있는 경우, 또는 (v) 에어비앤비 페이먼츠가 에어비앤비와 에어비앤비 회원, 에어비앤비 페이먼츠 또는 제3자의 안전 또는 재산을 보호하거나 부정행위 또는 기타 불법 활동을 방지하기 위해서 합리적으로 필요하다고 신의성실의 원칙에 따라 판단하는 경우, 회원님의 결제 서비스 이용 또는 액세스를 제한하거나 일시적 또는 영구적으로 중지시킬 수 있습니다. 나아가, 카드 만료, 잔고 부족 등의 사유로 결제가 실패한 경우, 당사는 유효한 결제 수단을 통해 청구할 수 있을 때까지 회원님의 결제 서비스 액세스를 일시 중지할 수 있습니다.

13.5 이의 제기. 에어비앤비 페이먼츠가 제13조3항 및 제13조4항에 기술된 조치를 취하는 경우, 고객센터에 연락하여 이러한 결정에 대해 이의를 제기하실 수 있습니다.

13.6 해지의 효과. 호스트가 에어비앤비 계정을 취소하거나 에어비앤비 페이먼츠가 위에 기술된 조치를 취하는 경우, 에어비앤비 페이먼츠는 확정된 예약을 보유한 게스트에게 전액 환불할 수 있으며, 해당 호스트는 취소된 대기 중이거나 확정된 예약에 대해 어떠한 보상도 받을 수 없습니다. 게스트가 에어비앤비 계정을 취소하는 경우, 에어비앤비 페이먼츠는 해당 리스팅의 환불 정책에 기초해서 확정된 예약에 대한 환불을 실시합니다. 결제 서비스에 대한 액세스나 이용이 일시 중지 또는 제한되거나 당사가 본 계약을 해지한 경우, 회원님은 새로운 에어비앤비 계정을 등록할 수 없으며 다른 회원의 에어비앤비 계정을 통해 결제 서비스에 액세스하거나 이용할 수 없습니다.

13.7 존속 규정. 본 결제 약관 제5조부터 제20조까지는 본 계약이 해지되거나 만료된 후에도 효력을 유지합니다.

14. 준거법 및 분쟁 해결

14.1 에어비앤비 페이먼츠 US와 계약을 체결하는 경우, 미국 캘리포니아주 법률 및 미연방 법률에 따라 해석하며, 국제사법은 적용하지 않습니다. 제15조에 명시된 중재 합의에서 제외되는 사법 절차(소액청구 소송은 제외)는 양 당사자가 다른 관할 법원에 대해 합의하지 않은 한 캘리포니아주 샌프란시스코시 소재 주법원 또는 연방법원에 제기해야 합니다. 회원님과 당사는 캘리포니아주 샌프란시스코를 법정지로 하며 동 법원에 대인 관할권이 있음에 동의합니다.

14.2 에어비앤비 페이먼츠 UK와 계약을 체결하는 경우, 본 결제 약관은 잉글랜드법에 따라 해석합니다. 회원님이 개인 소비자이고, 거주 국가의 소비자 보호 의무 규정에 회원님에게 더 유리한 조항이 포함된 경우, 잉글랜드법 대신 해당 조항이 적용됩니다. 개인 소비자는 본 결제 약관과 관련된 모든 사법 절차를 본인의 거주지 관할 법원 또는 잉글랜드 관할 법원에 제기할 수 있습니다. 에어비앤비가 소비자인 회원을 상대로 권리를 행사하고자 하는 경우, 회원의 거주지 관할 법원을 통해서만 가능합니다. 회원님이 사업체 자격인 경우, 회원님은 잉글랜드 법원의 배타적 관할권에 따를 것을 동의합니다.

14.3 에어비앤비 페이먼츠 인디아와 계약을 체결하는 경우, 본 결제 약관은 인도법에 따라 해석합니다. 본 결제 약관과 관련하여 발생하는 분쟁은 뉴델리 소재 국제상업회의소('ICC')에 중재를 요청해야 하며, 뉴델리를 중재지로 해야 합니다. 이러한 중재는 중재 신청 시점에 시행 중인 ICC 중재 규정에 따라 진행해야 합니다. 단, 본 조항은 에어비앤비 페이먼츠가 회원님에 대해 일정한 행위를 이행하거나 금지할 것을 요구하는 명령, 또는 인도법이나 회원님에게 적용되는 기타 법에 따라 허용되는 임시 구제수단을 관할 법원에 신청할 수 있는 권리를 제한하지 않습니다. 분쟁의 당사자들 중 1명 이상이 비거주자인 경우, (의문의 여지가 없도록 하기 위해) 당사자들은 본 조항에 따른 중재 절차에 1996년 인도 중재조정법 제1부의 규정(제9조, 제27조, 37(1)(a)호, 37(3)항 제외)을 적용하지 않는 데 동의합니다. 중재 절차는 영어로 진행됩니다. 중재 판정은 최종적이며 양 당사자를 구속합니다. 중재 관련 비용은 각 당사자가 부담합니다.

14.4 에어비앤비 브라질과 계약을 체결하는 경우, 본 결제 약관은 브라질법에 따라 해석합니다. 회원님이 소비자 자격인 경우, 본 결제 약관과 관련하여 당사를 상대로 제기할 수 있는 사법 절차는 브라질 상파울루주 상파울루시에 소재하는 법원 또는 회원님의 거주지 관할 법원에만 제기될 수 있습니다. 회원님이 사업체 자격인 경우, 회원님은 브라질 상파울루주 상파울루시에 소재하는 법원의 배타적 관할권에 따를 것에 동의합니다.

15. 미국 중재 합의

다음 조항은 회원님과 에어비앤비 페이먼츠가 구속력 있는 개별 중재를 통해 서로 간 모든 분쟁을 해결하고 집단 소송 포기 및 배심원 재판 포기 조항을 포함하는 데 동의한다는 내용을 담고 있으므로 주의 깊게 읽어보시기 바랍니다. 본 중재 합의는 모든 이전 버전에 우선합니다.

15.1 적용 대상. 이 중재 합의는 에어비앤비 페이먼츠 US와 계약을 체결하는 경우에만 적용됩니다. 에어비애비 페이먼츠 US와 계약을 체결하지 않았지만 미국에서 에어비애비 페이먼츠를 상대로 법적 소송을 제기하려고 하는 경우, 본 중재 합의는 본 제15조가 회원님에게 적용되는지 여부, 거주지, 중재 가능성, 중재 장소, 관련 법률을 포함한 기타 모든 기준 판단에 적용됩니다.

15.2 분쟁 해결 절차 개요. 에어비앤비 페이먼츠는 소비자 친화적인 분쟁 해결 절차를 통해 문제를 해결하고자 노력합니다. 이를 위해 본 결제 약관은 제15조가 적용되는 개인에 대해 다음의 두 단계로 구성된 절차를 제공합니다. (1) 에어비앤비 고객서비스팀과 직접 비공식 협상(제15조3항 참조), 그리고 필요한 경우 (2) 본 중재 합의 약관에 따라 구속력 있는 중재. 회원님과 에어비애비 페이먼츠는 중재에 대한 대안으로 소액 청구 법원에 분쟁 해결을 요청할 권리를 보유합니다.

15.3 중재 전 분쟁 해결 및 통지 의무. 중재 절차를 시작하기 최소 30일 전에, 회원님과 에어비앤비 페이먼츠는 분쟁에 대한 개별 통지를 상대방 당사자에게 서면으로 발송하고('분쟁 전 통지서') 개별 청구를 비공식적으로 해결하기 위해 성실히 노력하는 데 동의합니다. 회원님은 반드시 해당 업무를 맡고 있는 에어비앤비 페이먼츠 대리인(CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833)에게 분쟁 전 통지서를 우편으로 송부해야 합니다. 에어비앤비 페이먼츠는 분쟁 전 통지서를 회원님의 에어비앤비 계정과 연결된 이메일 주소로 발송합니다. 분쟁 전 통지서에는 날짜, 회원님의 이름, 우편 주소, 에어비앤비 사용자 이름, 에어비앤비 계정을 만들 때 사용한 이메일 주소, 서명, 분쟁에 대한 간단한 설명 및 희망하는 구제책이 포함되어야 합니다. 관련 당사자가 30일 이내에 분쟁을 해결하지 못하는 경우에 한하여, 아래 제15조6항에 따라 지정된 중재 기구에 서면으로 중재 요청서를 제출함으로써 중재 절차를 시작할 수 있습니다. 청구인이 분쟁 전 통지를 발송하는 것이 모든 중재의 전제 조건이며, 분쟁 전 통지서 사본과 본 조항에서 요구하는 바에 따라 통지서가 발송되었다는 증빙 자료를 모든 중재 요청에 첨부해야 합니다.

15.4 중재 합의. 회원님과 에어비앤비 페이먼츠는 본 결제 약관 또는 본 결제 약관의 적용, 위반, 해지, 유효성, 집행 또는 해석, 또는 결제 서비스 이용으로 인해 또는 그와 관련해 발생한 모든 분쟁, 피해 보상 청구 또는 이견(총칭하여 '분쟁')을 구속력 있는 개별 중재에 의해 개별적으로 해결하는 것('중재 합의')에 동의합니다. 중재 합의가 양 당사자 사이의 분쟁에 대하여 집행되거나 적용될 수 있는지에 관해 분쟁이 있는 경우, 회원님과 에어비앤비 페이먼츠는 이 문제를 중재인의 판단에 맡기기로 합의합니다. 의심의 여지가 없도록 명확히 하자면, 회원님과 에어비앤비는 중재 가능성 및 본 제15조 전체 또는 일부의 형성, 집행 가능성, 유효성, 범위 또는 해석에 관한 모든 질문(분쟁 전 통지서 요건 준수 및 중재 수수료 지불에 대한 일방 당사자의 책임에 관한 분쟁을 포함)은 중재인에 의해 해결되어야 함에 동의합니다.

15.5 중재 합의 예외 사항. 회원님과 에어비앤비 페이먼츠는 다음과 같은 소인 및/또는 구제 청구가 중재 합의의 예외 사항에 해당하며 (제15조에 정의된 바와 같이) 관할 법원에 사법적 절차로 제기되어야 함에 동의합니다. (i) 긴급한 사정(예: 임박한 위험 또는 범죄, 해킹, 사이버 공격 행위)에 따라 긴급 가처분 구제를 요하는 모든 청구 또는 소인, (ii) 공공 가처분 구제 방안에 대한 요청, (iii) 소송 남용에 대한 모든 청구 또는 소인, 또는 (iv) 에어비앤비 플랫폼 또는 호스트 서비스 이용 중 발생한 성폭행 또는 성희롱 피해에 대한 개별 청구. 회원님과 에어비앤비 페이먼츠는 모든 공공 가처분 조치 요청이 모든 중재 청구, 구제 조치 또는 소인의 중재 이후에 진행되며, 연방 중재법 제3조에 따라 중재 결과가 나올 때까지 유예된다는 데 동의합니다.

15.6 중재 포럼, 규정 및 준거법. 본 중재 합의는 주(州) 사이의 상거래에 적용되며, 본 중재 합의의 모든 실체적·절차적 해석과 집행에는 주법이 아닌 연방 중재법(Federal Arbitration Act)이 적용됩니다. 중재는 ADR 서비스(ADR Services, Inc., 'ADR')(www.adrservices.com)가 연방 민사 소송 규정의 규정 1, 6~7, 8~9 및 11~12, 45, 54 및 56('선별된 연방 규정')(https://www.uscourts.gov/rules-policies/current-rules-practice-procedure/federal-rules-civil-procedure) 및 해당 시점에 유효한 ADR의 중재 규정('ADR 규정')에 따라 진행합니다. 단, 선별된 연방 규정 또는 ADR 규정이 본 중재 합의에 의해 변경되거나 상충하는 경우는 예외입니다. ADR 규정은 www.adrservices.com에서 확인할 수 있습니다. 중재 요청이 본 합의 및 ADR 규정에 따라 ADR 서비스에 제출되고 ADR 서비스가 중재를 진행할 수 없거나 진행하지 않을 경우, 해당 중재는 미국중재협회('AAA')에서 진행하며, 선별된 연방 규정 및 AAA의 소비자 중재 규정 및/또는 중재인이 적용하기로 정하고 해당 시점에 유효한 기타 AAA 중재 규정('AAA 규정')에 따라 진행합니다. 단 본 약관에 의해 변경된 사항은 제외됩니다. AAA 규정은 www.adr.org에서 확인할 수 있습니다. AAA가 중재를 진행할 수 없거나 진행하지 않을 경우, 회원님과 에어비앤비 페이먼츠는 대체 중재 포럼을 협의하고 선정해야 하며, 이에 동의할 수 없는 경우, 회원님 또는 에어비앤비 페이먼츠는 9 U.S.C. § 5에 따라 법원에 중재인 임명을 요청할 수 있습니다. 이 경우, 중재는 지정된 중재 포럼의 규정에 따라 진행됩니다. 단, 해당 규정이 본 중재 합의의 조항과 일치하지 않는 경우는 예외입니다.

15.7 중재 규정의 변경 - 중재 심리/장소. 중재의 비용 대비 효율성과 편의성을 최대한 높이고 회원님의 편의를 위해, 분쟁 금액이 미화 1백만 달러($1,000,000)를 초과하지 않는 경우, 필요한 중재 심리는 양 당사자가 달리 합의하거나 중재인이 지시한 경우를 제외하고 화상회의를 통해 원격으로 진행되어야 합니다. 분쟁 금액이 미화 1백만 달러($1,000,000)를 초과하는 경우, 필요한 중재 심리는 양 당사자가 달리 합의하거나 중재인이 지시한 경우를 제외하고 샌프란시스코 카운티에서 진행되어야 합니다. 분쟁 금액이 미화 1만 달러($10,000) 이하인 경우, 양 당사자는 단지 중재인에게 서류를 제출하는 것만으로 진행될 수 있음에 동의합니다.

15.8 중재 규정 변경 - 중재 수수료와 비용. 중재 수수료 및 중재인 보수 중 회원님의 부담 부분에 관해서는 ADR 규정 및 ADR 서비스 수수료 별첨 문서(www.adrservices.com에서 확인 가능)가 적용됩니다. 월 총소득이 연방 빈곤 기준치의 300% 미만인 경우, 중재인 보수를 제외한 중재 수수료와 비용 면제권을 행사할 수 있습니다. 해당하는 경우, 월수입과 가구 구성원 수를 진술한 서약서를 중재 기구에 제출하여 수수료 면제를 신청할 수 있습니다. 중재 기구로부터 수수료 면제를 승인받고 월 총소득이 연방 빈곤 기준치의 300% 미만임을 입증하는 데 필요한 서류를 에어비앤비 페이먼츠에 제출하는 경우, 에어비앤비 페이먼츠에서 중재인 보수 중 회원님의 부담 부분을 지불합니다.

15.9 중재 규정의 변경 - 부적절한 목적으로 제기되거나 본 중재 합의에 위배되는 청구. 어느 당사자건 상대 당사자 또는 그 변호인이 사실이나 법적 근거 없이, 악의적으로, 괴롭히려는 목적으로, 또는 경솔한 이유로 청구 또는 변호를 진행했다는 사실을 입증할 경우, 상대 당사자에게 제재를 부과하도록 중재인에게 요청할 수 있습니다. 상대 당사자가 사실이나 법적 근거 없이, 악의적으로 또는 단순히 괴롭히려는 목적으로, 연방민사소송규칙 제11조b항(중재자를 '법원'으로 취급)을 위반하여, 또는 경솔한 이유로 청구를 제기하거나 변호를 진행했다는 사실이 입증될 경우, 중재인은 관련 법률 및 AAA 규정에서 허용하는 바에 따라 요청 당사자에게 발생한 합리적인 변호사 수임료와 제반 비용에 상응하는 제재 조치를 상대 당사자에게 부과해야 합니다. 어느 당사자든 본 중재 합의의 조항을 위반하여 제기된 중재의 기각을 요청할 수 있습니다. 어느 당사자든 상대 당사자가 본 중재 합의의 요건을 준수하지 않거나 이를 위반하여 중재 가능한 분쟁에 관한 절차를 개시할 경우, 중재 과정에서 이에 대한 반소 청구를 제기할 수 있습니다. 일방 당사자가 본 중재 합의의 요건을 준수하지 않거나 이를 위반하여 중재 가능한 분쟁에 관한 절차를 개시한 것으로 입증될 경우, 중재인은 상대 당사자에게 합리적인 변호사 수임료 및 제반 비용을 포함하나 이에 국한되지 아니하는 실손해액에 대한 배상금을 지급하도록 판정해야 합니다.

15.10 중재인의 결정. 중재인은 판정의 기초로 삼는 주요 판단 및 결론이 포함된 서면 결정을 내립니다. 중재 결정에 대한 판결은 해당 분쟁에 대한 관할권을 가진 법원에서 집행될 수 있습니다. 중재인은 법률 또는 AAA 규정에서 허용하는 구제안을 허여할 수 있지만, 선언적인 또는 가처분 구제안은 신청인의 개별 청구에 의해 보증된 구제안을 제공하는 데 필요한 범위 내에서 개별 기준으로만 허여할 수 있습니다.

15.11 배심원 재판의 포기. 회원님과 에어비앤비 페이먼츠는 중재가 가능한 모든 분쟁에 대해 배심원에 의한 재판을 받을 권리를 포기할 것을 인정하며 이에 동의합니다.

15.12 집단 소송 또는 대표 소송 불가. 회원님과 에어비앤비 페이먼츠는 관련 법률에서 허용하는 최대한의 범위에서 집단 소송, 집단 중재, 공익 소송 또는 기타 대표 또는 병합 소송에서 원고 또는 구성원으로 참여할 수 있는 권리를 포기하기로 합니다. 양측이 서면으로 합의하거나 본 합의에 명시된 경우를 제외하고, 중재인은 복수의 일방 당사자의 청구를 병합할 수 없으며 달리 여하한 집단 소송 또는 대표 소송을 주재할 수 없습니다. 관련 법률에 따라 특정 청구, 소인 또는 요청된 구제 조치와 관련해 본 항에 포함된 권리 포기의 시행이 불가능하다는 최종 사법 결정이 있는 경우, 해당 청구, 소인 또는 요청된 구제 조치(오직 해당 청구, 소인 또는 요청된 구제 조치만 해당)는 본 계약에서 분리되어 중재되고 관할권을 가진 법원에 제기될 것입니다. 본 조항에 따른 청구, 소인 또는 요청된 구제 조치가 시행 불가능하게 되어 분리된 경우, 회원님과 당사는 중재인에 의해 모든 청구, 소인, 요청된 구제 조치가 해결될 때까지 중재의 대상이 되지 않는 청구, 소인, 또는 요청된 구제 조치가 유예된다는 데 동의합니다.

15.13 대량 중재 청구 포기. 회원님과 에어비앤비 페이먼츠는 다음과 같은 성격의 중재 청구가 180일 내에 100건 이상 대량으로 제기될 경우 중재의 상대적인 효익과 효율성이 상실될 수 있음을 인정하고 이에 동의합니다. (1) 동일하거나 유사한 상황에 처한 당사자가 관련되어 있고, (2) 동일하거나 실질적으로 동일한 거래, 사고, 위반 가능성 또는 사건으로 인해 야기되었으며, 동일하거나 실질적으로 동일한 법적 또는 사실적 논점에 대한 판단이 요구되는 동일하거나 유사한 청구에 기반하며, (3) 양 당사자의 변호인이 동일하거나 협력 관계인 중재 청구('대량 청구'). 이에 따라, 회원님과 에어비앤비 페이먼츠는 대량 중재 청구의 일환으로 분쟁을 진행, 중재 또는 해결할 권리를 포기하는 데 동의합니다(단, 본 약관 제15조 및 제15조12항은 분쟁에 계속 적용됩니다). 분쟁이 발생하는 경우, 일방 당사자가 인정한 복수의 청구 중 첫 번째로 다뤄지는 사안에 선임된 중재인이 해당 청구가 대량 중재 청구의 일환인지 그 여부를 판정합니다. 중재인이 아직 선임되지 않은 경우, 일방 당사자가 인정한 청구 건이 대량 중재 청구의 일환인지 여부를 판정할 중재인을 별도로 선임해야 합니다. 본 조항의 어떠한 내용도 회원님이나 에어비앤비 페이먼츠가 대량 중재 청구에 참여하는 것을 제한하지 않습니다.

15.14 중재 규정의 변경 – 대규모 중재 청구의 일괄 처리 요건. 제15조13항에도 불구하고 어떠한 이유로든 중재가 대량 중재 청구의 일환으로 진행되는 경우, 양 당사자는 전체 청구 건을 200건 이하로 나누어 묶음을 구성해야 합니다. 묶음을 구성할 때는 청구인의 성 또는 회사명 중 해당하는 경우에 따라 알파벳순으로 정렬한 후 나눠야 합니다. 정렬 순서에 따라 첫 200명의 청구인이 첫 번째 묶음을 구성하고, 다음 200명의 청구인이 두 번째 묶음으로 분류되는 방식입니다. 양 당사자는 각 묶음에 순차적인 번호를 무작위로 배정하고, 해당 번호에 따라 한 번에 한 묶음씩 순차적으로 중재를 진행해야 합니다. 하나의 묶음에 대한 중재가 진행되는 동안, 중재 기구는 양 당사자가 달리 합의하거나 중재 기구가 지시한 경우를 제외하고 나머지 묶음을 유예 상태로 두어야 합니다. 각 묶음은 해당 묶음에 대한 심리 준비 기일로부터 240일 내에 해결되어야 합니다. 상기 내용에도 불구하고, 청구인의 제기한 청구가 대량 중재 청구 중 가장 최근에 제기된 청구로부터 2년 이내에 심리 전 사전 절차의 대상이 되지 않은 경우, 청구인은 본 약관 제14조 및 제15조12항의 적용을 받는 법원에서 해당 청구를 진행하기로 선택할 수 있습니다.

15.15 중재 규정의 변경 - 중재 판결 제안. 회원님 또는 에어비앤비 페이먼츠는 중재 심리가 열리기 최소 10일 전까지 특정 조건의 중재 판결이 가능하도록 상대 당사자에게 중재 판결 제안을 서면으로 제시할 수 있습니다. 상대 당사자가 제안을 수락하는 경우, 수락 사실 증빙이 첨부된 중재 판결 제안서가 중재 기구에 제출되며, 중재 기구는 이에 따라 판결을 내려야 합니다. 중재 심리 전 또는 제의를 보낸 후 30일 이내에 중재 판결 제안이 수락되지 않는 경우, 무엇이 먼저 발생하였는지 상관없이, 해당 제안은 철회된 것으로 간주되며 관련 비용(중재 기구에 지급된 모든 수수료 포함)을 제외하고 이를 중재에 증거로 제시할 수 없습니다. 일방 당사자의 중재 판결 제안을 상대 당사자가 수락하지 않고, 상대 당사자가 제안보다 더 유리한 판결을 받지 못한 경우, 상대 당사자는 제안이 제시된 이후 발생한 비용을 회수할 수 없으며, 제안이 제시된 시점부터 제안한 당사자에게 발생한 비용(중재 기구에 지불하는 모든 수수료 포함)을 부담해야 합니다.

15.16 조항의 독립성. 제15조12항에 명시된 사항을 제외하고, 본 중재 합의의 일부가 불법 또는 집행 불가한 것으로 간주될 경우, 해당 조항은 분리되며 중재 합의의 나머지 부분은 완전한 효력을 유지합니다.

15.17 중재 합의 변경. 에어비앤비 페이먼츠가 회원님의 본 결제 약관의 최종 수락일(또는 본 결제 약관의 후속 변경이 수락된 일자) 후에 제15조를 변경하는 경우, 회원님은 해당 변경 약관의 발효일로부터 30일 이내에 서면으로 통지하여 변경을 거부할 수 있습니다. 해당 통지서에는 회원님의 이름, 우편 주소, 통지일, 에어비앤비 사용자 이름, 에어비앤비 계정을 만들 때 사용한 이메일 주소, 회원님의 서명 및 변경된 제15조를 거부한다는 명백한 진술이 포함되어야 합니다. 통지서를 우편(주소: 888 Brannan St, San Francisco, CA 94103, Attn: Arbitration Opt-Out)으로 보내거나, 변경 약관 거부 통지서를 이메일(arbitration.opt.out@airbnb.com)로 보내야 합니다. 단, 변경을 거부하더라도 회원님과 에어비앤비 페이먼츠 사이의 분쟁을 중재하기 위한 이전 합의에 대한 사전 동의(또는 이에 대한 후속 변경에 대한 회원님의 사전 동의)는 취소 또는 변경되지 않으며, 양측간 분쟁에 대해 효력을 유지하고 집행할 수 있습니다.

15.18 존속 규정. 제15조16항에 명시된 경우를 제외하고, 제13조7항이 적용됨을 전제로, 제15조는 본 결제 약관이 해지된 이후에도 존속하며, 회원님이 결제 서비스 이용을 중단하거나 에어비앤비 계정을 해지한 이후에도 계속 적용됩니다.

16. 기타 조항

16.1 본 결제 약관의 해석. 추가 약관, 조건, 정책, 지침, 기준에 의해 보완될 수 있는 경우를 제외하고, 본 결제 약관은 본 약관의 주제에 관해 에어비앤비 페이먼츠와 회원님 사이의 완전한 합의를 구성하며, 결제 서비스에 관해 에어비앤비 페이먼츠와 회원님 사이에 맺어진 모든 기존 구두·서면의 양해 또는 합의에 우선합니다. 본 결제 약관의 일부 조항이 무효 또는 집행 불가능한 것으로 판단되는 경우, 해당 조항은 삭제되며 나머지 조항의 효력 및 집행 가능성에 영향을 주지 않습니다.

16.2 권리 불포기. 에어비앤비 페이먼츠가 본 결제 약관상의 권리 또는 조항을 집행하지 않는 경우에도, 당사가 서면으로 인정하고 합의하지 않은 한 이는 해당 권리 또는 조항의 포기로 간주되지 않습니다. 본 결제 약관에 명시된 경우를 제외하고, 일방 당사자에 의한 본 약관에 따른 구제수단의 행사는 본 약관에 따른 해당 당사자의 다른 구제수단 또는 법률에서 허용한 구제수단을 침해하지 않습니다.

16.3 양도. 회원님은 에어비앤비 페이먼츠의 사전 서면 동의 없이 본 계약 또는 본 계약상 회원님의 권리·의무를 양도, 이전, 위임할 수 없습니다. 에어비앤비 페이먼츠는 30일 전에(에어비앤비 페이먼츠 UK와 계약한 회원의 경우에는 2개월 전에) 통지하여 단독 재량에 따라 본 계약 및 그에 따른 권리·의무를 제한 없이 양도, 이전, 위임할 수 있습니다.

16.4 통지. 달리 명시된 경우를 제외하고, 본 계약에서 허용하거나 요구하는 일체의 통지나 연락은 서면으로 해야 하며, 에어비앤비 페이먼츠에 의해 이메일이나 에어비앤비 플랫폼 알림, 회원님의 알림 설정에 따라서는 메시징 서비스(SMS와 위챗(WeChat) 포함)를 통해 제공됩니다. 에어비앤비 페이먼츠가 통지를 전송한 날을 수령일로 간주합니다.

17. 에어비앤비 페이먼츠 UK와 계약을 체결하는 사용자에 적용되는 추가 조항

에어비앤비 페이먼츠 UK와 계약을 체결하는 경우 아래 규정이 적용됩니다. 제17조와 본 결제 약관의 다른 조항이 상충하는 경우, 제17조의 조항이 적용됩니다.

17.1 결제 서비스 이용자

17.1.1 결제 서비스에는 에어비앤비 페이먼츠 UK와 계약을 체결한 호스트에게 제공되는 결제액 수금 서비스가 포함됩니다. 결제액 징수 서비스는 결제 서비스 규정이 적용되는 '결제 서비스'를 구성하며, 해당 목적으로 에어비앤비 페이먼츠 UK는 호스트를 '결제 서비스 이용자'로 간주합니다.

17.1.2 본 결제 약관에 동의하는 경우, 선택하신 지불 수단으로 에어비앤비 페이먼츠 UK가 대금을 지급하는 데 호스트로서 동의하는 것입니다. 호스트는 제3조3항에 명시된 지불에 관해 합의한 시점으로부터 1일 전까지 지불 수단을 변경할 수 있습니다. 에어비앤비 페이먼츠 UK는 제3조3항에 따라 지불을 개시하기로 합의한 날에 호스트의 지급 명령을 수신한 것으로 간주됩니다.

17.1.3 에어비앤비 페이먼츠 UK는 영국에 소재하는 호스트가 에어비앤비 페이먼츠 UK의 지불 개시일의 다음 영업일 종료 시점까지 지불액을 수령할 수 있도록 노력해야 합니다.

17.1.4 연락. 에어비앤비 페이먼츠는 지급을 개시할 때마다 호스트에게 이메일로 통지합니다. 또한 오류로 인하여 대금이 반송될 경우에도 호스트의 등록된 이메일 주소로 통지합니다. 현재 사용하는 정확하고 유효한 이메일 주소를 제공하는 것은 호스트의 책임입니다.

17.2 타인에게 지급된 대금 및 불만 사항

17.2.1 호스트인 회원님의 에어비앤비 계정에 로그인하는 비밀번호나 기타 자격 증명('자격 증명')의 분실, 도난 또는 유용으로 인해 회원님이 수령해야 할 대금이 회원님의 허락 없이 타인에게 지급되었거나 그럴 가능성이 있다고 판단하거나 이를 인지하게 된 경우('타인에게 지급된 지불'), 자격 증명의 분실, 도난, 유용, 자격 증명의 무단 사용, 또는 에어비앤비 계정에 대한 무단 액세스 사실을 알게 된 후 부당한 지체 없이 에어비앤비 페이먼츠 UK에 즉시 통지(자세한 방법은 제20조 참조)해야 합니다.

17.2.2 호스트가 선택한 지불 수단을 통해 지불액을 수령하지 못했다고 주장하는 경우(타인에게 지급된 지불이 있는 경우 포함), 에어비앤비 페이먼츠 UK는 (승인되지 않았거나 부정확하게 실행된 지불액에 대해 알게 된 후 회원님이 부당한 지체 없이 요청하는 경우, 그리고 해당 상황 발생 후 13개월 이내에) 즉시 지급액을 추적하여 그 결과를 알려드릴 것입니다. 제17조2항3호에 따라, 당사가 (i) 회원님이 선택한 지불 수단을 통하여 회원님이 해당 지급액을 수령하였다는 사실이나, (ii) 회원님이 제공한 지불 수단 정보를 이용하여 당사가 올바르게 지급하였으나 회원님이 제공한 정보가 부정확하였다는 사실을 입증하지 못하는 경우, 당사는 해당 금액을 환불할 것입니다. 회원님이 당사에 잘못된 정보를 제공한 경우, 당사는 잘못된 지급 또는 지급 미집행에 대해 책임을 지지 않지만, 지급 대금의 회수를 위해 합당한 노력을 기울일 것입니다.

17.2.3 회원님은 본 결제 약관에 따라 자격 증명을 사용하고 자격 증명을 안전하게 유지하기 위해 모든 합리적인 조치를 취해야 합니다. 분실이나 도난, 유용된 자격 증명의 사용(애플리케이션을 설치한 휴대폰의 분실 포함) 또는 회원님이 자격 증명을 안전하게 보호하지 못함으로써 타인에게 지급된 지불 관련 손실은 최대 £35까지 호스트인 회원님이 책임져야 할 수 있습니다. 회원님이 부정행위를 하거나 에어비앤비 직원 또는 서비스 제공업체의 행위 또는 부작위로 인해 손실이 발생한 경우를 제외하고, 지급 전 회원님이 자격 증명의 분실, 도난 또는 유용을 감지하지 못한 경우에는 이 조항이 적용되지 않습니다. 그러나 회원님이 부정행위를 저질렀거나 고의 또는 중과실로 에어비앤비 플랫폼 및/또는 결제 서비스를 약관 또는 본 결제 약관(자격 증명을 안전하게 보호할 의무 포함)에 따라 이용하지 못했다고 당사가 입증할 수 있는 경우, 타인에게 지급된 지불과 관련된 모든 손실에 대해 회원님이 책임을 져야 할 수 있습니다. 회원님이 부정행위를 한 경우를 제외하고, 회원님이 자격 증명의 분실, 도난 또는 유용 또는 자격 증명의 무단 사용에 대해 통지했지만, 당사가 어떤 시점에서든 그러한 통지를 위한 적절한 수단을 제공하지 않았거나 강력한 고객 인증이 필요함에도 불구하고 이를 요구하지 않은 경우, 통지 후 발생한 타인에게 지급된 지불과 관련된 손실에 대해 회원님은 책임을 지지 않습니다.

17.2.4 결제 서비스에 대한 모든 불만은 에어비앤비 페이먼츠 UK에 제기해야 합니다(자세한 방법은 제20조 참조). 회원님이 불만 제기 결과에 만족하지 않으며 호스트로서 에어비앤비 페이먼츠 UK로부터 규제 대상 결제 서비스를 제공받은 경우, 금융 옴부즈맨 서비스에 불만 사항을 전달할 수도 있습니다. 금융 옴부즈맨 서비스에 제기하는 모든 불만의 경우, 자격 요건과 관련된 것을 포함하여 금융 옴부즈맨 서비스의 규정이 적용됩니다. 영국 금융 옴부즈맨 서비스는 개인, 상공인, 소규모 자선단체, 소액 신탁의 수탁자를 위해 무료 불만 해결 서비스를 제공합니다. 금융 옴부즈맨 서비스에 대한 추가 정보 및 연락처 정보는 http://www.financial-ombudsman에서 확인하실 수 있습니다.

17.3 멕시코에 거주하는 호스트 및 게스트의 경우

거주국이 멕시코인 경우, (i) 게스트의 예약 요청을 호스트가 수락한 후 게스트의 결제 금액을 정상적으로 수령할 때, 일반적으로 제3조3항1호에 따라 에어비앤비 페이먼츠가 해당 금액을 호스트에게 지급될 때까지 임시 보유하며, (ii) 호스트에 대한 지급은 제3조3항1호에 따라 호스트 서비스가 개시된 때에 한하여 실행됩니다. 에어비앤비는 관련 현지 법규에 따라 세금을 원천징수해야 할 수 있으며, 이러한 세금은 에어비앤비 페이먼츠가 호스트에게 지불액을 지급할 때 납부해야 합니다.

호스트는 에어비앤비 페이먼츠가 호스트 서비스를 구매하는 게스트의 자금을 수령 및 처리하고 부가가치세를 포함하여 멕시코에서 납부해야 하는 모든 세금을 지불하기 위한 제한적 목적으로 호스트를 대리하여 결제 징수 대리인 역할을 수행하고 있음을 인정합니다.

18. 에어비앤비 브라질과 계약을 체결하는 사용자에 적용되는 추가 조항

에어비앤비 브라질과 계약을 체결하는 경우 다음 조항이 적용됩니다.

18.1 브라질에 거주하는 사용자를 위한 할부 결제 기능

2조 '게스트 약관' 조항을 변경하는 내용으로 다음 하위 조항이 추가됩니다. "회원님의 거주 국가가 브라질이고 브라질에서 발행되었으며 할부 결제를 지원하는 신용카드로 결제하는 경우, 예약금을 여러 차례로 나누어 할부 결제할 수 있음을 확인합니다. 할부 결제 횟수의 옵션은 다양할 수 있으며, 이용자가 예약 거래를 완료하기 전에 볼 수 있습니다. 회원님은 예약과 관련하여 할부 결제를 선택하는 경우 신용카드 및/또는 기타 형태의 할부 결제와 관련된 비용('할부 수수료')으로 인해 총 금액이 증액될 수 있다는 점을 확인합니다. 회원님은 할부 수수료의 결제에 대한 책임이 전적으로 본인에게 있으며, 에어비앤비 브라질은 오직 해당 금액을 징수하여 해당 제3자 결제 서비스 제공업체에 전달할 책임만을 진다는 것에 동의합니다. 회원님은 예약 시 사용한 결제 수단으로 해당 제3자 결제 서비스 제공업체가 결제금을 자동 청구하도록 승인합니다. 할부 결제 기능을 이용하는 경우 해당 제3자 결제 서비스 제공업체의 별도 약관이 적용될 수 있습니다. 어떤 이유로든 예약이 취소되는 경우, 할부 수수료는 예약 시 사용한 결제 수단으로 환불됩니다. 할부로 결제할 수 있는 예약을 변경하고 예약 변경으로 인해 총 금액이 낮아진 경우에도 할부 수수료가 일체 환불되지 않습니다. 환불은 본 결제 약관에 따라 에어비앤비 페이먼츠에 의해 개시되어 송금됩니다."

18.2 게스트와 호스트의 거주 국가에 따라, 호스트에게 지급해야 하는 금액과 에어비앤비 서비스 수수료 등의 관련 수수료에 대한 결제는 관련 법령에 따라 외환 계약을 체결하거나 기타 관련 조치를 이행해야 할 수 있습니다.

18.3 회원님이 브라질에 거주하며 브라질 외부에 거주하는 호스트에게 현지 통화를 사용하여 예약을 하는 경우, 결제 서비스를 이용함으로써 에어비앤비 브라질이 브라질 외부에 거주하는 호스트의 결제 징수 대리인 역할을 한다는 사실을 확인하고 이에 동의하는 것입니다. 에어비앤비 브라질은 또한 약관에 명시된 바와 같이 회원님이 에어비앤비 플랫폼 이용을 위해 계약을 체결하는 주체이기도 합니다.

18.4 회원님은 에어비앤비 브라질이 직접 또는 제3자를 통해 신원 확인에 필요한 조회를 실행하는 것을 승인합니다. 여기에는 (i) 제3자 데이터베이스 또는 기타 출처를 통한 신원 조회, (ii) 서비스 제공자에 대한 보고서 요청, (iii) 정부 발급 신분증(예: 운전면허증 또는 여권), 납세자 번호, 생년월일, 주소 및 기타 정보의 제공 요청, 또는 (iv) 이메일 주소, 결제 수단 또는 지불 수단의 소유권을 확인하기 위한 조치의 이행 요구가 포함될 수 있습니다. 당사가 이러한 정보를 취득하거나 검증할 수 없는 경우, 에어비앤비 브라질은 결제 서비스를 종료 또는 일시 중지하거나, 결제 서비스에 대한 액세스를 제한할 수 있는 권리를 보유합니다.

18.5 회원의 결제를 처리할 때, 에어비앤비 브라질(또는 회원님이나 에어비앤비 브라질이 회원님을 대신해 계약한 제3자)은 관련 법령, 특정 규제 관리, 자금 세탁 방지를 위해 (해당하는 경우) 회원 및/또는 각각의 거래와 관련된 정보를 보유하거나 관할 당국에 보고할 수 있습니다.

18.6 에어비앤비 브라질과 계약을 체결하는 게스트 및 호스트의 경우, 본 결제 약관에서 에어비앤비, 에어비앤비 페이먼츠, 에어비앤비 플랫폼에 대한 모든 언급은 에어비앤비 브라질을 지칭하는 것으로 간주됩니다.

19. 사업자인 사용자에 적용되는 추가 조항

회원님이 사업체, 회사, 기타 법인을 대신하여 대표자('대표자') 자격으로 결제 서비스를 이용하는 경우, 아래 조항이 추가로 적용됩니다(이 경우, 결제 약관 적용에 있어서 '회원님'은 해당 사업체, 회사, 기타 법인을 지칭합니다).

19.1 회원님은 결제 약관을 수락하며, 회원님을 대리하여 결제 서비스를 이용하는 직원 또는 제3자 대리인의 작위·부작위에 대해 책임을 집니다.

19.2 회원님과 회원님의 대표자는 제2조1항 및 제3조2항에 기재된 정보를 제공할 권한이 있으며, 대표자가 본 결제 약관에 대해 회원님을 기속할 권한이 있음을 각각 확인합니다. 당사는 대표자의 권한을 증명하는 추가 정보나 문서 제공을 요구할 수 있습니다.

19.3 회원님은 (i) 본인의 사업체가 등록된 국가의 법에 따라 적법하게 설립되어 유효하게 존속하며 양호한 상태를 유지하고 있다는 사실, 그리고 결제 서비스를 이용하기 위해 등록되어 있다는 사실, (ii) 본 계약을 체결하고 본 계약상 의무를 이행하며 권리·라이선스·권한을 부여하는 데 필요한 모든 권리, 능력, 권한을 가지고 있다는 사실을 진술·보증합니다.

19.4 계정이 허용하는 바에 따라 에어비앤비 비즈니스 프로그램과 관련하여 직원 또는 권한을 부여받은 제3자의 이익을 위해 회사의 결제 수단을 사용하는 경우, 귀사의 직원 또는 권한 있는 제3자가 요청한 예약 비용을 회사의 결제 수단에 청구할 권한을 에어비앤비 페이먼츠에 승인합니다.

19.5 회원님은 에어비앤비 계정에 연결된 지불 수단에 대해, 지불 수단 정보를 저장하고, 해당 지불 수단을 사용하여 계정과 연계된 예약의 비용을 송금하고, 지불 수단과 관련하여 본 결제 약관에서 허용하는 다른 조치를 취할 수 있는 권한을 에어비앤비 페이먼츠에 허여합니다.

19.6 회원님이 타인 또는 제3자를 대신하여 결제 카드 정보를 취급, 저장, 또는 기타 방법으로 처리하는 경우, 그러한 신용카드 정보의 이용, 접근, 저장과 관련된 현행 결제 카드 산업 데이터 보안 표준에 따른 개인정보 보호 및 보안 요건을 지속적으로 준수하는 데 동의합니다. 규정 준수 여부를 확인할 수 있는 도구 등 상세한 정보는 https://www.visa.com/cisphttps://www.mastercard.com/sdp를 참조하시기 바랍니다.

Payments Terms of Service for European Users

If you reside in, or the organization you are acting for is established in, the United States, the arbitration agreement and class actions waiver in Section 15 apply to you. Please read them carefully.

These Payments Terms of Service for European Users (“Payments Terms”) are a binding legal agreement between you and Airbnb Payments that govern the Payment Services (defined below) conducted through or in connection with the Airbnb Platform. When these Payments Terms mention “Airbnb Payments,” “we,” “us,” or “our,” it refers to:

  • Airbnb Payments Luxembourg S.A. (“Airbnb Payment Luxembourg”) if your country of residence is in the EEA.
  • Airbnb Payments UK Ltd. (“Airbnb Payments UK”) if your country of residence is in the United Kingdom or Switzerland.

Airbnb Payments provides payments services to Members publishing, offering and booking Accommodations, Experiences or other Host Services, including services in connection with the Open Homes Program and other current and future services provided via the Airbnb Platform. These payment services may include (if available) the following (collectively, “Payment Services”):

  • Collecting payments from Guests (“Payin”), by charging the payment method associated with their Airbnb account, such as credit card, debit card, bank account or PayPal account (“Payment Method”);
  • Effecting payments to Hosts (“Payout”) to a financial instrument associated with their Airbnb account, such as a PayPal account, bank account, direct deposit, a prepaid card, or a debit card (“Payout Method”);
  • Effecting payments to a third-party Payout Method designated by a Host;
  • Collection and payment of charitable donations;
  • Payment collection services; and
  • Other payment related services in connection with Host Services.

In order to use the Payment Services, you must be at least 18 years old, must have an Airbnb account in good standing in accordance with the Airbnb Terms of Service (“Terms”), and must keep your payment and personal information accurate and complete.

If you change your country of residence, the Airbnb company you contract with and the applicable version of the Payment Terms will be determined by your new country of residence from the date on which your country of residence changes. Please note, however, that the Airbnb Payments company with whom you contract will stay the same for all bookings made prior to your change of residence.

The Terms separately govern your use of the Airbnb Platform. If you see an undefined term in these Payment Terms, it has the same definition as in the Terms.

1. Your use of the Payment Services

1.1 Airbnb Payment Services. By using the Payments Services, you agree to comply with these Payment Terms. Airbnb Payments may temporarily limit or suspend your access to or use of the Payment Services, or its features, to carry out maintenance measures that ensure the proper functioning of the Payment Services. Airbnb Payments may improve, enhance and modify the Payment Services and introduce new Payment Services from time to time. Airbnb Payments will provide notice to Members of any changes to the Payment Services, unless such changes do not materially increase the Members’ contractual obligations or decrease the Members’ rights under these Payments Terms.

1.2 Third Party Services. The Payment Services may contain links to third-party websites or resources (“Third-Party Services”). Such Third-Party Services are subject to different terms of service and privacy policies, and Members should review them. Airbnb Payments is not responsible or liable for the use of such Third-Party Services. Links to any Third-Party Services are not an endorsement by Airbnb Payments of those Third-Party Services.

1.3 Your Airbnb Account. Airbnb Payments may enable features that allow you to authorize other Members or third parties to take certain actions that affect your Airbnb account. You may authorize a third party to use your Airbnb account if the feature is enabled for your Airbnb account. You acknowledge and agree that anyone you authorize to use your Airbnb account may use the Payment Services on your behalf and that you will be responsible for any payments made by such person. If you reside in the EEA and contract with Airbnb Payments Luxembourg, this Section 1.3 does not apply to you.

1.4 Verification. You authorize Airbnb Payments, directly or through third parties, to make any inquiries we consider necessary to verify your identity. This may include (i) screening you against third-party databases or other sources, (ii) requesting reports from service providers, (iii) asking you to provide a form of government identification (e.g., driver’s license or passport), your date of birth, your address, and other information; or (iv) requiring you to take steps to confirm ownership of your email address, Payment Method(s) or Payout Method(s). Airbnb Payments reserves the right to terminate, suspend, or limit access to the Payment Services in the event we are unable to obtain or verify any of this information.

1.5 Additional Terms. Your access to or use of certain Payment Services may be subject to, or require you to accept, additional terms and conditions. If there is a conflict between these Payments Terms and terms and conditions applicable to a specific Payment Service, the latter terms and conditions will take precedence with respect to your use of or access to that Payment Service, unless specified otherwise.

2. Guest Terms

2.1 Adding a Payment Method. When you add a Payment Method to your Airbnb account, you will be asked to provide billing information such as name, billing address, and financial instrument information either to Airbnb Payments or its third-party payment processor(s). You authorize Airbnb Payments and its payment service providers to collect and store your Payment Method information.

2.2 Payment Method Verification. When you add or use a new Payment Method, Airbnb Payments may verify the Payment Method by (i) authorizing your Payment Method for one or two nominal amounts via a payment service provider, and asking you to confirm those amounts, or (ii) requiring you to upload a billing statement. We may, and retain the right to, initiate refunds of these amounts from your Payment Method. When you add a Payment Method during checkout, we will automatically save and add that Payment Method to your Airbnb account so it can be used for a future transaction. You can remove the Payment Method from your Airbnb account as long as it is not associated with an active or future reservation.

2.3 Payment Authorization. You allow Airbnb Payments to charge your Payment Method (including charging more than one payment method), either directly or indirectly, for all fees due (including any applicable taxes) in connection with your Airbnb account.

2.4 Automatic Update of Payment Method. If your Payment Method’s account information changes (e.g., account number, routing number, expiration date) as a result of re-issuance or otherwise, we may acquire that information from our financial services partners or your bank and automatically update your Payment Method on file.

2.5 Timing of Payment. Airbnb Payments generally charges the Total Price due after the Host accepts your booking request. However, if you pay with a push Payment Method (such as Sofort), Airbnb Payments will collect the Total Price due at the time of your booking request or after the Host accepts your booking request. Airbnb Payments may offer alternative options for the timing and manner of payment. Any additional fees for using those alternative payment options will be displayed via the Airbnb Platform and included in the Total Price, and you agree to pay such fees by selecting the payment option. Additional terms and conditions may apply for the use of an alternative payment option. If Airbnb Payments is unable to collect the Total Price due, as scheduled, Airbnb Payments will collect the Total Price due at a later point in accordance with Section 5.3. Once the payment for your requested booking is successfully completed, you will receive a confirmation email.

2.6 Currency. Airbnb Payments will process each transaction in the currency you select via the Airbnb Platform. The currencies available to make payments may be limited for regulatory or operational reasons based on factors such as your selected Payment Method, your country of residence and/or your Airbnb Payments contracting entity(ies). Any such limitations will be communicated via the Airbnb Platform, and you will be prompted to select a different currency or Payment Method. Note that if your Airbnb Payments contracting entity’s location is different than the country of your Payment Method or your selected currency is different than your Payment Method's billing currency, your payment may be processed outside of your country of residence. As a result, certain fees may apply and the amount listed on your card statement may be different from the amount shown at checkout. For example, if you make a booking using a U.S. issued card, but select Euro as your currency, your payment may be processed outside the U.S., and banks and credit card companies may impose international transaction fees and foreign exchange fees. In addition, if you select to pay with a currency that is different than your Payment Method's billing currency, your bank or credit card company may convert the payment amount to your billing currency associated with your Payment Method, based on an exchange rate and fee amount determined solely by your bank. Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Please contact your bank or credit card company if you have any questions about these fees or the applicable exchange rate.

2.7 Booking Request Status. If a requested booking is declined either because it is not accepted by the Host or you cancel the booking request before it is accepted by the Host, any amounts collected by Airbnb Payments will be refunded to you, and any pre-authorization of your Payment Method will be released (if applicable). The timing to receive the refund or for the pre-authorization to be released will vary based on the Payment Method and any applicable payment system (e.g., Visa, MasterCard, etc.) rules.

2.8 Payment Restrictions. Airbnb Payments reserves the right to decline or limit payments that we believe (i) may violate Airbnb Payments’ risk management policies or procedures, (ii) may violate these Payments Terms or the Terms, (iii) are unauthorized, fraudulent or illegal; or (iv) expose you, Airbnb, Airbnb Payments, or others to risks unacceptable to Airbnb Payments.

2.9 Payment Service Providers. Payment Methods may involve the use of third-party payment service providers. These payment service providers may charge you additional fees when processing payments in connection with the Payment Services, and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Your Payment Method may also be subject to additional terms of use. Please review them before using your Payment Method.

2.10 Your Payment Method, Your Responsibility. Airbnb Payments is not responsible for any loss suffered by you as a result of incorrect Payment Method information provided by you.

2.11 Different Ways to Pay

2.11.1 Payment Plan

2.11.1.1 Airbnb Payments may make available to Guests the option to pay a portion of the booking’s Total Price at the time of booking and pay the remainder of the Total Price at a later time prior to check-in (“Payment Plan”). Availability of this option may depend on the Listing and/or Payment Method.

2.11.1.2 If you choose a Payment Plan, the Airbnb Platform will notify you during check out of the amount, currency and schedule of each payment due. On the following payments due date, Airbnb Payments will automatically charge the original Payment Method you used to make the booking.

2.11.1.3 If you make a modification to a booking made with a Payment Plan, Airbnb Payments will notify you of the revised payment schedule, as applicable. If the modification increases your Total Price, you may be required to make an additional partial payment of the new Total Price at the time of the modification.

2.11.1.4 You agree that by selecting a Payment Plan, you may not be able to pay for the booking with a different Payment Method or pursuant to a different payment schedule.

2.11.1.5 If Airbnb Payments is unable to collect your payment, Airbnb Payments will notify you of such declined payment, and require you to complete the payment using an alternative Payment Method within 72 hours of the notice. If you fail to complete the payment, you authorize Airbnb to cancel the booking on your behalf. If the booking is canceled, you will be refunded based on the Host’s cancellation policy. You acknowledge that you may incur fees for cancellations pursuant to the Host’s cancellation policy.

2.11.2 Recurring Payments

2.11.2.1 For certain bookings (such as for Accommodation bookings of twenty-eight (28) nights or more), Airbnb Payments may require a Guest to make recurring, incremental payments toward the Total Price owed (“Recurring Payments”). More information on Recurring Payments (including the amount and the frequency of payments) will be made available via the Airbnb Platform if applicable to a booking.

2.11.2.2 If Recurring Payments apply to a confirmed booking, then the Guest authorizes Airbnb Payments to collect the Total Price due.

2.11.2.3 Guests may stop a Recurring Payment by notifying Airbnb Payments orally or in writing at least three (3) business days before the scheduled date of the payment. Airbnb Payments may require you to give written confirmation of a stop-payment order within fourteen (14) days of an oral notification. If you fail to provide written confirmation within those fourteen (14) days, Airbnb Payments is not obligated to honor your request to stop any future Recurring Payments. If you have any questions regarding your Recurring Payments, please contact Airbnb Payments.

3. Host Terms

3.1 Payment Collection. Airbnb Payments generally collects the Total Price of a booking at the time the Guest’s booking request is accepted by the Host, unless noted otherwise.

3.2 Adding a Payout Method. In order to receive a Payout you must have a valid Payout Method linked to your Airbnb account. When you add a Payout Method to your Airbnb account, you will be asked to provide billing information such as name, billing address, and financial instrument information either to Airbnb Payments or its third-party payment processor(s). Depending on the Payout Method selected additional information may be required, such as: residential address, name on the account, account type, routing number, account number, email address, payout currency, identification number and account information associated with a particular payment processor. You authorize Airbnb Payments to collect and store your billing information and financial instrument information. Airbnb Payments may also share your information with governmental authorities as required by applicable law.

3.3 Timing of Payout

3.3.1 Subject to and conditional upon successful receipt of the payments from Guest, Airbnb Payments will generally initiate Payouts to your selected Payout Method: (i) for Accommodations, 24 hours after the Guest’s scheduled check-in time (or 24 hours after 3:00 pm local time - or 3:00 pm UTC if local time is unknown - if the check-in time is flexible or not specified); (ii) for Experiences, 24 hours after the start of the Experience; and (iii) for all other Host Services, at the time specified via the Airbnb Platform. For Accommodation bookings of twenty-eight (28) nights or more, Airbnb Payments will generally initiate the first payout 24 hours after the Guest’s scheduled check-in time, and will initiate future payouts every 30 days after the initial payout, for the duration of the reservation.

3.3.2 Airbnb Payments may offer you a different Payout time or trigger for payment, which may be subject to additional terms and conditions.The time it takes to receive Payouts once released by Airbnb Payments may depend upon the Payout Method you select.

3.4 Payout. Your Payout for a booking will be the Total Price less applicable fees like Airbnb service fees and applicable taxes. In the event of cancellation of a confirmed booking, Airbnb Payments will remit the amount you are due (if any) as provided in the Terms and applicable cancellation policy.

3.5 Payout Restrictions. Airbnb Payments may temporarily place a hold, suspend, or cancel any Payout for purposes of preventing unlawful activity or fraud, risk assessment, security, or completing an investigation; or if we are unable to verify your identity. Furthermore, Airbnb Payments may temporarily place a hold on, suspend, or delay initiating or processing any Payout due to you under the Terms as a result of high volume Booking cancellations or modifications arising from a Force Majeure Event (as defined below).

3.6 Currency Conversion. Airbnb Payments will remit your Payouts in the currency you select via the Airbnb Platform. The currencies available may be limited for regulatory or operational reasons based on factors such as your selected Payout Method, your country of residence, and/or your Airbnb contracting entity(ies). Any such limitations will be communicated via the Airbnb Platform, and you will be prompted to select a different currency or Payout Method. Note that payment service providers may impose transaction, currency conversion or other fees based on the currency or Payout Method you select, and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard.

3.7 Limits on Payouts. For compliance or operational reasons, Airbnb Payments may limit the amount of a Payout. If you are due an amount above that limit, Airbnb Payments may make a series of Payouts (potentially over multiple days) in order to provide your full Payout amount.

3.8 Payment Service Providers. Payout Methods may involve the use of third-party payment service providers. These service providers may charge you additional fees when processing Payouts in connection with the Payment Services (including deducting charges from the Payout amount), and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Your Payout Method may also be subject to additional terms of use. Please review them before using your Payout Method.

3.9 Your Payout Method, Your Responsibility. Airbnb Payments is not responsible for any loss suffered by you as a result of incorrect Payout Method information provided by you.

3.10 Different ways to get paid

3.10.1 Split Payouts

If you provide Host Services jointly with one or more other Hosts as part of a team, business or other organization (“Host Team”), Airbnb may make available to such Hosts the option to allocate between the members of the Host Team the total Host Payout for a booking. Airbnb Payments will execute such payments at the instruction of one or more members of the Host Team and is not responsible for any losses related to errors or omissions made by the Hosts in providing such payment instructions.

4. Appointment of Airbnb Payments as Limited Payment Collection Agent

4.1 Each Host, including each Host Team member, hereby appoints Airbnb Payments as the Host’s payment collection agent solely for the limited purpose of accepting and processing funds from Guests purchasing Host Services on the Host’s behalf.

4.2 Each Host, including each Host Team member, agrees that payment made by a Guest through Airbnb Payments, shall be considered the same as a payment made directly to the Host, and the Host will provide the Host Service booked by the Guest in the agreed-upon manner as if the Host has received the payment directly from the Guest. Each Host agrees that Airbnb Payments may refund the Guest in accordance with the Terms. Each Host understands that Airbnb Payments’ obligation to pay the Host is subject to and conditional upon successful receipt of the associated payments from Guest. Airbnb Payments guarantees payments to Host(s) only for such amounts that have been successfully received by Airbnb Payments from Guests in accordance with these Payments Terms. In accepting appointment as the limited payment collection agent of the Host, Airbnb Payments assumes no liability for any acts or omissions of the Host.

4.3 Each Guest acknowledges and agrees that, notwithstanding the fact that Airbnb Payments is not a party to the agreement between you and the Host(s), including each Host Team member, Airbnb Payments acts as each Host’s payment collection agent for the limited purpose of accepting payments from you on behalf of the Host(s). Upon a Guest’s payment of the funds to Airbnb Payments, the Guest’s payment obligation to the Host(s) for the agreed upon amount is extinguished, and Airbnb Payments is responsible for remitting the funds successfully received by Airbnb Payments to the Host(s) in the manner described in these Payments Terms. In the event that Airbnb Payments does not remit any such amounts, the Host(s) will have recourse only against Airbnb Payments and not the Guest directly.

5. General Terms

5.1 Fees. Airbnb Payments may charge fees for use of certain Payment Services and any applicable fees will be disclosed to you in the Terms or via the Airbnb Platform.

5.2 Payment Authorizations. You authorize Airbnb Payments to collect from you amounts due pursuant to these Payment Terms and/or the Terms by either (i) charging the Payment Method associated with the relevant booking, or any other Payment Method on file that you authorize in your Airbnb account (unless you have previously removed the authorization to charge such Payment Method(s)), or (ii) by withholding the amount from your future Payout. Specifically, you authorize Airbnb Payments to collect from you:

  • Any amount due to Airbnb or Airbnb Payments (e.g., as a result of your bookings, Booking Modifications, cancellations, or other actions as a Guest, Host or user of the Airbnb Platform), including reimbursement for costs prepaid by Airbnb or Airbnb Payments on your behalf. Any funds collected by Airbnb Payments will set off the amount owed by you to Airbnb or Airbnb Payments and extinguish your obligation to Airbnb or Airbnb Payments.
  • Any amount due to a Host from a Guest which Airbnb collects as the Host’s payment collection agent as further set out in Section 4 above.
  • Taxes, where applicable and as set out in the Terms.
  • Any amount you pay through the Resolution Center in connection with your Airbnb account.
  • Overstay penalties payable under the Terms, including any cost and expenses incurred in collecting the overstay penalty.
  • Any service fees or cancellation fees imposed pursuant to the Terms (e.g., if, as a Host, you cancel a confirmed booking).
  • Any amounts already paid to you as a Host despite a Guest cancelling a confirmed booking or Airbnb deciding that it is necessary to cancel a booking in accordance with the Terms, Guest Refund Policy, Experiences Guest Refund Policy, Extenuating Circumstances Policy, or other applicable cancellation policy. You agree that in the event you have already been paid, Airbnb Payments will be entitled to recover the amount of any such guest refund from you, including by subtracting such refund amount out from any future Payouts due to you.

In addition to any amount due as outlined above, if there are delinquent amounts or chargebacks associated with your Payment Method, you may be charged fees that are incidental to Airbnb Payments collection of these delinquent amounts and chargebacks. Such fees or charges may include collection fees, convenience fees or other third-party charges.

5.3 Collections

5.3.1 If Airbnb Payments is unable to collect any amounts you owe under these Payments Terms, Airbnb Payments may engage in collection efforts to recover such amounts from you.

5.3.2 Airbnb Payments will deem any owed amounts overdue when: (a) for authorized charges, one hundred and twenty (120) days have elapsed after Airbnb Payments first attempts to charge your Payment Method or the associated services have been provided, whichever is later; and (b) for withholdings from a Host’s future Payouts, two hundred and seventy (270) days have elapsed after the adjustment is made to the Host’s Airbnb account or the associated services have been provided, whichever is later.

5.3.3 Airbnb Payments will deem any overdue amounts not collected to be in default when three hundred and sixty five (365) days have elapsed: (a) for authorized charges, after Airbnb Payments first attempts to charge your Payment Method or the associated services have been provided, whichever is later; and (b) for withholdings from a Host’s future Payouts, after the adjustment is made to the Host’s Airbnb account or the associated services have been provided, whichever is later.

5.3.4 You hereby explicitly agree that all communications in relation to amounts owed will be made by electronic mail or by phone, as provided to Airbnb and/or Airbnb Payments by you. Such communications may be made by Airbnb, Airbnb Payments, or by anyone on their behalf, including but not limited to a third-party collection agent.

5.4 Payment Processing Errors

5.4.1 Airbnb Payments will take the necessary steps to rectify any payment processing errors that we become aware of. These steps may include crediting or debiting (as appropriate) the original Payout Method or Payment Method used or selected by you, so that you end up receiving or paying the correct amount. This may be performed by Airbnb Payments or a third party such as your financial institution. We may also take steps to recover funds sent to you in error (including but not limited to an event of duplicate payments made to you due to a processing error), by reducing, setting off and/or debiting the amount of such funds from any future Payouts owed to you.

5.4.2 To the extent you receive any funds in error, you agree to immediately return such funds to Airbnb Payments.

5.5 Refunds

5.5.1 Any refunds or credits due to a Member pursuant to the Terms, Extenuating Circumstances Policy, Guest Refund Policy, and Experiences Guest Refund Policy, will be initiated and remitted by Airbnb Payments in accordance with these Payments Terms.

5.5.2 Subject to this Section 5.5.2, Airbnb Payments will process refunds immediately, however, the timing to receive any refund will depend on the Payment Method and any applicable payment system (e.g., Visa, Mastercard, etc.) rules. In the event of a Force Majeure Event that may affect the processing and settlement of refunds, Airbnb Payments will initiate and process the refund as soon as is practicable.

6. Damage Claims and Security Deposits

6.1 If you as a Guest (i) agree to pay the Host in connection with a Damage Claim, or (ii) Airbnb determines that you are responsible for damaging any real or personal property at a Listing pursuant to the Terms, you authorize Airbnb Payments to charge the Payment Method used to make the booking in order to collect any security deposit associated with the Listing, as well as any fees, costs and/or expenses associated with the Damage Claim. If Airbnb Payments is unable to collect from the Payment Method used to make the booking, you agree that Airbnb Payments may charge any other Payment Method on file in your Airbnb account at the time of the Damage Claim (unless you have previously removed the authorization to charge such Payment Method(s))

6.2 You agree that Airbnb Payments may seek to recover from you under any insurance policies you maintain and that Airbnb Payments may also pursue against you any remedies it may have available, including, but not limited to, in relation to any payment requests made by Hosts under the Airbnb Host Guarantee.

7. Abandoned Property

If Airbnb Payments holds funds due to you (e.g., because we are unable to issue you a Payout or refund) or you do not use a gift card or gift credit for the relevant period of time set forth by your state, country, or other governing body in its unclaimed property laws, we may process the funds due to you in accordance with our legal obligations, including by reporting and escheating (sending) such funds to the appropriate governing body as required by applicable unclaimed property laws.

8. Prohibited Activities

8.1 You are solely responsible for compliance with any and all laws, rules, regulations, and tax obligations that may apply to your use of the Payment Services. In connection with your use of the Payment Services, you may not and you agree that you will not and will not assist or enable others to:

  • breach or circumvent any applicable laws or regulations;
  • breach or circumvent any agreements with third parties, third-party rights, or the Terms, Policies, or Standards;
  • use the Payment Services for any commercial or other purposes that are not expressly permitted by these Payments Terms;
  • register or use any Payment Method or Payout Method with your Airbnb account that is not yours or you do not have authorization to use;
  • avoid, bypass, remove, deactivate, impair, descramble, or otherwise circumvent any technological measure implemented by Airbnb Payments or any of Airbnb Payments’ providers or any other third party to protect the Payment Services;
  • take any action that damages or adversely affects, or could damage or adversely affect, the performance or proper functioning of the Payment Services;
  • attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Payment Services; or
  • violate or infringe anyone else’s rights or otherwise cause harm to anyone.

8.2 You may not use or assist others to use the Payment Services to send or receive funds: (i) into any United States embargoed countries; or (ii) to anyone on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Department of Commerce’s Denied Persons List or Entity List. You represent and warrant that: (i) neither you nor your Host Services are located or take place in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. In addition to complying with the above, you must also comply with any relevant export control laws in your local jurisdiction.

9. Force Majeure

Airbnb Payments shall not be liable for any delay or failure to fulfill any obligation under these Payments Terms resulting from causes outside the reasonable control of Airbnb or Airbnb Payments, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials (“Force Majeure Event”).

10. Disclaimers

10.1 If you choose to use the Payment Services, you do so voluntarily and at your sole risk. To the maximum extent permitted by law, the Payment Services are provided “as is”, without warranty of any kind, either express or implied.

10.2 Notwithstanding Airbnb Payments’ appointment as the limited payment collection agent of Hosts pursuant to Section 4, Airbnb Payments explicitly disclaims all liability for any act or omission of any Member or other third party. Airbnb Payments does not have any duties or obligations as agent for each Host except to the extent expressly set forth in these Payments Terms, and any additional duties or obligations as may be implied by law are, to the maximum extent permitted by applicable law, expressly excluded.

10.3 If we choose to conduct identity verification on any Member, to the extent permitted by applicable law, we disclaim warranties of any kind, either express or implied, that such checks will identify prior misconduct by a Member or guarantee that a Member will not engage in misconduct in the future.

10.4 The foregoing disclaimers apply to the maximum extent permitted by law. You may have other statutory rights or warranties which cannot lawfully be excluded. However, the duration of any statutorily required warranties shall be limited to the maximum extent (if any) permitted by law.

11. Liability

11.1 If you reside in the UK or Switzerland and contract with Airbnb Payments UK you acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of your access to and use of the Payment Services remains with you. If you permit or authorize another person to use your Airbnb account in any way, you are responsible for the actions taken by that person. Neither Airbnb Payments nor any other party involved in creating, producing, or delivering the Payment Services will be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Payments Terms, (ii) from the use of or inability to use the Payment Services, or (iii) from any communications, interactions, or meetings with other Members or other persons with whom you communicate, interact, transact, or meet with as a result of your use of the Payment Services, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not Airbnb Payments has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose. Except for our obligations to pay amounts to applicable Hosts pursuant to these Payments Terms or an approved payment request under the Airbnb Host Guarantee, in no event will Airbnb Payments’ aggregate liability arising out of or in connection with these Payments Terms and your use of the Payment Services including, but not limited to, from your use of or inability to use the Payment Services, exceed (i) the amounts you have paid or owe for bookings via the Airbnb Platform as a Guest in the twelve (12) month period prior to the event giving rise to the liability, or if you are a Host, the amounts paid by Airbnb Payments to you in the twelve (12) month period prior to the event giving rise to the liability, or (ii) one hundred U.S. dollars (US$100), if no such payments have been made, as applicable. The limitations of damages set forth above are fundamental elements of the basis of the bargain between Airbnb Payments and you. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. If you reside outside of the U.S., this does not affect Airbnb Payments’ liability for death or personal injury arising from its negligence, nor for fraudulent misrepresentation, misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.

11.2 If you reside in the EEA and contract with Airbnb Payments Luxembourg, Section 11.1 does not apply, and Airbnb Payments is liable under statutory provisions for intent and gross negligence by us, our legal representatives, directors, or other vicarious agents. The same applies to the assumption of guarantees or any other strict liability, or in case of a culpable injury to life, limb, or health. Airbnb Payments is liable for any negligent breaches of essential contractual obligations by us, our legal representatives, directors, or other vicarious agents; such liability is limited to the typically occurring foreseeable damages. Essential contractual obligations are such duties of Airbnb Payments in whose proper fulfillment you regularly trust and must trust for the proper execution of the contract. Any additional liability of Airbnb Payments is excluded to the maximum extent allowed by applicable law.

12. Indemnification

To the maximum extent permitted by applicable law, you agree to release, defend (at Airbnb Payments’ option), indemnify, and hold Airbnb Payments and its affiliates and subsidiaries, and their officers, directors, employees, and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your breach of these Payments Terms; (ii) your improper use of the Payment Services; (iii) your failure, or our failure at your direction, to accurately report, collect or remit taxes; or (iv) your breach of any laws, regulations, or third-party rights. If your country of residence is in the EEA, the indemnification obligation according to this Section 12 only applies if and to the extent that the claims, liabilities, damages, losses, and expenses have been adequately caused by your culpable breach of a contractual obligation.

13. Modification, Term, Termination, and other Measures

13.1 Modification. Except as otherwise required by applicable law, Airbnb Payments may modify these Payments Terms at any time. If we make material changes to these Payments Terms, we will post the revised Payments Terms on the Airbnb Platform and update the “Last Updated” date at the top of these Payments Terms. If you are affected by the modification, we will also provide you with notice of the modification at least two (2) months before the date they become effective. If you do not terminate your agreement before the date the revised Payments Terms become effective, your continued use of the Payment Services will constitute acceptance of any changes to the revised Payments Terms.

13.2 Term. This agreement between you and Airbnb Payments reflected by these Payments Terms is effective when you create an Airbnb account or use the Payment Services and remains in effect until either you or we terminate this agreement in accordance with Section 13.3.

13.3 Termination. You may terminate this agreement at any time by sending us an email or by deleting your Airbnb account. Terminating this agreement will also serve as notice to cancel your Airbnb account pursuant to the Terms. Without limiting our rights specified below, Airbnb Payments may terminate this agreement for convenience at any time by giving you two (2) months’ prior notice. Airbnb Payments may also terminate this agreement immediately without notice if (i) you have materially breached your obligations under this agreement; (ii) you have provided inaccurate, fraudulent, outdated, or incomplete information; (iii) you have violated applicable laws, regulations, or third-party rights; or (iv) Airbnb Payments believes in good faith that such action is reasonably necessary to protect other Members, Airbnb, Airbnb Payments, or third parties.

13.4 Suspension and Other Measures. Airbnb Payments may limit or temporarily or permanently suspend your use of or access to the Payment Services (i) to comply with applicable law, or the order or request of a court, law enforcement, or other administrative agency or governmental body, (ii) if you have breached these Payments Terms, the Terms, applicable laws, regulations or third-party rights, (iii) if you have provided inaccurate, fraudulent, outdated, or incomplete information regarding a Payment Method or Payout Method, (iv) for any amounts you owe under these Payments Term that are overdue or in default, or (v) if Airbnb Payments believes in good faith that such action is reasonably necessary to protect the personal safety or property of Airbnb, its Members, Airbnb Payments, or third parties, or to prevent fraud or other illegal activity. Further, for unsuccessful payment due to card expiration, insufficient funds, or otherwise, we may temporarily suspend your access to the Payment Services until we can charge a valid Payment Method.

13.5 Appeal. If Airbnb Payments takes any of the measures described in Section 13.3 and 13.4 you may appeal such a decision by contacting customer service.

13.6 Effect of Termination. If you cancel your Airbnb account as a Host or Airbnb Payments takes any of the measures described above, Airbnb Payments may provide a full refund to any Guests with confirmed booking(s), and you will not be entitled to any compensation for pending or confirmed bookings that were cancelled. If you cancel your Airbnb account as a Guest, Airbnb Payments will initiate a refund for any confirmed booking(s) based on the Listing’s cancellation policy. If your access to or use of the Payment Services has been suspended or limited or this agreement has been terminated by us, you may not register a new Airbnb account or attempt to access and use the Payment Services through an Airbnb account of another Member.

13.7 Survival. Unless your country of residence is in the EEA, Sections 5 through 20 of these Payments Terms shall survive any termination or expiration of this agreement.

14. Governing Law and Dispute Resolution

14.1 If you are contracting with Airbnb Payments UK, these Payments Terms will be interpreted in accordance with English law. If you are acting as a consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of English law. As a consumer, you may bring any judicial proceedings relating to these Payments Terms before the competent court of your place of residence or a court in England. If Airbnb wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the English courts.

14.2 If you are contracting with Airbnb Payments Luxembourg, these Payments Terms will be interpreted in accordance with Luxembourg law. If you are acting as a consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of Luxembourg law. As a consumer, you may bring any judicial proceedings relating to these Payments Terms before the competent court of your place of residence or a court in Luxembourg. If Airbnb wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the Luxembourg courts.

15. United States Arbitration Agreement

15.1 Application. This Arbitration Agreement only applies to you if you are contracting with Airbnb Payment US. If you are not contracting with Airbnb Payments US, and you nevertheless attempt to bring any legal claim against Airbnb Payments in the United States, this Arbitration Agreement will apply for determination of the threshold issue of whether this Section 15 applies to you, and all other threshold determinations, including residency, arbitrability, venue, and applicable law.

15.2 Overview of Dispute Resolution Process. Airbnb Payments is committed to participating in a consumer-friendly dispute resolution process. To that end, these Payments Terms provide for a two-part process for individuals to whom this Section 15 applies: (1) an informal negotiation directly with Airbnb’s customer service team (described in paragraph 15.3, below), and if necessary (2) a binding arbitration administered by the American Arbitration Association (“AAA”). You and Airbnb Payments each retain the right to seek relief in small claims court as an alternative to arbitration.

15.3 Mandatory Pre-Arbitration Dispute Resolution and Notification. At least 30 days prior to initiating an arbitration, you and Airbnb Payments each agree to notify the other party of the dispute in writing and attempt in good faith to negotiate an informal resolution. You must send your notice of dispute to Airbnb Payments by mailing it to Airbnb Payments’ agent for service: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833. Airbnb Payments will send its notice of dispute to the email address associated with your Airbnb account. A notice of dispute must include: the party’s name and preferred contact information, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written Demand for Arbitration (available at www.adr.org) with the AAA and providing a copy to the other party as specified in the AAA Rules (available at www.adr.org).

15.4 Agreement to Arbitrate. You and Airbnb Payments mutually agree that any dispute, claim or controversy arising out of or relating to these Payments Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of the Payment Services (collectively, “Disputes”) will be settled by binding individual arbitration (the “Arbitration Agreement”). If there is a dispute about whether this Arbitration Agreement can be enforced or applies to our Dispute, you and Airbnb Payments agree that the arbitrator will decide that issue.

15.5 Exceptions to Arbitration Agreement. You and Airbnb Payments each agree that the following causes of action and/or claims for relief are exceptions to the Arbitration Agreement and will be brought in a judicial proceeding in a court of competent jurisdiction (as defined by Section 15): (i) any claim or cause of action seeking emergency injunctive relief based on exigent circumstances (e.g., imminent danger or commission of a crime, hacking, cyber-attack); or (ii) a request for the remedy of public injunctive relief. You and Airbnb Payments agree that the remedy of public injunctive relief will proceed after the arbitration of all arbitrable claims, remedies, or causes of action, and will be stayed pending the outcome of the arbitration pursuant to section 3 of the Federal Arbitration Act.

15.6 Arbitration Rules and Governing Law. This Arbitration Agreement evidences a transaction in interstate commerce and the Federal Arbitration Act governs all substantive and procedural interpretation and enforcement of this provision. The arbitration will be administered by AAA in accordance with the Consumer Arbitration Rules and/or other AAA arbitration rules determined to be applicable by the AAA (the “AAA Rules”) then in effect, except as modified here. The AAA Rules are available at www.adr.org. In order to initiate arbitration, a completed written demand (available at www.adr.org) must be filed with the AAA and provided to the other party, as specified in the AAA rules.

15.7 Modification to AAA Rules - Arbitration Hearing/Location. In order to make the arbitration most convenient to you, Airbnb Payments agrees that any required arbitration hearing may be conducted, at your option: (a) in the U.S county where you reside; (b) in San Francisco County; (c) via phone or video conference; or (d) if all parties agree, by solely the submission of documents to the arbitrator.

15.8 Modification of AAA Rules - Attorney’s Fees and Costs. Your arbitration fees and your share of arbitrator compensation shall be governed by the AAA Rules and, where appropriate, limited by the AAA Consumer Rules. If such costs are determined by the arbitrator to be excessive, Airbnb Payments will pay all arbitration fees and expenses. Either party may make a request that the arbitrator award attorneys’ fees and costs upon proving that the other party has asserted a claim, cross-claim or defense that is groundless in fact or law, brought in bad faith or for the purpose of harassment, or is otherwise frivolous, as allowed by applicable law and the AAA Rules.

15.9 Arbitrator’s Decision. The arbitrator’s decision will include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court with proper jurisdiction. The arbitrator may award any relief allowed by law or the AAA Rules, but declaratory or injunctive relief may be awarded only on an individual basis and only to the extent necessary to provide relief warranted by the claimant’s individual claim.

15.10 Jury Trial Waiver. You and Airbnb Payments acknowledge and agree that we are each waiving the right to a trial by jury as to all arbitrable Disputes.

15.11 No Class Actions or Representative Proceedings. You and Airbnb Payments acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate as a plaintiff or class member in any purported class action lawsuit, class-wide arbitration, private attorney general action, or any other representative or consolidated proceeding. Unless we agree in writing, the arbitrator may not consolidate more than one party’s claims and may not otherwise preside over any form of any class or representative proceeding. If there is a final judicial determination that applicable law precludes enforcement of the waiver contained in this paragraph as to any claim, cause of action or requested remedy, then that claim, cause of action or requested remedy, and only that claim, cause of action or requested remedy, will be severed from this agreement to arbitrate and will be brought in a court of competent jurisdiction. In the event that a claim, cause of action or requested remedy is severed pursuant to this paragraph, then you and we agree that the claims, causes of action or requested remedies that are not subject to arbitration will be stayed until all arbitrable claims, causes of action and requested remedies are resolved by the arbitrator.

15.12 Severability. Except as provided in Section 15.11, in the event that any portion of this Arbitration Agreement is deemed illegal or unenforceable, such provision shall be severed and the remainder of the Arbitration Agreement will be given full force and effect.

15.13 Changes to Agreement to Arbitrate. If Airbnb Payments changes this Section 15 after the date you last accepted these Payments Terms (or accepted any subsequent changes to these Payments Terms), you may reject that change by sending us written notice (including by email) within thirty (30) days of the date the change is effective. Rejecting a new change, however, does not revoke or alter your prior consent to any earlier agreements to arbitrate any Dispute between you and Airbnb Payments (or your prior consent to any subsequent changes thereto), which will remain in effect and enforceable as to any Dispute between you and Airbnb Payments.

15.14 Survival. Except as provided in Section 15.12 and subject to Section 13.7, this Section 15 will survive any termination of these Payments Terms and will continue to apply even if you stop using the Payment Services or terminate your Airbnb account.

16. Miscellaneous

16.1 Interpreting these Payments Terms. Except as they may be supplemented by additional terms and conditions, policies, guidelines, or standards, these Payments Terms constitute the entire agreement between Airbnb Payments and you regarding the subject matter hereof, and supersede any and all prior oral or written understandings or agreements between Airbnb Payments and you regarding the Payment Services. If any provision of these Payments Terms is held to be invalid or unenforceable, such provision will be struck and will not affect the validity and enforceability of the remaining provisions.

16.2 No Waiver. Airbnb Payments’ failure to enforce any right or provision in these Payments Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. Except as expressly set forth in these Payments Terms, the exercise by either party of any of its remedies under these Payments Terms will be without prejudice to its other remedies under these Payments Terms or otherwise permitted under law.

16.3 Assignment. You may not assign, transfer, or delegate this agreement or your rights and obligations hereunder without Airbnb Payments’ prior written consent. Airbnb Payments may without restriction assign, transfer, or delegate this agreement and any rights and obligations, at its sole discretion, with two (2) months’ prior notice.

16.4 Notices. Unless specified otherwise, any notices or other communications permitted or required under this agreement, will be in writing and given by Airbnb Payments via email or Airbnb Platform notification, and depending on your notification setting, messaging service (including SMS and WeChat). The date of receipt will be deemed the date on which Airbnb Payments transmits the notice.

16.5 Language. If you are contracting with Airbnb Payments Luxembourg, this agreement is concluded in the language as applied by the Terms and all communication undertaken during this contractual relationship shall be made in that language.

17. Additional Clauses for Users Contracting with Airbnb Payments UK

The following paragraphs will apply if you are contracting with Airbnb Payments UK:

17.1 Payment Service User

17.1.1 The Payment Services include the payment collection service provided to Hosts contracting with Airbnb Payments UK. The payment collection service constitutes a “payment service” regulated under the Payment Services Regulations and for these purposes Airbnb Payments UK treats Hosts as the “payment service user.”

17.1.2 By agreeing to these Payments Terms you as a Host have consented to Airbnb Payments UK’s payment of each Payout to your chosen Payout Method. Hosts may change a Payout Method up to one (1) day before the time agreed for the Payout as set out in Section 3.3. Airbnb Payments UK will be deemed to have received the Host's payment order to the Host on the same date Airbnb Payments UK agrees to initiate the Payout in accordance with Section 3.3

17.1.3 Airbnb Payments UK will endeavor to ensure that Hosts based in the UK will receive each Payout by the end of the business day following Airbnb Payments UK’s initiation of the Payout.

17.1.4 Communication. Airbnb Payments will provide the Host notice via email when we initiate each Payout. We will also provide notice to a Host’s registered email address if the Payout is returned to us because of an error. It is your responsibility as a Host to ensure that you provide us with a current, accurate, and valid email address.

17.2 Resolution Procedures for Diverted Payouts

17.2.1 If you as a Host believe that a Payout properly due to you has been or may be diverted without your permission (“Diverted Payout”) because your password or other credentials to log into your Airbnb account (“Credentials”) are lost or stolen, you should notify Airbnb Payments UK pursuant to Section 20 immediately. As a Host you may be liable for losses relating to any Diverted Payout arising from the use of lost, stolen, or misappropriated Credentials (including the loss of a mobile phone on which you have installed the Application) or where you have failed to keep your Credentials safe, up to a maximum of £50. Provided that you notify us of any Diverted Payout without delay and at the very latest within 13 months of the date of the payment, you may be entitled to a refund of that payment.

17.2.2 We will not be liable for any loss arising from: (i) Diverted Payouts where you acted fraudulently or where, with intent or gross negligence, you failed to use the Airbnb Platform and/or Payment Services in accordance with the Terms or these Payments Terms (including the obligation to keep your Credentials safe); (ii) or any payout transaction which we facilitated in accordance with information provided by you where the information you provided was incorrect.

17.2.3 If you as Host claim not to have received a Payout properly due to you via your chosen Payout Method, Airbnb Payments UK will (if requested) make immediate efforts to trace the payment and will notify you of the outcome. Unless we can prove that the payment was received by you via your chosen Payout Method, we will refund the amount.

17.2.4 Any complaints about the Payment Services should be made to Airbnb Payments UK pursuant to Section 20. Complaints that are made in accordance with this section that relate to the provision of Payment Services by Airbnb Payments UK will be eligible for referral to the Financial Ombudsman and will be subject to the Rules of the Financial Ombudsman Service. The UK Financial Ombudsman Service offers a free complaints resolution service to individuals, micro-enterprises, small charities, and trustees of small trusts. You can contact the UK Financial Ombudsman by (i) telephone from inside the UK: 0300 123 9123 or 0800 023 4567; from other countries: +44 20 7964 0500, on Monday to Friday, 8am to 8pm and on Saturday 9am to 1pm; (ii) post: South Quay Plaza, 183 Marsh Wall, London E14 9SR; or (iii) email: enquiries@financial-ombudsman.org.uk. The UK Financial Ombudsman Service is also available in a number of different languages and if you need it you will be put in touch with a translator when you contact the UK Financial Ombudsman Service.

18. Additional Clauses for Users Contracting with Airbnb Payments Luxembourg

The following paragraphs will apply if you are contracting with Airbnb Payments Luxembourg:

18.1 Payment Service User

18.1.1 The Payment Services include the payment service provided to Hosts contracting with Airbnb Payments Luxembourg. The Payment Services constitute “payment services” regulated under the modified Law of 10 November 2009 on payment services (“Law of 2009”) and for these purposes Airbnb Payments Luxembourg treats Hosts as the “payment service user” according to the Law of 2009.

18.1.2 By agreeing to these Payments Terms you as Host have consented to Airbnb Payments Luxembourg’s payment of each Payout to your chosen Payout Method. Hosts may change a Payout Method up to one (1) day before the time agreed for the Payout as set out in Section 3.3. Airbnb Payments Luxembourg will be deemed to have received the Host's payment order to the Host on the same date Airbnb Payments Luxembourg agrees to initiate the Payout in accordance with Section 3.3.

18.1.3 In the relation between you and Airbnb Payments Luxembourg, the legal provisions relating to the form of and procedure for giving consent to the initiation of a payment order or the execution of a payment transaction and the withdrawal of such consent such as Articles 81 and 93 of the Law 2009 on payment services shall apply at any time.

18.1.4 Airbnb Payments Luxembourg will endeavor to ensure that Hosts based in the EEA will receive each Payout by the end of the business day following Airbnb Payments Luxembourg’s initiation of the Payout.

18.1.5 Communication. Airbnb Payments will provide the Host notice via email when we initiate each Payout. We will also provide notice to a Host’s registered email address if the Payout is returned to us because of an error. It is your responsibility as a Host to ensure that you provide us with a current, accurate, and valid email address.

18.2 Resolution Procedures for Diverted Payouts

18.2.1 If you as a Host believe that a Payout is a Diverted Payout because your Credentials are lost or stolen or in case of an unauthorized, incorrectly initiated or incorrectly executed payment transaction, you should notify Airbnb Payments Luxembourg pursuant to Section 20 immediately. As a Host you may be liable for losses relating to any Diverted Payout arising from the use of lost, stolen, or misappropriated Credentials (including the loss of a mobile phone on which you have installed the Application) or where you have failed to keep your Credentials safe, up to a maximum of 50€. Provided that you notify us of any Diverted Payout without delay and at the very latest within 13 months following the debit date, you may be entitled to a refund of that payment.

18.2.2 We will not be liable for any loss arising from: (i) Diverted Payouts where you acted fraudulently or where, with intent or gross negligence, you failed to use the Airbnb Platform and/or Payment Services in accordance with the Terms or these Payments Terms (including the obligation to keep your Credentials safe); (ii) or any payout transaction which we facilitated in accordance with information provided by you where the information you provided was incorrect.

18.2.3 If you as Host claim not to have received a Payout properly due to you via your chosen Payout Method, Airbnb Payments Luxembourg will (if requested) make immediate efforts to trace the payment and will notify you of the outcome. Unless we can prove that the payment was received by you via your chosen Payout Method, we will refund the amount.

18.3 Out-of-court complaints

Any complaint, namely relating to any loss, theft, misappropriation or unauthorized use in connection with the Payment Services, or unauthorized or erroneous transactions should be made in writing to Airbnb Payments Luxembourg pursuant to Section 20.

In case you did not receive an answer or a satisfactory answer from Airbnb Payments Luxembourg within one month from the date the complaint was sent, you may file your request with the supervisory authority of Airbnb Payments Luxembourg, the CSSF (as defined in Section 20) within one year after you filed your complaint with Airbnb Payments Luxembourg. The CSSF will act as an out-of-court complaint resolution body. The request must be filed with the CSSF in writing, by post or by fax to the CSSF or by email to the address/number available on the CSSF website, or online on the CSSF website. The request shall be filed in English, French, German or Luxembourgish. The request shall be supported by a statement of the reasons on which it is based together with the following documents:

  • a detailed and chronological statement of the facts underlying the complaint and the steps already taken by you;
  • a copy of the prior complaint made to Airbnb Payments Luxembourg;
  • a copy of the answer to the prior complaint or the confirmation that you did not receive an answer one month after you sent your prior complaint;
  • the statement that you did not refer the matter to a court, an arbitrator or another out-of-court complaint resolution body in Luxembourg or abroad;
  • your agreement with the request handling conditions of the CSSF as body responsible for the out-of-court resolution of your complaint;
  • your express authorization so that the CSSF can transmit its request (including the attachments) as well as any future correspondence or information to Airbnb Payments Luxembourg;
  • in the case where a person acts on your behalf, a document showing that the person is legally entitled to act so; and
  • a copy of your valid ID document.

18.4. For Guests with France As Country of Residence.

Notwithstanding anything to the contrary in the Payments Terms, for the avoidance of any doubt, in connection with Guests who reside in France, the Total Price, installments or periodic payments, including Recurring Payments, collected by Airbnb Payments from such Guest are down payments (“acomptes”) within the meaning of French law.

18.5 Outsourcing.

We use a variety of service providers (some belonging to the Airbnb group and some being third party service providers) in the context of outsourcing arrangements to help us provide our services in an efficient and qualitative manner. The use of such service providers requires that we transfer or make available some data to them. You agree to such outsourcing arrangements and instruct us to transfer or make accessible data (as further defined below) concerning you and, where relevant, concerning persons linked to you (provided in connection with your Airbnb account) such as your beneficial owners and representatives, to a number of service providers in the context of outsourcing arrangements regarding technical (including IT), operational, payment processing, internal control, customer due diligence (including background or police checks), fraud prevention, risk assessment, product development, maintenance and debugging, advertising, processing of insurance claims, customer support and other services. The data to be transferred or made available includes, if you are an individual, your surname, first name, address, date and place of birth and nationality, and if you are a legal entity your corporate name, registered office, legal form, registration number for legal entities, as well as the aforementioned data on individuals for your beneficial owners and representatives. The data to be transferred or made available includes also for any person its contact details such as phone numbers and e-mail addresses as well as financial data and usage data in relation to our services (including payment method, payout method, payment transaction). The recipients of the data are located in the United States, the United Kingdom, Ireland, India, Luxembourg, Netherlands, Germany and Spain, as well as other countries in Europe, Asia Pacific and North and South America. Such data transfers will take place throughout the term of the business relationship between us and you as well as for an additional period as permitted by law after the end of the business relationship. You acknowledge that the transferred data is no longer protected by Luxembourg professional secrecy after its transfer.

19. Additional Clauses for Users that are Businesses

The following paragraphs also apply if you are using the Payment Services as a representative (“Representative”) acting on behalf a business, company or other legal entity (in such event, for purposes of the Payments Terms, “you” and “your” will refer and apply to that business, company or other legal entity).

19.1 You accept the Payments Terms and you will be responsible for any act or omission of employees or third-party agents using the Payment Service on your behalf.

19.2 You and your Representative individually affirm that you are authorized to provide the information described in Section 2.1 and Section 3.2 and your Representative has the authority to bind you to these Payments Terms. We may require you to provide additional information or documentation demonstrating your Representative’s authority.

19.3 You represent and warrant to us that: (i) you are duly organized, validly existing and in good standing under the laws of the country in which your business is registered and that you are registering for receiving the Payment Services; and (ii) you have all requisite right, power, and authority to enter into this agreement, perform your obligations, and grant the rights, licenses, and authorizations in this agreement.

19.4 If you are using your Payment Method for the benefit of your employees or other authorized third-party in connection with Airbnb for Work, as permitted by your account, you authorize Airbnb Payments to charge your Payment Method for bookings requested by employees at your company or other permitted third-party.

19.5 For any Payout Method linked to your Airbnb account, you authorize Airbnb Payments to store the Payout Method, remit payments using the Payout Method for bookings associated with your Airbnb account and take any other action as permitted in the Payments Terms in respect of the Payout Method.

19.6 If you handle, store or otherwise process payment card information on behalf of anyone or any third-party, you agree to comply on an ongoing basis with applicable data privacy and security requirements under the current Payment Card Industry Data Security Standard with regards to the use, access, and storage of such credit card information. Payments Terms of Service for Australian Users

If your country of residence or establishment is within Australia, these Payments Terms for Australian Users (“Payments Terms”) are subject to the Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law and other Australian laws. These Payments Terms (including clauses 10.1, 10.2, 11 and 12) apply to the maximum extent permitted by Australian law, including the Australian Consumer Law.

If you attempt to bring any legal claim against Airbnb Payments in the United States, the arbitration agreement and class actions waiver in Section 15 apply to you. Please read them carefully.

The Airbnb Terms of Service (“Terms”) govern your use of the Airbnb Platform. Capitalized terms not defined in these Payments Terms have the meaning ascribed to them in the Terms

These Payments Terms and the documents, policies and standards referred within them, form a binding legal agreement between you and Airbnb Payments that govern the Payment Services (defined below) conducted through or in connection with the Airbnb Platform.

Documents referred to within these Payments Terms include but are not limited to our:

  • Terms of Service, which govern your right to use the websites, applications, and other offerings from Airbnb (collectively, the “Airbnb Platform”).
  • Re-booking and Refund Policy, which explains how Airbnb will assist with rebooking a reservation and how Airbnb handles refunds when a Host cancels a reservation or another Travel Issue disrupts a stay.
  • Experiences Guest Refund Policy, which explains how refunds are handled for Experiences when a Host cancels or a Travel Issue occurs.
  • Extenuating Circumstances Policy, which explains how cancellations are handled when unforeseen events beyond your control arise after booking and make it impractical or illegal to complete your Reservation.
  • Host Damage Protection Policy, which explains the terms, exclusions and limitations under which Airbnb will agree to pay a Host to repair or replace Covered Property as a result of a Covered Loss.
  • Community Policies, which sets out expectations of Members of the Airbnb Community.
  • Content Policy, which governs the posting by Members of content on the Airbnb Platform.

For convenience, we have set out above several terms and policies that are referred to in these Payments Terms. However, it is important to note that there are other supplemental policies and terms linked from our Additional Legal Terms page, which apply to your use of the Airbnb Platform, and are incorporated by reference, and also form part of the binding legal agreement between you and Airbnb.

Our terms and policies are organized based on the topic(s) to which they relate so as to make it easy for you to find the terms or policy relevant to your query or event.

When these Payments Terms mention “Airbnb Payments,” “we,” “us,” or “our,” it refers to:

Airbnb Payments UK Ltd. (“Airbnb Payments UK”), except when you book a Host Service, in which case you are contracting with Airbnb Payments Australia Pty Ltd (“Airbnb Payments Australia”).

Airbnb Payments provides payments services to Members publishing, offering and booking Accommodations, Experiences or other Host Services, including services in connection with the Open Homes Program and other current and future services provided via the Airbnb Platform. These payment services are provided for the benefit of Hosts and may include (if available) the following (collectively, “Payment Services”):

  • Collecting payments from Guests (“Payin”), by charging the payment method provided by the Guest or associated with their Airbnb account, such as credit card, debit card, bank account, PayPal account, digital wallet or installments product provided by a credit provider (“Payment Method”);
  • Effecting payments to Hosts (“Payout”) to a financial instrument associated with their Airbnb account, such as a PayPal account, bank account, a prepaid card, or a debit card (“Payout Method”);
  • Effecting payments to a third-party Payout Method designated by a Host;
  • Collection and payment of charitable donations;
  • Payment collection services; and
  • Other payment related services in connection with Host Services.

Airbnb Payments provides regulated Payment Services only to Hosts as the Host’s limited payment collection agent by accepting and processing funds from Guests purchasing Host Services on the Host’s behalf.

In order to use the Payment Services, you must be at least 18 years old, must have an Airbnb account in good standing in accordance with the Terms, and must keep your payment and personal information accurate and complete and provide us with identity and other information as requested by us.

If you change your country of residence, the Airbnb company you contract with and the applicable version of the Payments Terms will be determined by your new country of residence from the date on which your country of residence changes. By continuing to use the Payment Services after your change of country of residence, you agree to such change of contracting party and terms. Please note, however, that the Airbnb Payments company with whom you contract will stay the same for all bookings made prior to your change of residence.

1. Your use of the Payment Services

1.1 Airbnb Payment Services. By using the Payments Services, you agree to comply with these Payments Terms. Airbnb Payments may temporarily limit or suspend your access to or use of the Payment Services, or its features, to carry out maintenance measures that ensure the proper functioning of the Payment Services.

1.2 Third Party Services. The Payment Services may contain links to third-party websites or resources (“Third-Party Services”). Such Third-Party Services are subject to different terms of service and privacy policies, and Members should review them. Airbnb Payments is not responsible or liable for the use of such Third-Party Services. Links to any Third-Party Services are not an endorsement by Airbnb Payments of those Third-Party Services.

1.3 Your Airbnb Account. Airbnb Payments may enable features that allow you to authorize other Members or third parties to take certain actions that affect your Airbnb account. You may authorize a third party to use your Airbnb account if the feature is enabled for your Airbnb account. You acknowledge and agree that anyone you authorize to use your Airbnb account may use the Payment Services on your behalf and that you will be responsible for any payments made by such person.

1.4 Identification and Verification. You authorize Airbnb Payments, directly or through third parties, to make any inquiries we consider necessary to verify your identity and information you provide, and if applicable, verifying the identity of the representative(s) and beneficial owner(s). This may include (i) screening you and, if applicable, your representative(s) and beneficial owner(s) against third-party databases or other sources, (ii) requesting reports from service providers, (iii) asking you and, if applicable, your representative(s) and beneficial owner(s) to provide a form of government identification (e.g., driver’s license or passport) to check your name, place and date of birth, your address, nationality and/or other information which we deem necessary under applicable laws. If you are providing information for identification and verification about your representative(s) and/or beneficial owner(s) on their behalf, by providing such information, you are confirming that you have the authority and requisite rights to provide their information (including consent, where applicable) to Airbnb Payments for Airbnb Payments to carry out the purposes set out in this Section 1.4; or (iv) requiring you to take steps to confirm ownership of your email address, Payment Method(s) or Payout Method(s). Airbnb Payments reserves the right to terminate, suspend, or limit access to the Payment Services in the event we are unable to obtain or verify any of this information.

1.5 Additional Terms. Your access to or use of certain Payment Services may be subject to you first having to agree to or to accept (expressly or by conduct) additional terms and conditions, including those of third party providers of Payment Services. If there is a conflict between these Payments Terms and terms and conditions applicable to a specific Payment Service, the terms and conditions applicable to the specific Payment Service will take precedence with respect to your use of or access to that Payment Service, unless specified otherwise in the terms and conditions applicable to the specific Payment Service.

2. Guest Terms

2.1 Adding a Payment Method. When you add a Payment Method to your Airbnb account, you will be asked to provide billing information such as name, billing address, and financial instrument information either to Airbnb Payments or its third-party payment processor(s). You authorize Airbnb Payments and its payment processor(s) to collect and store your Payment Method information in accordance with Airbnb’s privacy policy.

2.2 Payment Method Verification. When you add or use a new Payment Method, Airbnb Payments may verify the Payment Method by (i) authorizing your Payment Method for one or two nominal amounts via a payment service provider, and asking you to confirm those amounts, or (ii) requiring you to upload a billing statement. We may, and retain the right to, initiate refunds of these amounts from your Payment Method. When you add a Payment Method during checkout, we will automatically save and add that Payment Method to your Airbnb account so it can be used for a future transaction. You may not remove the Payment Method associated with a reservation, during the period commencing from the date of your booking and ending fourteen (14) days following your check-out date, nor during any additional period of time needed to resolve any outstanding Damage Claim associated with such booking.

2.3 Payment Authorization. You allow Airbnb Payments to charge your Payment Method (including charging more than one Payment Method), either directly or indirectly, for all fees and other amounts due (including any applicable taxes) in connection with your Airbnb account, including Damage Claim amounts in accordance with the Terms and with Sections 5 and 6.

2.4 Automatic Update of Payment Method. If your Payment Method’s account information changes (e.g., account number, routing number, expiration date or CVV or CVC number) as a result of re-issuance or otherwise, we may acquire that information from our financial services partners or your bank and automatically update your Payment Method on file.

2.5 Timing of Payment. Airbnb Payments generally charges the Total Price due after the Host accepts your booking request. However, if you pay with a push Payment Method (such as Sofort), Airbnb Payments will collect the Total Price due at the time of your booking request or after the Host accepts your booking request. Airbnb may offer alternative options for the timing and manner of payment. Any additional fees for using those alternative payment options will be displayed via the Airbnb Platform and included in the Total Price, and you agree to pay such fees by selecting the payment option. Additional terms and conditions may apply for the use of an alternative payment option. If Airbnb Payments is unable to collect the Total Price due, as scheduled, Airbnb Payments will collect the Total Price due at a later point in accordance with Section 5.3. Once the payment for your requested booking is successfully completed, you will receive a confirmation email.

2.6 Currency.

    2.6.1 You are able to select your currency in your settings. The currencies available to make payments may be limited for regulatory or operational reasons based on factors such as your selected Payment Method, your country of residence and/or your Airbnb Payments contracting entity(ies). Any such limitations will be communicated via the Airbnb Platform, and you will be prompted to select a different currency or Payment Method if your preferred currency is not available.

    2.6.2. Note that if the country in which your Airbnb Payments contracting entity is located is different from the country of your Payment Method provider or the preferred currency in your settings is different than your Payment Method's billing currency, your payment may be processed outside of your country of residence. As a result, your Payment Method provider may impose certain fees and the amount listed on your Payment Method statement may be different from the amount shown at checkout. For example, if you make a booking using an Australian issued card, but the preferred currency in your settings is set to US dollars, your payment may be processed outside Australia, and banks and credit card companies may impose international transaction fees and foreign exchange fees. In addition, if the preferred currency in your settings is different from your Payment Method's billing currency, your bank or credit card company may convert the payment amount to your billing currency associated with your Payment Method, based on an exchange rate and fee amount determined solely by your bank. Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Please contact your Payment Method provider if you have any questions about these fees or any exchange rate imposed by your Payment Method provider.

    2.7 Booking Request Status. If a requested booking is declined because it is not accepted by the Host, you cancel the booking request before it is accepted by the Host, or Airbnb cancels the booking, any amounts collected by Airbnb Payments and due to you pursuant to the policies described in Section 5.5 will be refunded to you, and any pre-authorization of your Payment Method will be released (if applicable) in accordance with Section 5.5.2.

    2.8 Payment Restrictions. Airbnb Payments reserves the right to decline or limit payments that we reasonably believe (i) may violate Airbnb Payments’ risk management policies or procedures, (ii) may violate these Payments Terms or the Terms, (iii) are unauthorized, fraudulent or illegal; or (iv) expose you, Airbnb, Airbnb Payments, or others to risks reasonably unacceptable to Airbnb Payments.

    2.9 Payment Service Providers. Payment Methods may involve the use of third-party payment service providers. These payment service providers may charge you additional fees when processing payments in connection with the Payment Services, and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Your Payment Method may also be subject to additional terms of use. Please review them before using your Payment Method.

    2.10 Your Payment Method, Your Responsibility. Airbnb Payments is not responsible for any loss suffered by you as a result of incorrect Payment Method information provided by you. Airbnb Payments does not provide any regulated Payment Services to you.

    2.11 Different Ways to Pay

    2.11.1 Pay Part Now, Part Later

    2.11.1.1 Airbnb may make available to Guests the option to pay a portion of the booking’s Total Price at the time of booking and pay the remainder of the Total Price at a later time prior to check-in (“Pay Part Now, Part Later”). Availability of this option may depend on the Listing and/or Payment Method.

    2.11.1.2 If you choose Pay Part Now, Part Later, the Airbnb Platform will notify you during checkout of the amount, currency and schedule of each payment due. On the following payments due date, Airbnb Payments will automatically charge the original Payment Method you used to make the booking.

    2.11.1.3 If you make a modification to a booking made with Pay Part Now, Part Later, Airbnb Payments will notify you of the revised payment schedule, as applicable, and Airbnb Payments will automatically charge the original Payment Method you used to make the booking on the revised payment due dates. If the modification increases your Total Price, you may be required to make an additional partial payment of the new Total Price at the time of the modification.

    2.11.1.4 You agree that by selecting Pay Part Now, Part Later, you may not be able to pay for the booking with a different Payment Method or pursuant to a different payment schedule.

    2.11.1.5 If Airbnb Payments is unable to collect your payment, Airbnb Payments will notify you of such declined payment, and require you to complete the payment using an alternative Payment Method within 72 hours of the notice. If you fail to complete the payment, you authorize Airbnb to cancel the booking on your behalf. If the booking is canceled, you will be refunded based on the Host’s cancellation policy.

    2.11.2 Recurring Payments

    2.11.2.1 For certain bookings (such as for Accommodation bookings of twenty-eight (28) nights or more), Airbnb Payments may require a Guest to make recurring, incremental payments toward the Total Price owed (“Recurring Payments”). More information on Recurring Payments (including the amount and the frequency of payments) will be made available via the Airbnb Platform if applicable to a booking.

    2.11.2.2 If Recurring Payments apply to a confirmed booking, then the Guest authorizes Airbnb Payments to collect the Total Price due.

    2.11.2.3 Guests may stop a Recurring Payment by notifying Airbnb Payments orally or in writing at least three (3) business days before the scheduled date of the payment. Airbnb Payments may require you to give written confirmation of a stop-payment order within fourteen (14) days of an oral notification. If you fail to provide written confirmation within those fourteen (14) days, Airbnb Payments is not obligated to honor your request to stop any future Recurring Payments. If you have any questions regarding your Recurring Payments, please contact Airbnb Payments.

      2.12 Buy now, pay later. 

      Guests may from time to time be offered the possibility to pay for an Accommodation Reservation on credit or other installment options, and pay for them over time ('buy now, pay later'). These Payment Methods will be provided by Klarna Australia Pty Ltd (or its affiliate), not Airbnb, subject to additional terms of use provided at checkout, and Klarna will become your creditor for the payment. Depending on the Payment Method, this may also create a separate relationship between you as the borrower and Klarna as the lender. Please review any applicable additional terms before using these Payment Methods.

      3. Host Terms

      3.1 Payment Collection. Airbnb Payments generally collects the Total Price of a booking at the time the Guest’s booking request is accepted by the Host, unless noted otherwise.

      3.2 Valid Payout Method. 

      3.2.1 In order to receive a Payout you must have a valid Payout Method linked to your Airbnb account. When you add a Payout Method to your Airbnb account, you will be asked to provide information, which may include name, government identification, tax identification, billing address, and financial instrument information either to Airbnb Payments or its third-party payment processor(s). Depending on the Payout Method selected additional information may be required, such as: residential address, name on the account, account type, routing number, account number, email address, payout currency, identification number and account information associated with a particular payment processor. Providing requested information is required for a Payout Method to be valid. The information Airbnb Payments requires for a valid Payout Method may change, and Airbnb Payments may request additional information at any time; failing to provide requested information may result in Airbnb Payments temporarily placing a hold, suspending, or canceling any Payout until the information is provided and, if necessary, validated.

      3.2.2 You authorize Airbnb Payments to collect and store your Payout Method information in accordance with Airbnb’s Privacy Policy. Airbnb Payments may also share your information with governmental authorities as required by applicable law.

      3.3 Timing of Payout

      3.3.1 Subject to and conditional upon successful receipt of the associated payments from Guests, Airbnb Payments will generally initiate Payouts to your selected Payout Method: (i) for Accommodations, 24 hours after the Guest’s scheduled check-in time (or 24 hours after 3:00 pm local time - or 3:00 pm UTC if local time is unknown - if the check-in time is flexible or not specified); (ii) for Experiences, 24 hours after the start of the Experience; and (iii) for all other Host Services, at the time specified via the Airbnb Platform. For Accommodation bookings of twenty-eight (28) nights or more, Airbnb Payments will generally initiate the first payout 24 hours after the Guest’s scheduled check-in time, and will initiate future payouts every 30 days after the initial payout, for the duration of the reservation.

      3.3.2 Airbnb Payments may offer you a different Payout time or trigger for payment via the Airbnb Platform. The time it takes to receive Payouts once released by Airbnb Payments may depend upon the Payout Method you select.

      3.4 Payout.

      Your Payout for a booking will be the Total Price less applicable fees like Airbnb service fees and applicable taxes and any amounts you agree to allocate to any co-host, or the owner(s) of an Accommodation, a homeowners’ association, and/or their agent (such as a building operator or property management company). In the event of cancellation of a confirmed booking, Airbnb Payments will remit the amount you are due (if any) as provided in the Terms and applicable cancellation policy.

      3.5 Payout Restrictions. Airbnb Payments may temporarily place a hold, suspend, or cancel any Payout for the purposes of preventing unlawful activity or fraud, risk assessment, security, or completing an investigation; or if we are unable to verify your identity or where applicable the identity of your representative(s) or beneficial owner(s), or to obtain or verify requested information. Furthermore, Airbnb Payments may temporarily place a hold on, suspend, or delay initiating or processing any Payout due to you under the Terms as a result of high volume booking cancellations or modifications arising from a Force Majeure Event (as defined below).

      3.6 Payout Currency. Airbnb Payments will remit your Payouts in the currency you select via the Airbnb Platform. The currencies available may be limited for regulatory or operational reasons based on factors such as your selected Payout Method, your country of residence, and/or your Airbnb contracting entity(ies). Any such limitations will be communicated via the Airbnb Platform, and you will be prompted to select a different currency or Payout Method. Note that payment service providers may impose transaction, currency conversion or other fees based on the currency or Payout Method you select, and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard.

      3.7 Limits on Payouts. For compliance or operational reasons, Airbnb Payments may limit the amount of a Payout. If you are due an amount above that limit, Airbnb Payments may make a series of Payouts (potentially over multiple days) in order to provide your full Payout amount.

      3.8 Payment Service Providers. Payout Methods may involve the use of third-party payment service providers. These payment service providers may charge you additional fees when processing Payouts in connection with the Payment Services (including deducting charges from the Payout amount), and Airbnb Payments is not responsible for any such fees and disclaims all liability in this regard. Your Payout Method may also be subject to additional terms of use from such third-party payment service providers. Please review them before using your Payout Method.

      3.9 Handling of Funds. Airbnb Payments may combine amounts that it collects from Guests and invest them as permitted under applicable laws. Airbnb Payments will retain any interest it earns on those investments.

      3.10 Your Payout Method, Your Responsibility. Subject to Section 17, Airbnb Payments is not responsible for any loss suffered by you as a result of incorrect Payout Method information provided by you.

      3.11 Different ways to get paid

      3.11.1 Split Payouts If you provide Host Services jointly with one or more other Hosts as part of a team, business or other organization (“Host Team”), Airbnb may make available to such Hosts the option to allocate between the members of the Host Team the total Host Payout for a booking. Airbnb Payments will execute such payments at the instruction of one or more members of the Host Team, and Hosts are responsible for the accuracy of their instructions.

      3.12 Buy now, pay later. If a Guest in Germany chooses to pay for an Accommodation Reservation using a Klarna "buy now, pay later" option (other than a Pay-in-3 option), these additional Host terms apply.

      4. Appointment of Airbnb Payments as Limited Payment Collection Agent

      4.1 Each Host, including each Host Team member, hereby appoints Airbnb Payments as the Host’s payment collection agent solely for the limited purpose of accepting and processing funds from Guests purchasing Host Services on the Host’s behalf.

      4.2 Each Host, including each Host Team member, agrees that payment made by a Guest through Airbnb Payments, shall be considered the same as a payment made directly to the Host, and the Host will provide the Host Service booked by the Guest in the agreed-upon manner as if the Host has received the payment directly from the Guest. Each Host agrees that Airbnb Payments may refund the Guest in accordance with the Terms. Each Host understands that Airbnb Payments’ obligation to pay the Host is subject to and conditional upon successful receipt of the associated payments from Guests. Airbnb Payments guarantees payments to Host(s) only for such amounts that have been successfully received by Airbnb Payments from Guests in accordance with these Payments Terms. In accepting appointment as the limited payment collection agent of the Host, Airbnb Payments assumes no liability for any acts or omissions of the Host, except for acts or omissions the Host is directed to engage in by Airbnb Payments.

      4.3 Each Guest acknowledges and agrees that, notwithstanding the fact that Airbnb Payments is not a party to the agreement between you and the Host(s), including each Host Team member, Airbnb Payments acts as each Host’s payment collection agent for the limited purpose of accepting payments from you on behalf of the Host(s). Upon a Guest’s payment of the funds to Airbnb Payments, the Guest’s payment obligation to the Host(s) for the agreed upon amount is extinguished, and Airbnb Payments is responsible for remitting the funds successfully received by Airbnb Payments to the Host(s) in the manner described in these Payments Terms. In the event that Airbnb Payments does not remit any such amounts, the Host(s) will have recourse only against Airbnb Payments and not the Guest directly.

      4.4 At no point in time is Airbnb Payments holding funds on behalf of the Guest or providing the Guest a payment service.

      5. General Terms

      5.1 Fees. Airbnb Payments may charge fees for use of certain Payment Services and any applicable fees will be disclosed to you in the Terms or via the Airbnb Platform prior to being charged.

      5.2 Payment Authorizations. You authorize Airbnb Payments to collect from you amounts due pursuant to these Payments Terms and/or the Terms by either (i) charging the Payment Method associated with the relevant booking, or any other Payment Method on file that you authorize in your Airbnb account (unless you have previously removed the authorization to charge such Payment Method(s)), or (ii) by withholding the amount from your future Payout. Specifically, you authorize Airbnb Payments to collect from you:

        • Any amount due to Airbnb or Airbnb Payments (e.g., as a result of your bookings, Booking Modifications, cancellations, or other actions as a Guest, Host or user of the Airbnb Platform), including reimbursement for costs prepaid by Airbnb or Airbnb Payments on your behalf. Any funds collected by Airbnb Payments will set off the amount owed by you to Airbnb or Airbnb Payments and extinguish your obligation to Airbnb or Airbnb Payments.
        • Any amount due to a Host from a Guest which Airbnb collects as the Host’s payment collection agent as further set out in Section 4 above.
        • Taxes, where applicable and as set out in the Terms.
        • Any amount you pay through the Resolution Center in connection with your Airbnb account.
        • Any Damage Claim amounts owed to Airbnb or Airbnb Payments in accordance with the Terms and Section 6.
        • Overstay penalties payable under the Terms, including any cost and expenses incurred in collecting the overstay penalty.
        • Any service fees or cancellation fees imposed pursuant to the Terms (e.g., if, as a Host, you cancel a confirmed booking).
        • Any amounts already paid to you as a Host despite a Guest canceling a confirmed booking or Airbnb deciding that it is necessary to cancel a booking in accordance with the Terms, Rebooking and Refund Policy, Experiences Guest Refund Policy, Extenuating Circumstances Policy, or other applicable cancellation policy. You agree that in the event you have already been paid, Airbnb Payments will be entitled to recover the amount of any such Guest refund from you, including by subtracting such refund amount out from any future Payouts due to you.

        If you owe an amount at any time after a booking, such as with Payment Plan or Recurring Payment charges, Booking Modifications, Resolution Center payments or Damage Claims (“Additional Amounts”), you authorize Airbnb Payments to collect payments for such Additional Amounts by charging your Payment Method associated with the relevant booking without any further action on your part. Airbnb Payments will notify you in writing before any Additional Amounts are charged.

        If your Payment Method associated with the relevant booking is expired, invalid or otherwise not able to be charged for any reason (such as insufficient funds), you remain responsible for any uncollected amounts and Airbnb Payments may charge the Payment Method related to your booking again or use any other Payment Method on file associated with your Airbnb account, if available, to collect such Additional Amounts. Any amount not collected for any reason will be subject to any remedies that may be available, including, but not limited to, referral to a collections agency, or pursuit of available causes of action or claims against you.

        If Airbnb has reason to believe that you as a Host participated in fraudulent activity, such as an overpayment scam, booking fraud or other fraud, and Airbnb Payments released the payout for such stay, Airbnb Payments may recoup from you such amount by reducing, setting off or debiting the amount from any future Payouts owed to you.

        In addition to any amount due as outlined above, if there are amounts which you owe us but are unpaid or chargebacks associated with your Payment Method, you may be charged fees or costs for reasonable steps taken by Airbnb and/or Airbnb Payments to collect, recover or process these amounts and chargebacks (“Collection Fees”). The Collection Fees will be limited to: (a) reasonable costs directly incurred by Airbnb Payments and/or Airbnb (such as costs associated with the time our personnel spend collecting, recovering or processing the relevant amounts); and (b) collection fees, convenience fees or other fees or costs that are charged to Airbnb Payments and/or Airbnb by third parties.

        5.3 Collections from Guests and Hosts

        5.3.1 If Airbnb Payments is unable to collect any amounts you owe, as a Guest or as a Host, under the Terms and these Payments Terms, Airbnb Payments may engage in collection efforts to recover such amounts from you.

        5.3.2 Airbnb Payments will deem any owed amounts overdue when: (a) for authorized charges, one hundred and twenty (120) days have elapsed after Airbnb Payments first attempts to charge your Payment Method or the associated services have been provided, whichever is later; and (b) for withholdings from a Host’s future Payouts, two hundred and seventy (270) days have elapsed after the adjustment is made to the Host’s Airbnb account or the associated services have been provided, whichever is later.

        5.3.3 Airbnb Payments will deem any overdue amounts not collected to be in default when three hundred and sixty five (365) days have elapsed: (a) for authorized charges to your Payment Method with respect to a Guest transaction, after Airbnb Payments first attempts to charge your Payment Method or the associated services have been provided, whichever is later; and (b) for withholdings from a Host’s future Payouts, after the adjustment is made to the Host’s Airbnb account or the associated services have been provided, whichever is later.

        5.3.4 You hereby explicitly agree that all communications in relation to amounts owed will be made by electronic mail or by phone, as provided to Airbnb and/or Airbnb Payments by you. Such communications may be made by Airbnb, Airbnb Payments, or by anyone on their behalf, including but not limited to a third-party collection agent.

        5.4 Payment Processing Errors

          5.4.1 Airbnb Payments will take the necessary steps to rectify any payment processing errors that we become aware of. These steps may include crediting or debiting (as appropriate) the original Payout Method or Payment Method used or selected by you, so that you end up receiving or paying the correct amount. This may be performed by Airbnb Payments or a third party such as your financial institution. We may also take steps to recover funds sent to you in error (including but not limited to an event of duplicate payments made to you due to a processing error). For Hosts, this may include, by reducing, setting off and/or debiting the amount of such funds from any future Payouts owed to you.

          5.4.2 To the extent you receive any funds in error, you agree to promptly return such funds to Airbnb Payments after you become aware that you have received such funds in error.

            5.5 Refunds

            5.5.1 Any refunds or credits due to a Member pursuant to the Terms, Extenuating Circumstances Policy, Rebooking and Refund Policy, and Experiences Guest Refund Policy, will be initiated and remitted by Airbnb Payments in accordance with these Payments Terms.

            5.5.2 Subject to this Section 5.5.2, Airbnb Payments will initiate the refund process immediately. In the case of a cancellation by a Host, Airbnb Payments will hold the funds for up to 72 hours until the Guest is either refunded or the funds are used to rebook with another Host. In certain instances, the refund process may include the option to receive credit in lieu of a cash refund; if this option is made available to you, the timing of your refund will be communicated via the Airbnb Platform. The time it takes to receive any cash refund or for any pre-authorization of your Payment Method to be released will vary based on the Payment Method and any applicable payment system (e.g., Visa, Mastercard, etc.) rules. In the event of a Force Majeure Event that may affect the processing and settlement of refunds, Airbnb Payments will initiate and process the refund as soon as is practicable.

            6. Damage Claims and Damage Amounts

            6.1 If you are responsible for Damage Claim amounts, pursuant to Section 14 of the Terms, Airbnb via Airbnb Payments may, on reasonable notice to you, charge the Payment Method used to make the booking or any other Payment Method associated with your Airbnb account at the time of the Damage Claim or within a reasonable period thereafter in order to collect the Damage Claim amounts, up to a maximum amount as defined in Section 14 of the Terms. To facilitate this charge, when you book a Listing, you are agreeing that Airbnb via Airbnb Payments may charge the Payment Method used to book the Listing in order to collect Damage Claim amounts.

            6.2 To the maximum extent permitted by law, you agree that Airbnb Payments may seek to recover from you under any insurance policies you maintain and that Airbnb Payments may also pursue against you any remedies it may have available, including, but not limited to, referral to a collections agency, or pursuit of causes of action or claims against you, including in relation to a Damage Claim, or payment requests made by Hosts under the Host Damage Protection.

            7. Abandoned Property

            If Airbnb Payments holds funds due to you (e.g., because we are unable to issue you a Payout or refund) or you do not use a gift card or gift credit for the relevant period of time set forth by your state, country, or other governing body in its unclaimed property laws, we may process the funds due to you in accordance with our legal obligations, including by reporting and escheating (sending) such funds to the appropriate governing body as required by applicable unclaimed property laws.

            8. Prohibited Activities

            8.1 You are solely responsible for compliance with any and all laws, rules, regulations, and tax obligations that may apply to your use of the Payment Services. In connection with your use of the Payment Services, you may not and you agree that you will not and will not assist or enable others to:

              • breach or circumvent any applicable laws or regulations, including to facilitate anyone else to breach or circumvent any applicable laws or regulations;
              • breach or circumvent any agreements with third parties, third-party rights, or the Terms, Additional Legal Terms, Policies, or Standards;
              • use the Payment Services for any commercial or other purposes that are not expressly permitted by these Payments Terms;
              • register or use any Payment Method or Payout Method with your Airbnb account that is not yours or you do not have authorization to use;
              • avoid, bypass, remove, deactivate, impair, descramble, or otherwise circumvent any technological measure implemented by Airbnb Payments or any of Airbnb Payments’ service providers or any other third party to protect the Payment Services;
              • take any action that damages or adversely affects, or could damage or adversely affect, the performance or proper functioning of the Payment Services;
              • attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Payment Services; or
              • violate or infringe anyone else’s rights or otherwise cause harm to anyone.

              8.2  We are required to act in accordance with our internal policies and the laws of various jurisdictions relating to the prevention of money laundering and the implementation of sanctions including: (i) economic or financial sanctions or trade embargoes imposed, administered or enforced from time to time by the U.S. government, including those administered by the Office of Foreign Asset Control or the U.S. Department of State; or (ii) by the United Nations Security Council, the European Union or His Majesty’s Treasury of the United Kingdom. You will comply with any relevant financial sanctions and any relevant export control laws applicable to you and to your local jurisdiction.

              9. Force Majeure

              As between Airbnb and a Member, neither shall be liable to the other for any delay or failure to perform resulting from causes outside their reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials (“Force Majeure Event”). For the avoidance of doubt, this clause does not: (i) apply to a Reservation, which is subject to the Host’s cancellation policy and the Extenuating Circumstances Policy; or (ii) operate to extend deadlines applicable to a Resolution Centre Request, a Host Damage Protection claim, an Aircover for guests claim, a Travel Issue under the Rebooking and Refund Policy or an Experiences Issue under the Experiences Guest Refund Policy, or other requests, claims or reporting under similar policies that are incorporated by reference into these Terms.

              10. Disclaimers

              10.1 If you choose to use the Payment Services, you do so voluntarily and at your sole risk. 

              10.2 Notwithstanding Airbnb Payments’ appointment as the limited payment collection agent of Hosts pursuant to Section 4 and subject to Section 11, Airbnb Payments explicitly disclaims all liability for any act or omission by you, any Member or other third party. Airbnb Payments does not have any duties or obligations as agent for each Host except to the extent expressly set forth in these Payments Terms, and any additional duties or obligations as may be implied by law are, to the maximum extent permitted by applicable law, expressly excluded.

              10.3 If we choose or are required to conduct identity verification on any Member, to the extent permitted by applicable law, we disclaim warranties of any kind, either express or implied, that such checks will identify prior misconduct by a Member or guarantee that a Member will not engage in misconduct in the future. We are not responsible for prior misconduct by a Member where such misconduct was unknown by us.

              10.4 The foregoing disclaimers apply to the maximum extent permitted by law. You may have other statutory rights or warranties which cannot lawfully be excluded. However, the duration of any statutorily required warranties shall be limited to the maximum extent (if any) permitted by law.

              11. Liability

              11.1 You acknowledge and agree that, to the maximum extent permitted by law, the risk arising out of your access to and use of the Payment Services remains with you. If you permit or authorize another person to use your Airbnb account in any way, you are responsible for the actions taken by that person. To the maximum extent permitted by law, no party, including Airbnb’s affiliates and personnel, or any other party involved in or delivering the Payment Services will be liable for any incidental, special, exemplary, or consequential damages. Incidental, special, exemplary or consequential damages, include, to the maximum extent permitted by law, lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services. Neither is Airbnb Payments liable nor any other party liable, to the extent permitted by law, for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Payments Terms, (ii) from the use of or inability to use the Payment Services, or (iii) from any communications, interactions, or meetings with other Members or other persons with whom you communicate, interact, transact, or meet with as a result of your use of the Payment Services, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not Airbnb Payments has been informed of the possibility of such damage, even if a limited remedy set forth herein is found to have failed of its essential purpose.

              11.2 Except for: (i) Airbnb’s obligation to pay amounts to applicable Hosts pursuant to these Payments Terms; (ii) Airbnb’s obligation to make payments under the Airbnb Host Damage Protection, which contains its own limitation of liability; and/or (iii) Airbnb Payments’ wilful breach of these Terms, to the maximum extent permitted by law, in no event shall Airbnb Payments’ aggregate liability arising out of or in connection with these Payments Terms and your use of the Payment Services including, but not limited to, from your use of or inability to use the Payment Services, exceed (A) to Guests, three (3) times the amount you paid for the relevant Reservation(s) giving rise to the liability, or (B) to Hosts, three (3) times the amount paid to you for the relevant Reservation(s) giving rise to the liability. The limitations of damages set forth above are fundamental elements of the basis of the bargain between Airbnb Payments and you.

              11.3 Except in the case of a Member’s wilful breach of these Terms, to the maximum extent permitted by law, in no event shall a Member’s liability to Airbnb or any other party involved in creating, producing, or delivering the Airbnb Platform or any Content for any claim or dispute arising out of or in connection with these Payments Terms, interaction with any Member, or your use of or inability to use the Airbnb Platform, any Content, or any Host Service exceed: (A) in the case of Guests, three (3) times the amount you paid for the relevant Reservation(s) giving rise to the liability, or (B) in the case of Hosts, three (3) times the amount paid to you for the relevant Reservation(s) giving rise to the liability.

                12. Indemnification

                To the maximum extent permitted by applicable law, you agree to release, defend (at Airbnb Payments’ option), indemnify, and hold Airbnb (including Airbnb Payments, other affiliates and subsidiaries, and their officers, directors, employees, and agents) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of (i) your breach of these Payments Terms (including any supplemental or additional terms that apply to a product or feature) or our Additional Legal Terms, Policies, or Standards; (ii) your improper use of the Payment Services; (iii) your failure, or our failure at your direction, to accurately report, collect or remit Taxes; or (iv) your breach of any laws, regulations, or third-party rights, such as intellectual property or privacy rights. The indemnification obligation only applies if and to the extent that the claims, liabilities, damages, losses, and expenses have been adequately caused by your negligence or breach of a contractual obligation.

                13. Modification, Term, Termination, and other Measures

                13.1 Modification. Airbnb Payments may modify these Payments Terms at any time. If we make material changes to these Payments Terms, we will post the revised Payments Terms on the Airbnb Platform and update the “Last Updated” date at the top of these Payments Terms. If you are affected by the modification, we will also provide you with notice of the modifications at least two (2) months before the date they become effective. If you do not terminate your agreement before the date the revised Payments Terms become effective, your continued use of the Payment Services will constitute acceptance of any changes to the revised Payments Terms.

                13.2 Term. This agreement between you and Airbnb Payments is effective (i) if you are a Guest, from when you make your first booking; or (ii) if you are a Host, from when a Guest first books a Listing made available by you and you use the Payment Services and remains in effect until either you or we terminate this agreement in accordance with Section 13.3.

                13.3 Termination. You may terminate this agreement at any time by sending us an email or by deleting your Airbnb account. Without limiting our rights specified below, Airbnb Payments may terminate this agreement for convenience at any time by giving you thirty (30) days' notice via email to your registered email address (or two (2) months’ prior notice for Members contracting with Airbnb Payments UK). Airbnb Payments may also terminate this agreement immediately without notice if (i) you have materially breached your obligations under this agreement; (ii) you have provided inaccurate, fraudulent, outdated, or incomplete information; (iii) you have violated applicable laws, regulations, or third-party rights; or (iv) Airbnb Payments believes in good faith that such action is reasonably necessary to protect other Members, Airbnb, Airbnb Payments, or third parties. In case of non-material breaches or where otherwise reasonable, you will be given reasonable notice of any actions that Airbnb proposes to take and an opportunity to remedy the non-material breach (if it is capable of remedy) unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other Members or third parties, or (iii) contravene applicable laws. Terminating this agreement will also serve as notice to cancel your Airbnb account pursuant to the Terms.

                13.4 Suspension and Other Measures. Airbnb Payments may limit or temporarily or permanently suspend your use of or access to the Payment Services (i) to comply with applicable law, or the order or request of a court, law enforcement, or other administrative agency or governmental body, (ii) if you have materially breached these Payments Terms, the Terms, applicable laws, regulations or third-party rights, (iii) if you have provided inaccurate, fraudulent, outdated, or incomplete information regarding a Payment Method or Payout Method, (iv) for any amounts you owe under these Payments Term that are overdue or in default, or (v) if Airbnb Payments believes in good faith that such action is reasonably necessary to protect the personal safety or property of Airbnb, its Members, Airbnb Payments, or third parties, or to prevent fraud or other illegal activity. Further, for unsuccessful payment due to card expiration, insufficient funds, or otherwise, we may temporarily suspend your access to the Payment Services until we can charge a valid Payment Method.

                13.5 Appeal. If Airbnb Payments takes any of the measures described in Section 13.3 you may appeal such a decision by contacting customer service.

                13.6 Effect of Termination. If you cancel your Airbnb account as a Host or Airbnb Payments takes any of the measures described above, Airbnb Payments may provide a full refund to any Guests with confirmed booking(s), and you will not be entitled to any compensation for pending or confirmed bookings that were cancelled. If you cancel your Airbnb account as a Guest, Airbnb Payments will initiate a refund for any confirmed booking(s) based on the Listing’s cancellation policy. If your access to or use of the Payment Services has been suspended or limited or this agreement has been terminated by us, you may not register a new Airbnb account or attempt to access and use the Payment Services through an Airbnb account of another Member.

                  13.7 Survival. Sections 1.2, 2.2, 2.3, 2.4, 2.5, 2.6, 2.7, 2.8, 2.9, 2.10, 2.11, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17 and 19, survive expiry or termination, together with any other terms that, by reasonable implication or to give them efficacy are, or are intended, to be performed in whole or in part after the expiry or termination of this agreement.

                  14. Governing Law and Dispute Resolution

                  14.1 If you are contracting with Airbnb Payments UK, these Payments Terms will be interpreted in accordance with English law. If you are acting as a consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of English law. As a consumer, you may only bring proceedings relating to these Payments Terms before the competent court of your place of residence or a court in England. If Airbnb wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the English courts.

                  14.2 If you are contracting with Airbnb Payments Australia, these Payments Terms will be governed by the laws of the State of New South Wales, Australia. The parties agree to submit to the non-exclusive jurisdiction of the courts of that State and courts of appeal of that State in respect of any proceedings arising out of or in connection with this agreement.

                  15. United States Arbitration Agreement

                  PLEASE READ THE FOLLOWING PARAGRAPHS CAREFULLY BECAUSE THEY PROVIDE THAT YOU AND AIRBNB PAYMENTS AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION AND INCLUDE A CLASS ACTION WAIVER AND JURY TRIAL WAIVER. This Arbitration Agreement supersedes all prior versions.

                  15.1 Application. This Arbitration Agreement only applies to you if you are contracting with Airbnb Payment US. If you are not contracting with Airbnb Payments US, and you nevertheless attempt to bring any legal claim against Airbnb Payments in the United States, this Arbitration Agreement will apply for determination of the threshold issue of whether this Section 15 applies to you, and all other threshold determinations, including residency, arbitrability, venue, and applicable law.

                  15.2 Overview of Dispute Resolution Process. Airbnb Payments is committed to participating in a consumer-friendly dispute resolution process. To that end, these Payments Terms provide for a two-part process for individuals to whom this Section 15 applies: (1) an informal negotiation directly with Airbnb’s customer service team (described in Section 15.3), and if necessary (2) a binding arbitration in accordance with the terms of this Arbitration Agreement. You and Airbnb Payments each retain the right to seek resolution of the dispute in small claims court as an alternative to arbitration.

                  15.3 Mandatory Pre-Arbitration Dispute Resolution and Notification. At least 30 days prior to initiating an arbitration, you and Airbnb Payments each agree to send the other party an individualized notice of the dispute in writing (“Pre-Dispute Notice”) and attempt in good faith to negotiate an informal resolution of an individual claim. You must send your Pre-Dispute Notice to Airbnb Payments by mailing it to Airbnb Payments’ agent for service: CSC Lawyers Incorporating Service, 2710 Gateway Oaks Drive, Suite 150N, Sacramento, California 95833. Airbnb Payments will send its Pre-Dispute Notice to the email address associated with your Airbnb account. A notice of dispute must include: the date, your name, mailing address, your Airbnb username, the email address you used to set up your Airbnb account, your signature, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 30-day period, only then may either party commence arbitration by filing a written demand for arbitration with the arbitration provider designated pursuant to Section 15.6, below. A claimant’s Pre-Dispute Notice requirement is a prerequisite to any arbitration, and a copy of the Pre-Dispute Notice and evidence that it was sent as required by this Section must be attached to any arbitration demand.

                  15.4 Agreement to Arbitrate. You and Airbnb Payments mutually agree that any dispute, claim or controversy arising out of or relating to these Payments Terms or the applicability, breach, termination, validity, enforcement or interpretation thereof, or any use of the Payment Services (collectively, “Disputes”) will be settled by binding arbitration on an individual basis (the “Arbitration Agreement”). If there is a dispute about whether this Arbitration Agreement can be enforced or applies to our Dispute, you and Airbnb Payments agree that the arbitrator will decide that issue. For the avoidance of doubt, you and Airbnb agree that any question regarding arbitrability and the formation, enforceability, validity, scope, or interpretation of all or part of this Section 15, including any dispute over compliance with the Pre-Dispute Notice requirement and a party’s responsibility to pay arbitration fees, shall be resolved by an arbitrator.

                  15.5 Exceptions to Arbitration Agreement. You and Airbnb Payments each agree that the following causes of action and/or claims for relief are exceptions to the Arbitration Agreement and will be brought in and will be brought in a judicial proceeding in state or federal court in San Francisco, California, unless we both agree to some other location: (i) any claim or cause of action seeking emergency injunctive relief based on exigent circumstances (e.g., imminent danger or commission of a crime, hacking, cyber-attack); (ii) a request for the remedy of public injunctive relief; (iii) any claim or cause of action for vexatious litigation; or (iv) any individual claim of sexual assault or sexual harassment arising from your use of the Airbnb Platform or Host Services. You and Airbnb Payments agree that any request for the remedy of public injunctive relief will proceed after the arbitration of all arbitrable claims, remedies, or causes of action, and will be stayed pending the outcome of the arbitration pursuant to section 3 of the Federal Arbitration Act.

                  15.6 Arbitration Forum, Rules and Governing Law. This Arbitration Agreement evidences a transaction in interstate commerce and the Federal Arbitration Act governs all substantive and procedural interpretation and enforcement of this Arbitration Agreement, and not state law. The arbitration will be administered by ADR Services, Inc. (“ADR”) (www.adrservices.com) in accordance with Rules 1, 6–7, 8–9, and 11–12, 45, 54, and 56 of the Federal Rules of Civil Procedure (“Selected Federal Rules") (https://www.uscourts.gov/rules-policies/current-rules-practice-procedure/federal-rules-civil-procedure) and ADR’s Arbitration Rules then in effect (the “ADR Rules”), except as the Selected Federal Rules or ADR Rules are modified by or conflict with this Arbitration Agreement. The ADR Rules are available at www.adrservices.com. If an arbitration demand is submitted to ADR Services in accordance with this agreement and the ADR Rules, and ADR Services cannot or will not administer the arbitration, the arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Selected Federal Rules and the AAA’s Consumer Arbitration Rules and/or other AAA arbitration rules determined to be applicable by the arbitrator (the “AAA Rules”) then in effect, except as modified here. The AAA Rules are available at www.adr.org. If the AAA cannot and will not administer the arbitration, you and Airbnb Payments shall confer and select an alternative arbitral forum, and if we are unable to agree, either you or Airbnb Payments may ask a court to appoint an arbitrator pursuant to 9 U.S.C. § 5. In that event, the arbitration will be conducted in accordance with the rules of the appointed arbitral forum, unless those rules are inconsistent with the provisions of this Arbitration Agreement.

                  15.7 Modification of Arbitration Rules - Arbitration Hearing/Location. In order to make the arbitration most cost-effective, efficient, and convenient to you, any required arbitration hearing in an arbitration wherein the amount in controversy does not exceed US $1,000,000, shall be conducted remotely via video conference except as otherwise agreed by the parties or instructed by the arbitrator. Any required arbitration hearing in an arbitration wherein the amount in controversy exceeds US $1,000,000 shall be conducted in San Francisco County except as otherwise agreed by the parties or instructed by the arbitrator. If the amount in controversy is US $10,000 or less, the parties agree to proceed solely on the submission of documents to the arbitrator.

                  15.8 Modification of Arbitration Rules - Arbitration Fees and Costs. Your arbitration fees and your share of arbitrator compensation shall be governed by the ADR Rules and the ADR Services fee schedule (available at www.adrservices.com). If you have a gross monthly income of less than 300% of the federal poverty guidelines, you are entitled to a waiver of arbitration fees and costs, exclusive of arbitrator fees. You may request a fee waiver by providing the arbitration provider with a declaration under oath stating your monthly income and the number of persons in your household. If a fee waiver is granted by the arbitration provider and you provide Airbnb Payments with documents necessary to prove that your gross monthly income is less than 300% of the federal poverty guidelines, Airbnb Payments will pay your share of any arbitrator fees.

                  15.9 Modification of Arbitration Rules - Claims Brought for an improper Purpose or in Violation of This Arbitration Agreement. Either party may make a request that the arbitrator impose sanctions upon proving that the other party or its attorney(s) has asserted a claim, or defense that is groundless in fact or law, brought in bad faith or for the purpose of harassment, or is otherwise frivolous. As allowed by applicable law and the AAA Rules the arbitrator shall impose sanctions equal to the requesting party’s reasonable attorneys’ fees and costs upon finding that a claim or defense is groundless in fact or law, brought in bad faith or for the purpose of harassment, asserted in violation of Fed. R. Civ. P. 11(b) (treating the arbitrator as “the court”), or is otherwise frivolous. Either party may seek dismissal of any arbitration filed in violation of any provision of this Arbitration Agreement. Either party may assert in arbitration a counterclaim for the other party’s initiation of proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement. Upon finding that a party has initiated proceedings concerning an arbitrable Dispute without complying with or otherwise in violation of the requirements of this Arbitration Agreement, the arbitrator shall award the other party its actual damages, including but not limited to reasonable attorneys’ fees and costs.

                  15.10 Arbitrator’s Decision. The arbitrator will issue a written decision which shall include the essential findings and conclusions upon which the arbitrator based the award. Judgment on the arbitration award may be entered in any court with proper jurisdiction. The arbitrator may award any relief allowed by law or the AAA Rules, but declaratory or injunctive relief may be awarded only on an individual basis and only to the extent necessary to provide relief warranted by the claimant’s individual claim.

                  15.11 Jury Trial Waiver. You and Airbnb Payments acknowledge and agree that both parties are each waiving the right to a trial by jury as to all arbitrable Disputes.

                  15.12 No Class Actions or Representative Proceedings. You and Airbnb Payments acknowledge and agree that, to the fullest extent permitted by law, we are each waiving the right to participate as a plaintiff or class member in any purported class action lawsuit, class- wide arbitration, private attorney general action, or any other representative or consolidated proceeding. Unless we agree in writing or as provided in this agreement, the arbitrator may not consolidate more than one party’s claims and may not otherwise preside over any form of any class or representative proceeding. If there is a final judicial determination that applicable law precludes enforcement of the waiver contained in this paragraph as to any claim, cause of action or requested remedy, then that claim, cause of action or requested remedy, and only that claim, cause of action or requested remedy, will be severed from this agreement to arbitrate and will be brought in a court of competent jurisdiction. In the event that a claim, cause of action or requested remedy is severed pursuant to this paragraph, then you and we agree that the claims, causes of action or requested remedies that are not subject to arbitration will be stayed until all arbitrable claims, causes of action and requested remedies are resolved by the arbitrator.

                  15.13 Mass Action Waiver. You and Airbnb Payments acknowledge and agree that the relative benefits and efficiencies of arbitration may be lost when 100 or more arbitration claims are filed within 180 days which (1) involve the same or similarly situated parties; (2) are based on the same or similar claims which arise from the same or substantially identical transactions, incidents, alleged violations or events requiring the determination of the same or substantially identical questions of law or fact; and (3) involve the same or coordinated counsel for the parties (“Mass Action”). Accordingly, you and Airbnb Payments agree to waive the right to have any Dispute administered, arbitrated, or resolved as part of a Mass Action (though Sections 15 and 15.12 will continue to apply to the Dispute). In case of a dispute, the appointed arbitrator for the first matter instituted within a set of claims identified by either party shall decide whether those claims are part of a Mass Action. If no arbitrator has yet been appointed, an arbitrator shall be appointed solely to determine whether claims identified by either party are part of a Mass Action. Nothing in this provision prevents you or Airbnb Payments from participating in a mass settlement of claims.

                  15.14 Modification of Arbitration Rules – Mass Action Batching Requirements. If for any reason, notwithstanding Section 15.13, an arbitration proceeds as part of a Mass Action, the parties shall group the arbitration demands into batches of no more than 200. The batches shall be determined by listing the claimants’ alphabetically (by last name or business name, as applicable)—for example, the first 200 claimants listed will be the first batch, the next 200 claimants listed will be the second batch, and so forth. The parties shall randomly assign each batch a sequential number and arbitrate the batches one at a time, in sequential order. While one batch is being arbitrated, the arbitration provider shall hold the remainder in abeyance unless otherwise agreed by the parties or instructed by the arbitration provider. Each batch shall be resolved within 240 days of the pre-hearing conference for that batch. Notwithstanding the forgoing, if any claimant’s demand has not been the subject of a pre-hearing conference within 2 years of the latest-filed demand in the Mass Action, such claimant may elect to pursue the claims asserted in the claimant’s demand in court subject to Sections 14 and 15.12.

                  15.15 Modifications of Arbitration Rules - Offers of Judgment. At least 10 days before the date set for the arbitration hearing, you or Airbnb Payments may serve a written offer of judgment on the other party to allow judgment on specified terms. If the offer is accepted, the offer with proof of acceptance shall be submitted to the arbitration provider, who shall issue an award accordingly. If the offer is not accepted prior to the arbitration hearing or within 30 days after it is made, whichever occurs first, it shall be deemed withdrawn and cannot be given as evidence in the arbitration, other than with respect to costs (including all fees paid to the arbitration provider). If an offer made by one party is not accepted by the other party, and the other party fails to obtain a more favorable award, the other party shall not recover their post-offer costs and shall pay the offering party’s costs (including all fees paid to the arbitration provider) from the time of the offer.

                  15.16 Severability. Except as provided in Section 15.12, in the event that any portion of this Arbitration Agreement is deemed illegal or unenforceable, such provision shall be severed and the remainder of the Arbitration Agreement will be given full force and effect.

                  15.17 Amendment to Agreement to Arbitrate. If Airbnb Payments amends this Section 15 after the date you last accepted these Payments Terms (or accepted any subsequent changes to these Payments Terms), you may reject the change by sending us written notice no later than thirty (30) days of the date the change is effective. Your notice must include your name, mailing address, the date of the notice, your Airbnb username, the email address you used to set up your Airbnb account, your signature, and an unequivocal statement that you want to opt out of the amended Section 15. You must either mail your notice to this address: 888 Brannan St, San Francisco, CA 94103, Attn: Arbitration Opt-Out, or email the opt-out notice to arbitration.opt.out@airbnb.com. Rejecting a new change, however, does not revoke or alter your prior consent to any earlier agreements to arbitrate any Dispute between you and Airbnb Payments (or your prior consent to any subsequent changes thereto), which will remain in effect and enforceable as to any Dispute between you and Airbnb Payments.

                  15.18 Survival. Except as provided in Section 15.12 and subject to Section 13.7, this Section 15 will survive any termination of these Payments Terms and will continue to apply even if you stop using the Payment Services or terminate your Airbnb account.

                  16. Miscellaneous

                  16.1 Interpreting these Payments Terms. Except as they may be supplemented by additional terms and conditions, policies, guidelines, or standards, these Payments Terms constitute the entire agreement between Airbnb Payments and you regarding the subject matter hereof, and supersede any and all prior oral or written understandings or agreements between Airbnb Payments and you regarding the Payment Services. This clause does not exclude a party’s liability for prior false, misleading or deceptive statements or misrepresentations, whether oral or written. If any provision of these Payments Terms is held to be invalid or unenforceable, such provision will be struck and will not affect the validity and enforceability of the remaining provisions.

                  16.2 No Waiver. Subject to any limitation expressly stated in these Payments Terms or the Terms, or any document, policy or standard incorporated into them, Airbnb Payments’ or a Member’s failure to enforce any right or provision in these Payments Terms will not constitute a waiver of such right or provision unless acknowledged and agreed between the relevant parties in writing. Except as expressly set forth in these Payments Terms, the exercise by Airbnb Payments or a Member of any of its remedies under these Payments Terms will be without prejudice to its other remedies under these Payments Terms or otherwise permitted under law.

                  16.3 Assignment. You may not assign, transfer, or delegate this agreement or your rights and obligations hereunder without Airbnb Payments’ prior written consent (not to be unreasonably withheld or delayed). Airbnb Payments may assign, transfer, or delegate this agreement and any rights and obligations, at its sole discretion, with thirty (30) days’ prior notice (or two (2) months’ prior notice (for Members contracting with Airbnb Payments UK) provided that this would not reduce your rights or benefits under these terms.

                  16.4 Notices. Unless specified otherwise, any notices or other communications permitted or required under this agreement, will be in writing and given by Airbnb Payments via email or Airbnb Platform notification, and depending on your notification setting, messaging service (including SMS and WeChat). The date of receipt will be deemed the date on which Airbnb Payments transmits the notice.

                    17. Additional Clauses for Users Contracting with Airbnb Payments UK

                    This Section 17 will apply if you are contracting with Airbnb Payments UK. To the extent that there is any conflict between this Section 17 and any other provision of these Payment Terms, the provisions of this Section 17 shall apply

                    17.1 Payment Service User

                    17.1.1 The Payment Services include the payment collection service provided to Hosts contracting with Airbnb Payments UK. The payment collection service constitutes a “payment service” regulated under the Payment Services Regulations and for these purposes Airbnb Payments UK treats Hosts as the “payment service user.”

                    17.1.2 By agreeing to these Payments Terms you as a Host have consented to Airbnb Payments UK’s payment of each Payout to your chosen Payout Method. Hosts may change a Payout Method up to one (1) day before the time agreed for the Payout as set out in Section 3.3. Airbnb Payments UK will be deemed to have received the Host's payment order to the Host on the same date Airbnb Payments UK agrees to initiate the Payout in accordance with Section 3.3.

                    17.1.3 Airbnb Payments UK will endeavor to ensure that Hosts based in the UK will receive each Payout by the end of the business day following Airbnb Payments UK’s initiation of the Payout.

                    17.1.4 Communication. Airbnb Payments will provide the Host notice via email when we initiate each Payout. We will also provide notice to a Host’s registered email address if the Payout is returned to us because of an error. It is your responsibility as a Host to ensure that you provide us with a current, accurate, and valid email address.

                    17.2 Diverted Payouts and Complaints

                    17.2.1 If you as a Host believe or become aware that a Payout properly due to you has been or may be diverted without your authorization (“Diverted Payout”) because your password or other credentials to log into your Airbnb account (“Credentials”) have been lost, stolen, or misappropriated, you should notify Airbnb Payments UK without undue delay. As a Host you may be liable for losses relating to any Diverted Payout arising from the use of lost, stolen, or misappropriated Credentials (including the loss of a mobile phone on which you have installed the Application) or where you have failed to keep your Credentials safe, up to a maximum of £35. Provided that you notify us of any Diverted Payout without delay and at the very latest within 13 months of the date of the payment, you may be entitled to a refund of that payment.

                    17.2.2 If you as Host claim not to have received a Payout properly due to you via your chosen Payout Method (including where there has been a Diverted Payout), Airbnb Payments UK will (if requested by you without undue delay, on becoming aware of the unauthorized or incorrectly executed Payout and in any event within 13 months of it happening) make immediate efforts to trace the payment and will notify you of the outcome. Subject to Section 17.2.3, unless we can prove that (i) the Payout was received by you via your chosen Payout Method, or (ii) we made the Payout correctly using the Payout Method information you provided but the information you provided was incorrect, we will refund the amount. Where you have given us incorrect information, we will not be liable for the defective or non-execution of the Payout, however, we will make reasonable efforts to recover the Payout funds.

                    17.2.3 You must use your Credentials in accordance with these Payment Terms, and take all reasonable steps to keep your Credentials safe. As a Host you may be liable for losses suffered by Airbnb Payments UK in attempting to trace and recover a Diverted Payout (up to a maximum of £35) arising from the use of lost, stolen, or misappropriated Credentials including where due to the loss of a mobile phone on which you have installed the Application or where you have failed to keep your Credentials safe. You will not be liable for losses suffered by Airbnb Payments UK in attempting to trace and recover a Diverted Payout where the loss, theft or misappropriation of your Credentials was not detectable by you prior to the Diverted Payout (unless you acted fraudulently in connected with the Diverted Payout), or where the loss suffered by Airbnb Payments UK was caused by acts or omissions of Airbnb personnel or a service provider. You may however be liable to Airbnb Payments UK for all losses relating to attempted tracing and recovery of a Diverted Payout if we can produce reasonable evidence that you acted fraudulently or where you failed to use the Airbnb Platform and/or Payment Services in accordance with the Terms or these Payment Terms (including the obligation to keep your Credentials safe). Except where you have acted fraudulently, you will not be liable to Airbnb Payments UK for any losses incurred in respect of the attempted tracing and recovery of a Diverted Payout arising after notification by you of the loss, theft, or misappropriation of your Credentials or of the unauthorized use of your Credentials, where we have failed at any time to provide appropriate means for such notification, or where we do not require strong customer authentication, where required.

                    17.2.4 Any complaints about the Payment Services should be made to Airbnb Payments UK. If you are not happy with the outcome of a complaint and you as a Host have received regulated Payment Services from Airbnb Payments UK, you may also be able to refer your complaint to the Financial Ombudsman. All complaints to the Financial Ombudsman Service are subject to the rules of the Financial Ombudsman Service, including in relation to eligibility requirements. The UK Financial Ombudsman Service offers a free complaints resolution service. You may obtain further information regarding the Financial Ombudsman Services and contact details at: http://www.financial-ombufsman.org.uk.

                    18. Additional Clauses for Users Contracting with Airbnb Payments UK

                    The following paragraphs also apply if you are using the Payment Services as a representative (“Representative”) acting on behalf a business, company or other legal entity (in such event, for purposes of the Payments Terms, “you” and “your” will refer and apply to that business, company or other legal entity).

                    18.1 You accept the Payments Terms and you will be responsible for any act or omission of employees or third-party agents using the Payment Service on your behalf.

                    18.2 You and your Representative individually affirm that you are authorized to provide the information described in Section 2.1 and Section 3.2 and your Representative has the authority to bind you to these Payments Terms. We may require you to provide additional information or documentation demonstrating your Representative’s authority.

                    18.3 You represent and warrant to us that: (i) you are duly organized, validly existing and in good standing under the laws of the country in which your business is registered and that you are registering for receiving the Payment Services; and (ii) you have all requisite right, power, and authority to enter into this agreement, perform your obligations, and grant the rights, licenses, and authorizations in this agreement.

                    18.4 If you are using your Payment Method for the benefit of your employees or other authorized third-party in connection with Airbnb for Work, as permitted by your account, you authorize Airbnb Payments to charge your Payment Method for bookings requested by employees at your company or other permitted third-party.

                    18.5 For any Payout Method linked to your Airbnb account, you authorize Airbnb Payments to store the Payout Method, remit payments using the Payout Method for bookings associated with your Airbnb account and take any other action as permitted in the Payments Terms in respect of the Payout Method.

                      18.6 If you handle, store or otherwise process payment card information on behalf of anyone or any third-party, you agree to comply on an ongoing basis with applicable data privacy and security requirements under the current Payment Card Industry Data Security Standard with regards to the use, access, and storage of such credit card information.
